Re: Findings of Fact, application of Richard Scott to amend an
existing 6.8 acre planned commercial development by converting an
existing 12,000 square foot building to retail use, 1519 Shelburne
Road.
On the 28th of September, 1993, the South Burlington Planning
Commission approved the request of Richard S. Scott for revised
final plat approval under Section 204 of the South Burlington
Subdivision Regulations based on the following findings:
1. This project consists of converting the former G.E. Supply
building to retail electronics sales and construction of 20'x30'
ramp. This is one (1) of three (3) buildings on the same lot, the
other buildings include the Jiffy Lube building and Grossman's
building supply. Since there is more than one (1) principal
building on a lot and the lot is over four (4) acres, this
application is being treated as an amendment to a PCD. The sketch
plan was reviewed on 8/10/93.
2. This property located at 1519 Shelburne Road lies within the C2
District. It is bounded on the north by Town & Country Furniture
and Goss Dodge, on the west by Vermont Railway, on the south by
Bartlett Bay Road and on the east by Shelburne Road.
3. Access/circulation: Access is provided by an ingress only curb
cut which is 35 feet wide on Shelburne Road and an access drive to
Bartlett Bay Road. The Bartlett Bay Road access is via a 44 foot
wide curb cut shared with the Jiffy Lube building. No changes are
proposed.
Circulation is adequate.
4. Parking: The new use requires a total of 27 spaces and 28
spaces are being provided including two (2) handicapped spaces.
5. Landscaping: The site is currently well landscaped so no
additional landscaping is recommended.
6. Coverage/setbacks: Building coverage is 19.1% (maximum allowed
is 30%). Overall coverage is 61.5% (maximum allowed is 70%).
Front yard coverage is 56% (maximum allowed is 30%). This is an
existing situation which will not be made worse by this
application.
7. Traffic: The only issue raised at the 8/10/93 meeting was
traffic generation. At the Commission's request, the applicant

submitted a traffic generation report dated 8/31/93. The study
indicates that the previous use generated 12 P.M. peak hour vehicle
trip ends (vte's). The proposed use is projected to generate 51
vte's for a 39 vte or 325% increase. Although traffic generation
will increase, the study points out that the 6.9 acre lot on which
this building sits is allowed 333 vte's by Traffic Overlay District
Zone 5, and all the uses on the property will generate 167 vte's.
This represents 166 vte's or 50% less than is allowed by the
Traffic Overlay District.
However, since this is a PUD, the Commission has the authority to
review a project's impact on nearby intersections. The Shelburne
Road/Bartlett Bay Road intersection currently operates at LOS F.
As part of this project, the applicant will be making the project
access enter only. Exiting traffic will be via Bartlett Bay Road.
The parking spaces in front of the building should be angled to
discourage exits directly onto Shelburne Road.
8. The applicant will be required to contribute $1,001 to the
Shelburne Road Intersection Improvement Fund based on 39 additional
P.M. peak hour trip ends to be generated.
9. Sewer: No additional sewer allocation needed since the number
of employees will decrease from the previous tenant.
10. Dumpster: A screened dumpster will be provided.
11. Lighting: Exterior lighting consists of the following:
--- four (4) building mounted 175 watt mercury vapor lights with
downcasting luminaries.
--- three (3) building mounted 175 mercury vapor lights over a
side rear door and front facade.
--- five (5) 75 watt incandescent soffit lights in entry.
These lights should not cast light beyond the property line.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the revised final plat application of Richard
S. Scott to amend an existing 6.8 acre planned commercial
development by converting an existing 12,000 square foot building
to retail use as depicted on a two (2) page set of plans, page one
entitled "Audio/Video Authority, Site Plan", prepared by Civil
Engineering Associates, Inc. and dated 7/93, with the following
stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.

2. The Commission waives the minimum landscaping requirement. It
is the Commission's opinion that the area of the lot surrounding
the proposed Video Authority building is presently well landscaped
and not in need of additional landscaping.
3. All exterior lighting shall be downcasting or appropriately
shielded so as not to cast light beyond the property line. Any
change in existing lighting or new lighting shall be approved by
the City Planner prior to installation.
4. Prior to issuance of a zoning/building permit, the applicant
shall contribute $1,001 to the Shelburne Road Intersection
Improvement Fund based on 39 additional P.M. peak hour trip ends
estimated to be generated by the development.
5. The plans shall be revised prior to recording to show the
changes listed below and shall require approval by the City
Planner. Three (3) copies of the approved revised plans shall be
submitted to the City Planner prior to permit issuance.
a) Sheet one (1) shall be revised to show angled parking
spaces in front of the building so that the plan is consistent
with sheet 2.
6. The applicant shall record the final plat plans in the South
Burlington land records within 90 days or this approval is
null and void. The plans shall be signed by the Planning
Commission Chair or Clerk prior to recording. The plans shall
be recorded prior to issuance of a zoning/building permit.
7. The applicant shall obtain a Certificate of Occupancy from the
Administrative Officer prior to occupancy of the building.
8. Any changes to the final plat plans shall require approval by
the South Burlington Planning Commission.
