HomeMy WebLinkAboutSD-98-0000 - Decision - 1519 Shelburne RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Pomerleau Real Estate to amend a planned unit development consisting of three (3) buildings on a 6.8 acre parcel, 1519 Shelburne Road. The amendment consists of converting 4,800 square feet of a 12,000 square foot building currently used for retail to light manufacturing. On the 3`d day of March, 1998, the South Burlington Planning Commission approved the request of Pomerleau Real Estate for revised final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of amending a planned unit development consisting of three (3) buildings on a 6.8 acre parcel, 1519 Shelburne Road. The amendment consists of converting 4800 square feet of a 12,000 square foot building currently used for retail to light manufacturing. The last review of this particular property was on 8/23/94 . The sketch plan was reviewed on January 27, 1998. The ZBA on Monday, January 26, 1998 approved a request by the applicant for a conditional use permit. 2. The property involving this PUD includes the Audio/Video Authority building at 1519 Shelburne Road, the Jiffy Lube building at 1525 Shelburne Road, and the new Magic Hat brewery building at 5 Bartlett Bay Road. It is located within the C2 and CO Districts. It is bounded on the north by an auto dealership, on the east by a retail store on Shelburne Road, on the south by Bartlett Bay Road, and on the west by the VT Railway r.o.w. 3. Access/circulation: Access is provided by an ingress only curb cut which is 35 feet wide on Shelburne Road and an access drive to Bartlett Bay Road. The Bartlett Bay Road access is via a 44 foot wide curb cut shared with the Jiffy Lube building. No changes are proposed. Circulation on the site is adequate. 4. Coveragetsetbacks: Entire PUD: Building coverage is 18.5% (maximum allowed is 30%). Overall coverage is 60.1 % (maximum allowed is 70%). Front yard coverage along Bartlett Bay Road is 31.9% and along Shelburne Road is 51.9% (maximum allowed is 30%). This is an existing situation which will not be made worse by this application. 5. Setback requirements are met by all buildings except the Jiffy Lube building which does not meet the front yard setback requirement from Shelburne Road. 6. Parking: The existing and proposed uses require a total of 25 spaces and 28 spaces are being provided including two (2) handicapped spaces. A bike rack is being provided as required under Section 26.253(b) of the zoning regulations. 1 7. Landscaping: There is no minimum landscaping requirement, based on building costs, for this project. No additional landscaping recommended. 8. Traffic: A previously submitted traffic study estimated that the current use generates 51 vehicle trip ends (vte's) during the P.M. peak hour. ITE estimates that the change in use will decrease vte's by 10.5 for a total estimated vte's of 40.5. The applicant was made aware that the road impact fee is zero (0). 9. Sewer: No additional sewer allocation needed. 10. Dumpster: Existing and proposed dumpster will be screened. 11. Lighting: Exterior lighting consists of the following: — four (4) building mounted 175 watt mercury vapor lights with downcasting luminaries. — three (3) building mounted 175 watt mercury vapor lights over a side rear door and front facade. — five (5) 75 watt incandescent soffit lights in entry. 12. These lights should not cast light beyond the property line. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the final plat application of Pomerleau Real Estate to amend a planned unit development consisting of three (3) buildings on a 6.8 acre parcel, 1519 Shelburne Road. The amendment consists of converting 4,800 square feet of a 12,000 square foot building currently used for retail to light manufacturing, As depicted on two (2) page set of plans, page one (1) entitled, "Grace Pomerleau Furniture Site Plan South Burlington Vermont," prepared by Civil Engineering Associates, Inc., dated November, 1997, last revised 1/29/98, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. 3. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the change in use will generate zero (0) additional vehicle trip ends during the P.M. peak hour. 2 4. Any changes to the final plat plans shall require approval of the South Burlington Planning Commission. 5. The final plat plan (sheet l) shall be recorded in the land records within 90 days or this approval is null and void.
