The plan shall be amended to move the access to the west over the O'Brien property at the existing depressed curb which may be used as a curb cut for this purpose only. 7. Continue site plan application(of Nordic Ford for conversion of existing building to Nordic Pre -owned Autos and Rental Vehicles at 1519 Shelburne Road Mrs. Lafleur advised that Peter Allison asked to defer action until a later time. The item can be postponed until 16 September without running into the 60-day problem. Mr. Dooley moved that the Commission deny the site plan ap- plication of Nordic Ford for conversion of existing building to Nordic Pre -owned Autos and Rental Vehicles at 1519 Shelburne Rd., unless within a week the City Planner receives an agreement from Nordic Ford to waive the deadline 2 weeks beyond the 60-day deadline. Mrs. Maher seconded, and the motion passed unanimously. 3. Continue site plan of Merchants Bank for construction of a 40,000 sq. ft. operations center including a 1600 sq.. ft. branch bank on lot 47, Business Park North, Kimball Avenue and Kennedy Drive Mrs. Lafleur advised that the sidewalk will be along Kimball Avenue and on Kennedy Drive to the end of the building. There is still discussion going on about the remaining frontage and the CO Zone and O'Brien land. Mr. Jacob said he spoke with the City Manager and they feel the situation is almost as bad as Palmer's, since there would have to be filling in the CO Zone. Mr. Schuele said it is very precarious if the CO Zone is filled. He is also concerned about the need for a pedestrian footpath, however. He suggested that if it can't be built now, money be put in escrow so it could be built later. He added that the Com- mission should consider this kind of issue at subdivision time, before it becomes a major problem. There is no question that if there is filling, the stream will be affected. He felt that a footpath could be constructed to the inside of the guardrail. Mrs. Maher recommended asking for a sizable fee to be put in escrow. She noted that the O'Brien land is zoned R-7, and there could be many people 8/11/86 JBL MOTION OF APPROVAL That the South Burlington Planning Commission approve the site plan application of Peter Allison of Allson Partnership, for the conversion of the 18,300 square foot former Milbrook building to an auto dealership at 1517 Shelburne Road as depicted on a plan entitled "Proposed Automotive Facility/South Burlington, Vermont, Nordic Pre -Owned Vehicles/Dollar Rent-A-Car" prepared by David Raphael, last revised 8/4/86 with the following stipulations: 1) A $5400. landscaping bond shall be posted prior to permit. 2) A concrete curb shall be installed in the closed driveways. Any new driveway shall be constructed with a continuous curb across the drive. A bond shall be posted for this prior to permit in an amount determined by the City Engineer. 3) An agreement shall be signed and recorded with the City to combine the two Shelburne Road driveways of G.E. and the proposed use into one when the present lease to G.E. expires. The_ 30 foot--ditel►-'along Bartletts Bay should be eliminated and existing pipe extended beyond the entrance drive. 2. Plans are difficult to read. There are lines that are not, identified such as the one behind the G.E. Supply Building and one in rear parking island. 4) MERCHANTS BANK, KENNEDY DRIVE. 1. Construction of a sidewalk along Kennedy Drive from the bank access drive to the northerly property line would require a considerable amount of filling. To do this would also require permission from the adjacent owner. The cost estimate for doing this work amounts to approximately $45,500 assuming all required fill material is trucked in from the outside. If surplus fill from the site, such as from the building site is available then that cost can be reduced. The City has plans for jacking another pipe across Kennedy- Drive and from the information available it appears this filling will extend into that area adding some extra expense to the project. Continuing the sidewalk northerly to Williston Road will be the responsibility of the City. No estimate of that cost has been made but it will be considerable (+$50,000) 2. Comments from previous memo's still apply. 5) SEMICON INC., HINESBURG ROAD 1. The property should be subdivided so that existing utilities mainly water and sewer could be used for future development. Mr. O'Brien has been contacted by the Natural Resources Committee to see if he is willing to grant an easement or sell some proper- ty for better access to this lot. Mr. Palmer and the O'Brien's have not reached any agreements yet. Since I have not received revised plans with new access and scaled down coverage, this item should be tabled until August. 12, 1986. 3) NORDIC PRE -OWNED VEHICLES, 1519 SHELBURNE ROAD This item should be tabled until August 12, 1986. I have not received revised plans showing the corrections to the front yard, the lot dimensions, and the parking lot. An evaluation from Wagner, He.indel and Noyes is also needed. It would be helpful to have lease information that confirms why- improvements to the GE property can not be done now. Site Plan application of Cedric Demeritt for multiple use of the existing building on o erar Drive Mrs. Lafleur explained that the building is not "existing" but has been approved. Walt Adams presented the plan. This is the last lot before the cul de sac on Berard Drive. They are asking to divide the building into 4 pieces. Mr. Demeritt owns a building in Winooski which is divided into 3 pieces; he is familiar with the market and feels this kind of building will work here. The site is essentially level, and they are proposing parking in the front area. All accesses are across the front, and landscaping will be concentrated in the front as well. Mrs. Lafleur noted extra parking will be required from the original plan. She also noticed that landscaping was reduced from the original plan, and this will be made up by requiring larger Austrian pines. Since the curb cut is very wide, the City Engineer has requested closing a portion of it. Mr. Adams said they had no objection. Site Plan application of Nordic Ford/Toyota for conversion of e former Milbrook building t3 Dollar Rent-A-Car at 15T97S_R_eT_- Dave Raphael presented the plan. He noted this will be a facility for Dollar Rent-A-Car and Nordic pre -owned cars. Me felt they will improve the lot substantially. There will be a small area of additional paving. They would like to maintain the entry on Shelburne Rd. and consider in the future doubling up with the adjacent property (G.E.) when the present leases expire in 1993. The Shelburne Rd. access will be an entrance only. Exit and an additional entrance will be on Bartlett Bay Rd. He felt they exceed landscaping requirements for the lot as they propose to add unpaved islands of grass which will also aid in drainage. PLANNING COMMISSION 22 JULY 1986 Page 5 Mr. Dooley asked what portion of the lot is currently paved. No one had exact figures on this, but Mrs. Lafleur said the proposed landscaping is 24% while the requirement is 30%. She felt it was a net improvement to the layout of the land. Mr. Allison said that when you add in the 50-foot strip around the lot, it would be more than 30%. Mrs. Lafleur noted that part of that strip is paved, and exact figures were not available. Mr. Dooley said he is bothered by using property that is not on the site plan. Mrs. Lafleur said the strip might also pre- sent a problem as there is another possible access on it. Mrs. Hurd agreed that she did not like using the strip until they have more information about it. Mrs. Lafleur explained that according to the Ordinance, only 30% of the area from the property line to the front of the building can be pared. At present 60-70% is paved. This will be reduced to 52% by the plan. The only way to bring the lot into conformance is to remove the curb cut and driveway and landscape the front yard. Mr. Dooley said he would like to see the Wagner, Meindel & Noyes recommendations before going further. Mr. Lash stressed that in 1968 Williston Rd. was little more than a used car lot. At that time, they decided to put their Town & Country Furniture business on Shelburne Rd. because the Planning and Zoning Boards had determined that Shelburne Rd. would never repeat the problems of Williston Rd. He said that now there are car lots all over Shelburne Rd. tie said that Nordic started out with a beautiful lot, but that now it is almost completely covered with pavement, buildings, and cars. The only grassed area is in front, and they are not even sat- isfied with that. He showed pictures of trucks parked on the grass areas. He also noted that the property line is drawn in- correctly on the plan. Town & Country has a right-of-way around the back of his property. The only way to change that would be for them to be supplied with another right-of-way of at least 25 feet. Mr. Allison agreed with Mr. Lash that the property lines are drawn incorrectly, but he said the dimensions are correct. Mr. Belter said the Commission should have an accurate map and it should be stamped. Mr. Jacob added that the right- of-way question would have to be squared away with Mr. Pomerleau. Members agreed to continue the discussion until August 12th at which time they would consider lot coverage, front yard coverage, displaying of vehicles, drainage, and other concerns. It was the concensus of the commission that the front yard coverage did not have to meet the 70% landscaping requirement. Mr. Dooley moved to continue the application for 3 weeks unless it could be done in 2 weeks. Mrs. Maher seconded, and the motion passed unanimously. A drop inlet should be placed in the existing drain line and site graded toward this inlet. 2. An easement to maintain the drain line should be given to the City. 3. The Planning Commission should look into the regulations to see if this type of development can be discouraged. In similar developments adjacent residents complain about users driving at excessive speeds, lack of maintenance, dust, and overflow parking blocking entrance for emergency vehicles. 4) MAREK SUBDIVISION (M & M PARTNERSHIP) SWIFT STREET 1. Development of lot #1 will require draining across lot #2. That may require swales and or pipes. That right shall be given to lot #1 especially if lot #2 develops first. 5) CEDRIC DEMERITT, BERARD DRIVE 1. There is a long depressed curb of approximately 50 feet. which will only in part be used for the proposed driveway. The unused portion shall be removed and a barrier curb installed. As long as this has to be done, it would improve the access if the drive were constructed at a right angle to the street. 6) NORDIC CAR RENTAL (FORMERLY MILLBROOK STORE) SHELBURNE ROAD 1. The first curb cut on Bartletts Bay Road should be eliminated. 2. Plan shall include storm water runoff control and a complete site drainage plan. 3. Water main easement should be shown on the plan. 1 4. Plan should show who owns what and limits of site being reviewed. Site development seems to include part of the G.E. Supply site. 7) MERCHANTS BANK, KIMBALL AVENUE 1. In construction of the deceleration lane and acceleration lane the removed road granite curb shall be used with additional as required to curb this drive to the parking area instead of shoulders as shown. The island shall also be lined with curb. 2. Vermont State Highway has standards for traffic islands. This standard shall be followed. 3. Site should have sidewalks on both streets. 4. The corner of Kimball Avenue and Kennedy Drive has a triangle reserved to maintain day lighting. Large trees should not be planted in this area. 5. Site should include storm water runoff control. 6. City requests rights of access across this property to maintain reconstruction or add to the drainage pipe under Kennedy Drive under the condition the City restore any disturbed area to its original condition. 7. The property is part of the Pomerleau property that includes the G.E. Supply building, and the two rights -of -way on the north and west of the Lash Furniture. This plan needs conditional use approval by the Zoning Board of Adjustment. Access and Circulation: As stated in Section 19.103a of our ordinance, there should be only one cut per lot. Access is shown from 3 curb cuts - one on Shelburne Road and two on Bartlett Bay Road. I strongly recommend closing the Shelburne Road curb cut. One of the cuts on Bartlett Bay should be closed unless one is marked as entrance and one as an exit. Circulation is complete due to the excessive paving on the property. Parking: Fifty seven spaces are shown. Landscaping and Lot Coverage: The Shelburne Road curb out should be closed and this area landscaped and grassed. The front yard has excessive coverage and can be brought into conformance by closing the driveway and seeding topsoil and landscaping the front yard. The applicant has calculated total lot coverage by using the Millbrook, the G.E., and the r.o.w. to count for green area. More information is needed on the other lots to count them toward coverage. However, I do not believe the spirit of the ordinance is met by paving the front part of a property and leaving a grassed strip along the rear property line to meet the 70 % coverage requirement. Furthermore, if the G.E. lot is counted, access improvements might be considered there as well. I expect to receive better information on lot coverage by Monday.
