APRIL 28, 1986 fifty-six (56) foot frontage from a lot containing 1.02 acres and one hundred forty (140) foot frontage, located at 10 Shunpike Road. Mr. Ward said the area was zoned R4 and that minimum required lot size is 9,500 sq. ft. with 80' frontage. The existing lot has 44,590 sq. ft. and 140' frontage, and the proposed lots would have 11,245 sq. ft. and 83' frontage, and 33,344 sq. ft. and 56' frontage. Mr.. Fisette said they had lived in the city for 13 years. He may be taking a foreign assignment soon and would like to be able to come back to South Burlington after that is done. If he does not take the assignment, he may build the .new house anyway, because the family is outgrowing the present home. He noted that the land was originally two lots, but one person bought both and put the home across the dividing line. This means that the lot has to.be 83' wide;,.. in order to allow a 10' side yard. He noted that he might make the new home a two-family dwelling. Ir. Ward said that would increase the frontage requirement to 85'. Mr. Fisette said the new home would be placed in the middle of the larger lot, not in the 56' wide area of the lot. The Board diseussed stipulating that, but decided it was not necessary. Mr. Boehm noted that the parcel was now being used in conformity with the ordinance, and he saw no hardship. ins. Fisette said he could not afford to buy a lot in South Burlington, so this was the only way he could remain in the city, or come back to it. He was asked about expanding the present house, but did not feel that was appropriate or cost-effective. The appeal was granted on a 4-1 vote. No. 3 Appeal of Nathaniel Lash Appeal of Nathaniel Lash seeking a variance from Section 19.00, Non- complying structures, subsection 19.002, alterations of the S'outh Burlington Regulations. Request is for permission to construct a 37' x 140' addition to an existing structure which exceeds the maximum lot coverage (total coverage 36j�) on a lot containing 1.3 acres, located at 1515 Shelburne Road. Mr. 'Ward said the area was zoned C2 and th4t.maximum coverage allowed for building was 30o, and total was 70;�. ExistingAcov`h-age is 40,» and proposed i , 36P. This would be an alteration of a non -complying structure. The proposal is to rurchase a strip of land 50' x 2751, making the lot total 53,350 sq. ft. The new addition would contain 5,090 sq. ft. The 25,b rule also applies here. 14r. Lash said the building was built in 1968 and he had been before the Board several times since to try to increase its size. He said he had lost one furniture franchise because he did not have enough space and he was concerned that he not lose more. Mr. Boehm asked about total coverage and was told it exceeded the 70M allowed now and under the proposal. Mr. Robert Foczabut represented the owners of Goss Dodge next to this and said they would like to see on the ground exactly where this building would be put. He added that there was a natural drainageway in the iroposed area. 14r. Boehm saw no unique physical circumstances, noted that reasonable use of the property now existed, saw no hardship and felt that the coverage limits were set to establish openness in that area. I�,r. Guyette noted that he would be reducing the total building coverage as a percentage. Mr. Lash said he felt this was the minimumvariancebecause he would reduce coverage, and that this, would not alter the, character of .the area, but enhance it. He also felt there was a wardship because the business had.to.move ahead and that because of the cost of the land and the construction, to build a smaller addition would 3. No. 4 Appeal of Peter Bouyea, David Desautel, agent Appeal of Peter Bouyea, David Desautel, agent seeking approval from Section 12.20, Conditional uses -and Section 19.65, Multiple uses of the South Burlington Regulations. Request is for ermission to construct a 10,200 sq. ft. building and occupy same with three V automotive service businesses, on a lot containing approximately 1.8 acres, located at 1785 Shelburne Road. Mr. Ward said the area was zoned C2 and that approval was being requested for multiple uses and conditional uses - three automotive service businesses. The proposed building will be 60' x 170', one story tall. Mr. Desautels said he felt they would fit the character of the area and that the curb cut they share with the adjacent lot would benefit traffic in the area. They will use little sewer or water capacity. The proposed uses are a car care store, sales of tires, and tentatively an auto parts business. The appeal was granted unanimously. No. 5 Appeal of Russell Tilley Appeal of Russell Tilley seeking approval from Section 7.20, Conditional ` uses, subsection 7.202 of the South Burlington Regulations. Request is for permission to construct an addition 18' x 30' to an existing 40' x 60' barn, and to operate a farmers market, lot containing 17 acres, located at 700 Hinesburg Road. Xr. hard said the area was zoned R-1 and that commercial a„riculture was a conditional use. Kr. Tilley said this would be a seasonal market, selling produce, and later in the year, pu.nrrins and Christmas trees. He noted that he -ad no cor=urity facilities on the property and said that this was an effort to maintain tie character of the area as it is now - in o-)en fields. They stopped milking cows several years ago and need some income. He did not feel this would generate a significant amount of traffic and noted that the greenhouse would use the sun as its i)ower source, which is a renewable resource. Tilley said he would raise the products himself and/or buy from local producers. The appeal was granted unanimously. No. 6 Appeal of William Peters Appeal of William Peters seeking a variance from Section 19.00, Non- conforming uses and non -complying structures of the South Burlington Regulations. Request is for permission to construct a 50' x 76' addition to an existing structure which is non -conforming to use and dimensional requirements, d.b.a. Harrington Brothers, 400 Patchen Road. Mr. Ward said the area was zoned R4 and that this request was for an extension to a non -conforming use and a non -complying structure. Allowed coverage in an R4 zone is 20o for the structure and 40% total. In Cl it is
