HomeMy WebLinkAboutSP-18-19 - Decision - 1341 Shelburne Road#SP-18-19 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING JUDE CHICOINE — 1341 SHELBURNE ROAD SITE PLAN APPLICATION #SP-18-19 FINDINGS OF FACT AND DECISION Jude Chicoine, hereinafter referred to as the applicant, is requesting site plan review to amend a previously approved plan for a 7,217 sq. ft. building used for car wash and auto service. The amendment consists of: 1) adding two (2) pay station islands in front of the wash bays, 2) relocate vacuum island, 3) add one (1) parking space, and 4) add fence around dumpster, 1341 Shelburne Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The application is to amend a previously approved plan for a 7,217 sq. ft. building used for car wash and auto service. The amendment consists of: 1) adding two (2) pay station islands in front of the wash bays, 2) relocate vacuum island, 3) add one (1) parking space, and 4) add fence around dumpster, 1341 Shelburne Road. 2. The owner of record of the subject property is Ed Crane, Trustee. 3. The subject property is located in the Commercial 2 Zoning District. 4. The application was received on May 11, 2018. 5. This application is to reapprove application #SP-17-43 which expired. 6. The plan submitted is entitled "Seaway Car Wash Wash Bay Addition Existing Site Plan South Burlington Vermont", prepared by Champlain Consulting Engineers, dated 4/26/17, and last revised on 5/24/17. DIMENSIONAL REQUIREMENTS 7. Building coverage is 14.6% (maximum allowed is 40%). Overall coverage is 67.2% (maximum allowed is 70%). Front yard coverage is 24.2% (maximum allowed is 30%). 8. Setback requirements will continue to be met. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. - 1 — #SP-18-19 Parking 9. The minimum parking requirement is 15 spaces. One (1) additional parking space is proposed in the rear of the building for a total of 18 spaces provided. 10. Section 13.14 (B) (1) (b) of the LDRs allows an existing bicycle rack to remain and count towards the minimum requirement if it is in compliance with this section. The existing bike rack (wave style) meets these requirements in that a bicycle can be positioned lengthwise along the rack, where it can be supported upright and attached at the frame and wheel. Therefore, it can remain to count as no more than one space, which meets the minimum requirement of one (1) bicycle parking space. The existing rack is not correctly shown of the plan submitted, so the plan will have to revised to reflect the existing location and orientation, with at least 24" clearance from the rack where a bicycle may be positioned. All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s), 11. The plan indicates that the dumpster storage area will be enclosed with a fence. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-18-19 of Jude Chicoine subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The plans must be revised to show the changes below and will require approval of the Administrative Officer. Three (3) copies of the approved revised plans must be submitted to the Administrative Officer prior to permit issuance. a. The site plan must be revised to show the existing location and orientation of the existing bike rack. 4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. Prior to issuance of a zoning permit for the project, the applicant must submit to the Administrative Officer a final set of project plans as approved in digital (PDF) format. 6. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use or occupancy of the pay stations or relocated vacuum stations. -2— #SP-18-19 7. Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer.
