The Vermont College of Cosmetology and O'Brien's Training Center operated at this facility until being rebranded the O'Brien's Aveda Institute in 2009. The school operated with 10 hairdresser chairs, 50 students and 8 faculty members. No PB or WW permit can be located for this property. The design flows for the building is 2,160 GPD foe sewer and 2,430 GPD for water at the time of "clean slate" determination date of January 1, 2007. Please see attached summary. With the O'Brien's Aveda Institute merging the South Burlington campus into its Williston Campus, the building's school use is proposed to be continued with a proposed Day Care School with up to 78 students and 10 faculty members. The design flows for the proposed Day Care School are 996 GPD for sewer and 1,121 GPD for water. Less than that for the Obrien's Training Center/Aveda Institute. Please see attached summary. As outlined in the Environmental Protection Rules, Chapter 1, Wastewater System and Potable Water Supply Rules, the continued school use does not trigger the need for a WW permit as outlined below. §1-304 Exemptions (a) The following are exempt from the permitting requirements of this Subchapter provided the specified conditions are met (Note: more than one exemption may apply in a particular situation). (1) (A) All buildings or structures, campgrounds, and their associated potable water supplies and waste water systems that were substantially completed before January 1, 2007 and all improved and unimproved lots that were in existence before January 1, 2007. This building was constructed in 1923 and Cite school use was in place prior to 2007 at this building. This exemption shall remain in effect provided: Ms. Jessanne Wyman Page 2 of 2 June 8, 2018 (i) No action for which a permit is required please see below for further discussion under these Rules is taken or caused to be taken on or after January 1, 2007 unless such action is exempt under one of the other permitting exemptions listed in this section; and (ii) If a permit has been issued under these Rules before January 1, 2007 not applicable that contained conditions that required actions to be taken on or after January 1, 2007, including, but not limited to, conditions concerning operation and maintenance and transfer of ownership, the permittee shall continue to comply with those permit conditions. Under §1-303(b) Permit Required — The actions that require the issuance of a permit that most closely align with the situation for this property are: §1-303 Permit Required _ (a) Except as provided in this section and in section 1-304 of this Subchapter, no person shall take or cause to be taken any of the following actions without first obtaining a permit or permit amendment from the Secretary: (5) the modification of an existing building or structure in a manner that increases the design flow The proposed day care school will reduce the design flowsfrom those thatpreviously existing with the O'Brien Is Training Center or modifies other operational requirements of a potable water supply or wastewater system; The operations will continue to beprimarily during the weekday and daytime operating hours without any supplemental operational requirements for the proposed use. (7) the change of use of a building or structure in a manner that increases the design flow The proposed day care school will reduce the design flowsfrom those thatpreviously existing with the O'Brien's Training or modifies other operational requirements of a potable water supply or wastewater system including the conversion of a single family residence from seasonal to year-round use; The operations will continue to be primarily during the weekday and daytime operating hours without any supplemental operational requirements for the proposed use. With there being no change in use, nor an increase in design flows, it is our understanding that the property is exempt from needing to acquire a Wastewater System and Potable Water Supply Permit. Building Height: The addition, which is a pitched roof structure, will have a height of 37 feet to -the ridge. Section 18.112 of the zoning regulations would allow this type of structure to rise 40 feet. 7. Traffic: The I.T.E. Generation manual does not have a land use category for this type of land use. Staff requested and received traffic generation counts taken by the applicant on three (3) days taken between the hours of 4 and 6 P.M. On average, the property generates 32 trip ends during the peak hour between 4 - 6 P.M. From this information staff determined existing trip generation based on square footage, operator stations and number of students. This property is in Traffic Overlay Zone 5 which would limit this property to 45 vehicle trip ends (vte's) during the P.M. peak hour. Utilizing square footage to determine trip generation staff estimates that this project would generate 74.2 vte's and if the number of students (50 students proposed) is used staff estimates 45.7 vte's. The applicant will be required to contribute $352 to the Shelburne Road Intersection Impact Fund based on the estimated 13.7 additional P.M. peal-, hour trips to be generated by this expansion. 8. Sewer: Staff has calculated that additional sewer allocation needed for this project is 342 gpd. This is based on past water usage for the current 42 occupants applied to the additional 18 occupants proposed. The applicant would have to pay the $2.50 per gallon fee prior to permit. According to City records, there is sufficient reserve capacity to handle this additional demand. 9. Coverage/setbacks: Building coverage will be 14% (maximum allowed is 30%). overall coverage will be 60% (maximum allowed is 70%). The existing front yard coverage is 45% (maximum allowed is 30%). The removal of three (3) parking spaces closest to Shelburne Road and the area converted to grass/landscaped area would bring this property closer to front yard coverage requirement (38%). Parking standards will still be met and the appearance of the property would be improved. The new addition and the relocated garage will be meeting the setback requirements. 10. Millikin Dear Mr. Belair and Members of Development Review Board, We have read the comments in your letter "Findings of Fact Conclusion and Decision" dated July 14, 2003, regarding conditions of approval for the 475' Shelburne Road Site Plan with revised parking approved by your board on July 1, 2003. Enclosed you will find three full sized (2' x 3') and one reduced (11" x 171 copy of the Site Plan with acknowledgement of the conditions cited in the decision section of your letter. We further modified the plan Exhibit "A" to increase the snow removal area, which is to be grass, by 240 sq. ft., increased the setback from the north property boundary 172 sq. ft., (also a grassed area) and removed one parking space 172 sq. ft. at the northwest. We also increased the grassy area adjacent to the dumpsters by 30 sq. ft.. This replaces the 620 ± sq. ft. of grassy area at the south and the west of the storage building western most on the property. This will make snow removal around the storage building easier as well as making the parking lot much safer. Covered area total remains the same at 38.26%. Our view is that these minor adjustments to the grassed areas will benefit adjacent properties due to the increase in setback at the north and west property boundaries, as well as providing a more intelligent way of handling snow removal and storage. The Appellant was present at the public hearing held 12/17/02 relative to this appeal. Based on the evidence submitted at the hearing and as part of this appeal, the 5outh Burlington Development Review Board hereby renders the following decision: EIN DINC25 OF FACT 1. The owner of record of this particular property located at 1475 Shelburne Road is Two O'Brien's Properties, LLC 2. This is an appeal of the Administrative Officer's decision to issue Notice of Violation (N.O.V.) #NV-02-39 dated 10/4/02. This N.O.V. alleges that the Appellant'5 property, including an addition constructed in 1992, is being occupied without a Certificate of Occupancy. 3. The Appellant appealed this decision on 10/21/02, 4. In 1992, the Planning Commission approved an addition for "vocational training" use to the O'Brien's Training Center, In 1994 the Planning Commission approved an amendment to the site plan to relocate a garage, revise -parking layout, and revise the landscaping. In 1995, the Planning Commission approved another amendment which eliminated a condition to construct a sidewalk. 5. In 1999 the Appellant requested a Certificate of Occupancy (C.O.) which was denied because the parking aisle serving the single row of parking along the south boundary was too narrow. The three (3) previously approved plans showed this aisle meeting the 22 foot minimum width requirement. 5taff measured this aisle at its narrowest point at 13 feet. 6. The Appellant was informed of the violation and the response was that they would take care of it. 5tafF recently discovered that the Appellant opened up a retail store in the building without a zoning permit. A Notice of Violation (N.O.V.) was sent to the Appellant for this violation and for occupying the building without a C.O. The N.O.V. for the occupancy violation was appealed and the N.O.V. for the retail Store was not. 7. This property located off Van Sicklen Road lies within the SEQ District, C. O. District, Floodplain Overlay District, and Hinesburg Road -South View Protection Zone. LL_ - - 6 DEVELOPMENT REVIEW/ BOARD MEMO December 17, 2002 MEETING Appeal of a decision of the Administrative Officer to issue Notice of Violation #NV-02-39 alleging that the property owned by Two O'Brien's Properties, LLC located at 1475 Shelburne Road is being occupied without a Certificate of Occupancy. In 1992, the Planning Commission approved an addition for "vocational training" use to the O'Brien's Training Center. In 1994 the Planning Commission approved an amendment to the site plan to relocate a garage, revise parking layout, and revise the landscaping. In 1995, the Planning Commission approved another amendment which eliminated a condition to construct a sidewalk. In 1999 the Appellant requested a Certificate of Occupancy (C.O.) which was denied because the parking aisle serving the single row of parking along the south boundary was too narrow. The three (3) previously approved plans showed this aisle meeting the 22 foot minimum width requirement. Staff measured this aisle at it's narrowest point at 13 feet. The Appellant was informed of the violation and the response was that they would take care of it. Staff recently discovered that the Appellant opened up a retail store in the building without a zoning permit. A Notice of Violation (N.O.V.) was sent to the Appellant for this violation and for occupying the building without a C.O. The N.O.V. for the occupancy violation was appealed and the N.O.V. for the retail store was not. This property is located at 1475 Shelburne Road and is within the C2 District. It is bounded on the north by Densmore Monuments, on the east by Shelburne Road, on the south by Goss Dodge and on the west by undeveloped property. Access/circulation: Access will be via an existing 22 foot curb cut. No changes proposed. Circulation is acceptable. Parking: The parking requirement for this project is 41 spaces and 43 spaces are being provided including two (2) handicapped spaces. The previously approved plan showed 45 spaces. All parking stall dimensions and aisle width requirements are being met. Landscaping: The revised landscaping plan meets the minimum landscaping requirement of $7700. Plantings include Arborvitae, Honey Locust, Lilac, Sandcherry, Juniper, Spirea, and Burning Bush. Coverage/setbacks: Building coverage is 14% (maximum allowed is 30%). Site plan application of William and Timothy O'Brien for a 6,000 sq. ft. addition for vocational training use to the 0'- Brien's Training Center, 1475 Shelburne Rd.: The applicant questioned the amount of new landscaping required. Mr. Weith with look into this and see if any credit can be given for existing plantings. Traffic: There is no ITE standard that can be used for this use. One suggestion is to condition the approval on the number of students. Mr. Weith noted this will require a reporting method and members were concerned about enforcement. Members said they would want to stipulate that the facility be for this use only in order to avoid a higher traffic generator lif;r coming in. Mr. O'Brien said they now have 35 students and anticipate a total of 60 students and teachers after the addition. They will be getting a bus load of students from the Essex Jct. Vocational Center which will cut down on the trip ends. Mr. Burgess said that once the building is buil&-, the Commission can't control how students get there. Ms. Pugh said she would feel uncomfortable turning this down when the Commission approved the ballroom addition at Howard Johnson's. Mr. Burgess suggested asking the City Attorney about wording for enforcing the student limit. Mr. Weith noted 2 other issues. First, the requirement for a sidewalk along the frontage. Members agreed this should be done. The other issue was the Fire Chief's request for a hy- drant on the property. The problem with this is that the major water service is on the other side of Shelburne Rd. The appli- cant noted they had an estimate of $16,000-20,000 to run a line under Shelburne Rd. Mr. Weith said that if a fire occurred, traffic would have to be stopped in order for the fire dept. to fight the fire with water from a hydrant on the other side of the road. The Chief is also concerned that when Shelburne Rd. is upgraded, there will be a median, and this will make it even harder to get water across the road to fight a fire. Mr. Burgess summarized outstanding issues: fire hydrant location (he suggested the applicant talk with the Chief) and a review by the City Attorney about wording on limiting the number of students and enforcing the limitation. Mr. Sheahan then moved to continue the application until 12 May. Ms. Peacock seconded. Motion passed unanimously. The applicant shall post a $7700, 3-year landscaping bond Prior to issuance of a zoning/building permit. Based on trip generation count data submitted by the applicant, it is estimated that 50 students would generate 45.7 vte's during the peak hour. In an effort to assure compliance with the provisions of the Traffic Overlay Zone, the maximum number of students shall be limited to 50. Because this restriction in the number of students is essential to the approval of this proect, violation of this condition shall constitute sufficient grounds for revocation of the approval of this project, and shall entitle the City of South Burlington to a Permanent injunction enjoining any use of the proposed facility. The applicant will be required to pay the $2.50 per gallon fee prior to issuance of a zoning/building permit. Building Height: The applicant submitted elevations which show the proposed tower to be 42 feet. high (maximum allowed for peaked roof structure is 40 feet). The Zoning Administrator has ruled that the onl- way the Commission can approve this increase above the maximum is if the entire building maintains a 32 foot rear yard setback (Section 18.112(e)). Since the building has only a 27 foot rear yard setback, the required setback cannot be maintained. The applicant should lower the height of the tower to 40 feet or seek a variance. 6) O'BRIEN'S TRAINING CENTER - ADDITI.ON- 1475 SHELBURNE ROAD This project consists of the construction of a 6,000 square foot 2 1/2 story addition to an existing 2 1/2 story 4550 square foot building for vocational training use. The existing building is a noncomplying structure and the proposed addition will exceed the 25% limit under Section 19.002 of the zoning regulations. The applicant has requested a variance which will be heard by the Zoning Board of Adjustment. on April 27, 1992. This property is located at 1475 Shelburne Road and is within the C2 District. It is bounded on the north by Densmore Monuments on the east by Shelburne Road, on the south by Goss Dodge and on the west by undeveloped property. Access/circulation: Access will be via an existing 22 foot curb cut. No changes are proposed to this access. Circulation is acceptable. Parking: The parking requirement for this project is 41 spaces and 45 spaces are being provided including two (2) handicapped spaces. All parking stall dimensions and aisle width requirements are being met. 5 Memorandum - Planning April 28, 1992 agenda items April 24, 1992 Page 6 Landscaping: The landscaping requirement for this project is $7700. Plantings proposed only have a value of $6,450 which is $1250 short.. The applicant is requesting a credit for existing plantings to make-up the shortfall. Staff recommends that tree sizes be increased. Plantings will include Sugar Maple, Ash, Willow, Barberry, Juniper, Lilac and Arborvitae. Planting plan shows new plantings within the Shelburne Road r.o.w. These should be relocated onto the property. The existing front yard coverage is 45% (30% maximum allowed by ordinance). Staff recommends that the three (3) parking spaces closest to Shelburne Road be removed and the area converted to grass/landscaped area. This would bring property closer to front yard coverage requirement (38%), still meet parking standard, and improve appearance of property along Shelburne Road. Building Height: The addition, which is a pitched roof structure, will have a height. of 37 feet to the ridge. Section 18.112 of the zoning regulations would allow this type of structure to rise 40 feet. Traffic: The I.T.E. Generation manual does not have a land use category for this type of land use. Staff requested and received traffic generation counts taken by the applicant on three (3) days taken between the hours of 4 and 6 P.M. On average, the property generates 32 trip ends during the peak hour between 4 - 6 P.M. From this information staff determined existing trip generation based on square footage, operator stations and number of students. w �4t P 3 s� owe This property is in Traffic Overlay Zone 5 which would limit this property to 45 vehicle trip ends (vte's) during the P.M. peak hour. Utilizing square footage to determine trip generation'F staff estimates that this project would generate 74.2 vte's and Af'f h if the number of students is used we estimate 45.7 vte's. Square footage is the best way to determine trip generation because it is more difficult to keep track of student population than square SJ footage increases. Sewer: Staff has calculated that additional sewer allocation needed for this project is 342 gpd. This is based on past water usage for the current 42 occupants applied to the additional 18 occupants proposed. The applicant would have to pay the $2.50 per gallon fee prior to permit. According to City records, there is sufficient reserve capacity to handle this additional demand. The applicant should check with the State ANR to see if they would issue a discharge permit. Coverage/setbacks: Building coverage will be 14% (maximum allowed is 30%). Overall coverage will be 60% (maximum allowed is 70%). Mr. Weith noted that in the original approval there had been a stipulation for downcasting, shielded lighting. Two floodlights have been put on the back of the building and must be replaced. The applicant said this will be done. Mr. Weith also noted that some parking spaces have to be removed to come into conformance with coverage requirements. Mr. O'Brien said they will grass this area. Discussion with Peter Judge regarding requirements of the Central District: Mr. Burgess stressed that this was not to be a discussion of the item that is up for variance with the Zoning Board. Mr. Judge introduced Rob Donaghue who is interested in establishing a market in the City Center District. This is a permitted use. The GFA of the proposed market would be 16,000. Mr. Judge said they would have no problem with an average depth of 80 feet, but the 80 ft. envelope creates a problem for this use. This is based on past water usage for the current 42 occupants applied to the additional 18 occupants proposed. --- staff has calculated, based on trip generation rates supplied by the applicant, that the current trip generation rate for the existing facility is 7.033 vehicle trip ends (vte's) per 1,000 square feet of gross floor area. Applying this rate to the expanded facility we estimate trip generation to be 74.2 vte's. The Traffic Overlay District limits this property to 45 vte's. If we use students to determine trip generation, we calculate the current rate to be .914 vte's per student which when applied to the expansion results in a rate of 45.7 vte's. Square footage is the best way to determine trip generation because it is more difficult to keep track of student population than square footage increases. The Planning Commission may be able to live with a condition that limits students to 50. --- the applicant will be required to contribute $352 to the Shelburne Road Intersection Impact Fund based on the estimated 13.7 additional P.M. peak hour trips to be generated by this expansion. This proposal will reduce the southerly side yard setback to only 3 feet. This reduction is prohibited under Section 18.114 of the Zoning Regulations. However, the Planning Commission may modify this setback requirement under Section 11.507 since this is part of the U-Mall PCD. --- the Jacobs property currently has 131.68 feet of frontage and this proposal will reduce the frontage to 126.9 feet. The minimum frontage requirement is 200 feet. O'BRIEN'S TRAINING CENTER - ADDITION - 1475 SHELBURNE ROAD --- the relocated garage does not meet 30 foot rear yard_ setback, either the garage must be shown meeting the requirement or a variance obtained. --- plan shows one (1) handicapped parking space and new ADA guidelines requires two (2) spaces. --- existing structures does not meet minimum front yard setback of 50 feet, this structure is therefore a noncomplying structure and improvements are limited to 25% of the fair market value under Section 19.002 of the zoning regulations. Applicant must submit a property appraisal to show that proposed improvements do not exceed 25% of the property's current fair market value, or obtain a variance to exceed the limitation. --- if a dumpster is proposed, it should be shown and screened. --- submit information on type, wattage and location of any existing or proposed exterior lighting. --- minimum landscaping requirement for this project is $7,700 and staff calculates proposed landscaping to only equal $5,000.
