HomeMy WebLinkAboutSP-94-0000 - Decision - 1475 Shelburne RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of William & Timothy O'Brien to amend a previously approved site plan to relocate a garage, revise parking layout and revise landscaping for a vocational training use, 1475 Shelburne Road. On the 12th of July, 1994, the South Burlington Planning Commission approved the request of William & Timothy O'Brien for site plan review under Section 19.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a previously approved site plan to relocate a garage, revise parking layout and revise landscaping for a vocational training use. The site plan being amended was approved on 5/12/92. The site revisions being requested have already been made. 2. This property is located at 1475 Shelburne Road and is within the C2 District. It is bounded on the north by Densmore Monuments, on the east by Shelburne Road, on the south by Goss Dodge and on the west by undeveloped property. 3. Access/circulation: Access will be via an existing 22 foot curb cut. No changes proposed. Circulation is acceptable. 4. Parking: The parking requirement for this project is 41 spaces and 43 spaces are being provided including two (2) handicapped spaces. The previously approved plan showed 45 spaces. All parking stall dimensions and aisle width requirements are being met. 5. Landscaping: The revised landscaping plan meets the minimum landscaping requirement of $7700. Plantings include Arborvitae, Honey Locust, Lilac, Sandcherry, Juniper, Spirea, and Burning Bush. 6. Coverage/setbacks: Building coverage is 16.25% (maximum allowed is 30%). Overall coverage is 63.7% (maximum allowed is 70%). Front yard coverage is 38.3% (maximum allowed is 30%). This is an existing situation which will not be made worse by this application. 7. The main building does not meet the front setback requirement and is therefore a noncomplying structure subject to Section 19.002 of the zoning regulations. No changes to this building are proposed. The relocated garage meets the setback requirements. 1 8. Traffic: No change 9. Sewer: No change 10. Lighting: Applicant installed floodlights on the new addition which are not downcasting shielded fixtures. These fixtures should be replaced with downcasting shielded fixtures. 11. Sidewalk: The applicant was required, as part of the 5/12/92 approval, to construct a sidewalk along Shelburne Road. The construction of the sidewalk, including its final location, should be approved by the Vermont Agency of Transportation. The plan should be revised to show the final location of the sidewalk, if necessary. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of William & Timothy O'Brien to amend a previously approved site plan to relocate a garage, revise parking layout and revise landscaping for a vocational training use, 1475 Shelburne Road as depicted on a plan entitled "O'Brien's Training Center", prepared by Truex, Degroot, Cullins, Architects, dated May 26, 1994, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. All exterior lighting installed after 5/12/92 must consist of downcasting shielded fixtures. Any fixture which does not meet this requirement must be replaced within 30 days of this approval. Any new exterior lighting or change in existing lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in lighting shall be approved by the City Planner prior to installation. 3. As stipulated in the 5/12/92 approval, the applicant shall be responsible for constructing a sidewalk along the frontage of the property. The construction of the sidewalk including its final location shall be approved by the Vermont Agency of Transportation. The plan shall be revised to show the final location of the proposed sidewalk, if necessary. Three (3) copies of the revised plan shall be submitted to the City Planner. 4. The applicant shall obtain a zoning/building permit within six (6) months or this approval is null and void. 5. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the relocated garage. 6.
