Re: Findings of Fact, application of Timothy O'Brien to amend a
previously approved site plan for a 6,000 square foot addition for
vocational training use. The amendment is to eliminate condition
#7 of the 5/12/92 approval and condition #3 of the 7/12/94 approval
which require the construction of a sidewalk along 1475 Shelburne
Road.
On the 24th day of October, 1995, the South Burlington Planning
Commission approved the request of Timothy O'Brien for site plan
review under Section 26.10 of the South Burlington Zoning
Regulations based on the following findings:
1. This application is to amend a previously approved site plan
for a 6,000 square foot addition for vocational training use. The
amendment is to eliminate condition #7 of the 5/12/92 approval and
condition #3 of 7/12/94 approval. These conditions refer to the
construction of a sidewalk along Shelburne Road.
2. This property located at 1475 Shelburne Road lies within the C2
District. It is bounded on the north by Densmore Monuments, on the
east by Shelburne Road, on the south by Goss Dodge and on the west
by undeveloped property.
3. Sidewalk: This is the only aspect of the site plan being
modified. The 5/12/92 and 7/12/94 approvals required the applicant
to construct a sidewalk along the property's frontage. The
applicant has obtained a letter from VAOT which indicates that if
the sidewalk is constructed the State would have to remove it in
about two (2) years. The applicant is therefore requesting that
the sidewalk condition be eliminated. The construction of a
sidewalk along Shelburne Road is part of the proposed improvements.
Staff recommended approval of the request.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the site plan application of Timothy O'Brien to
amend a previously approved site plan for a 6,000 square foot
addition for vocational training use. The amendment is to
eliminate condition #7 of the 5/12/92 approval and condition #3 of
the 7/12/94 approval which require the construction of a sidewalk
along 1475 Shelburne Road, as depicted on a plan entitled
"O'Brien's Training Center, Shelburne Road, South Burlington,

Vermont", prepared by Truex, deGroot, and Cullins, Architects,
dated 5/26/94, and stamped "received" October 11, 1995, with the
following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. Based on the expressed request of VAOT in a letter dated August
23, 1995, the Planning Commission eliminates conditions #7 of the
5/12/92 approval and condition #3 of the 7/12/94 approval requiring
the applicant to construct a sidewalk along the subject property's
frontage.
