SITE PLAN APPLICATION #SP-18-25
FINDINGS OF FACT AND DECISION
Reperio Properties, hereinafter referred to as the applicant, is seeking approval to
amend a previously approved plan for a 12,503 sq. ft. building approved for commercial
parking use. The amendment consists of converting the building to a 40 student child
care facility, licensed non-residential use, 1475 Shelburne Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
The applicant is seeking to amend a previously approved plan for a 12,503 sq. ft.
building approved for commercial parking use. The amendment consists of
converting the building to a 40 student child care facility, licensed non-residential
use, 1475 Shelburne Road.
2. The owner of record of the subject property is Two O'Brien Properties.
3. The subject property is located in the Commercial 2 Zoning District.
4. The application was received on June 6, 2018.
5. The only change to the approved site plan proposed includes designating 4,927 sq. ft.
of lawn area for an outside play area.
6. The use previous to the commercial parking was a 50 student personal instruction
use.
DIMENSIONAL REQUIREMENTS
7. No changes to the coverages.
8. Setback requirements are being met.
SITE PLAN REVIEW STANDARDS
Only the standards below are affected by this application. All other standards will
continue to be met.

Bicycle Parking
9. The property currently has one (1) bike rack which can accommodate two (2)
bicycles. Section 13.14 (B) (1) (b) of the LDRs allows an existing bicycle rack to remain
and count towards the minimum requirement if it is in compliance with this section. The
existing bike rack meets these requirements in that a bicycle can be positioned at each
end of the rack, where it can be supported upright and attached at the frame and
wheel. Therefore, it can remain to count as no more than two (2) spaces, which meets
50% the minimum requirement of four (4) bicycle parking spaces. The existing rack
must be secured to the ground must meet the appropriate clearances.
Parking
10. The proposed 40 student child care facility will require a total of nine (9) parking
spaces and a total of 41 spaces and two (2) handicapped spaces are being provided.
Traffic
11. The previous personal instruction use is estimated to generate 45.7 pm peak hour
trip ends, based on the 8/25/92 Planning Commission approval. The City of South
Burlington Impact Fee Ordinance was amended on May 19, 2014 to allow a pass -by rate
reduction of 30% when estimating the traffic to be generated by child care centers for
which the City has issued a zoning permit since 1/1/11. The proposed 40 students are
estimated to generate 33 vtes and with the 30% reduction to generate 23.1 total vtes
(33 X 0.7 = 23.1). No additional traffic is therefore expected to be generated.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-18-25 of Reperio Properties, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. This project shall be completed as shown on the plan and shall be on file in the
South Burlington Department of Planning and Zoning.
3. The applicant must obtain final wastewater allocation prior to permit issuance.
4. For the purpose of calculating road impact fees under the South Burlington Impact
Fee Ordinance, the Administrative Officer estimates that this change in use will
generate zero (0) additional vehicle trip ends during the p.m. peak hour.
5. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.

6. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer
prior to the use of the building as a child care facility.
7. Any change to the site plan shall require approval by the South Burlington
Development Review Board or the Administrative Officer.

by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
