HomeMy WebLinkAboutSP-95-0000 - Decision - 1485 Shelburne RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Douglas Hoar to: 1) construct an 832 square foot addition to an accessory structure on a lot containing a 26,917 square foot auto sales and service facility, and 2) construct a 735 foot long access road to Holmes Road, 1485 Shelburne Road. On the 9th of May, 1995, the South Burlington Planning Commission approved the request of Douglas Hoar for site plan reveiw under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of: 1) construction of an 832 square foot addition to an accessory structure on a lot containing a 26,917 square foot auto sales and service facility, and 2) construction of a 735 foot long access road to Holmes Road. The last review of this property by the Planning Commission was on 8/28/84. 2. This property located at 1485 Shelburne Road and 2 Holmes Road lies within the C2 District. It is bounded on the north by Holmes Road, on the east by commercial business and Shelburne Road, on the west by the railway r.o.w. and on the north by a retail store. 3. Access/circulation: Access to the 1485 Shelburne Road property is via two (2) curb cuts on Shelburne Road. The southerly access is for ingress and egress and the northerly access is egress only. The 8/28/84 approval for the northerly access required that it be signed for exiting vehicles only. This condition is not currently being met. The plan should be revised to indicate that this access is for egress only. Access to the 2 Holmes Road property is via one (1) curb cut on Holmes Road. 4. This proposal includes the construction of an access road 735 feet in length which would provide the 1485 Shelburne Road property (i.e., Goss Dodge) access to Holmes Road over the 2 Holmes Road property. This would result in this property having two (2) driveways. Section 26.103(a) of the zoning regulations state that "unless specifically approved by the Planning Commission there shall be a maximum of one driveway per lot accessing a public street". Staff did not see a problem with providing two (2) driveways since this access road will improve safety on Shelburne Road. 5. Staff suggested that the adjacent O'Brien and Socinski properties be given rights to utilizing the access road. The applicant has not expressed a willingness to allow this. The 1 legal documents for this r.o.w. should be approved by the City Attorney and recorded prior to issuance of the zoning permit. The plan should be revised to include the metes and bounds information for the r.o.w. Circulation is adequate. 6. Coverage/setbacks: 1485 Shelburne Road: Building coverage is 5.9% (maximum allowed is 30%). Overall coverage is 40.8% (maximum allowed is 70%. Front yard coverage is 8.2% (maximum allowed is 30%). 2 Holmes Road: Building coverage is 2.1% (maximum allowed is 30%). Overall coverage is 29.1% (maximum allowed is 70%). Front yard coverage is 7.8% (maximum allowed is 30%). Setback requirements are met. 7. Landscaping: The minimum landscaping requirement, based on building costs, is $420 which plantings include cedar shrubs. The plan should be revised to show the location of the proposed plantings and include a planting schedule. 8. Parking: The 1485 Shelburne Road property requires a total of 56 parking spaces for customers and employees. These spaces should be indicated on the plan. 9. Sewer: No additional allocation needed. 10. Traffic: This property is located in Traffic Overlay Zone 5 which would allow this property to generate 470 vehicle trip ends (vte's) during the P.M. peak hour. ITE estimates that this facility currently generates 71 vte's and with the proposed addition to generate 72.7 vte's for a 1.7 vte increase. 11. Lighting: Existing exterior lighting consists of the following: --- 23, one thousand watt metal halide lamps with downcasting and shielded fixtures on sixteen 22 foot poles. --- 2 building mounted 250 watt sodium high pressure flood lights, one (1) mounted on the main building and one (1) is mounted on an accessory building. 12. Other: --- the plan should be revised to include: a scale, the correct name of Holmes Road and the name of the current owner of 2 Holmes Road. K DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the site plan application of Douglas Hoar to: 1) construct an 832 square foot addition to an accessory structure on a lot containing a 26,917 square foot auto sales and service facility, and 2) construct a 735 foot long access road to Holmes Road, 1485 Shelburne Road as depicted on a plan entitled "Goss Dodge, Holmes Trucking, and Surrounding Properties", prepared by Heath Racine - Presentation Drawings, dated 4/27/95, subject to the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plan shall be revised prior to issuance of a zoning permit to show the changes listed below and shall require approval by the City Planner. Three (3) copies of the approved revised site plan shall be submitted to the City Planner prior to permit. a) The site plan shall be revised to show: 1) the northerly access to 1485 Shelburne Road as being for egress only, 2 ) the scale, 3) the correct name of Holmes Road and, 4) the name of the current owner of 2 Holmes Road. b) The site plan shall be revised to show the location of proposed landscaping and a planting schedule which shall include the species, quantity and size of the planting material. c) The site plan shall be revised to show the 56 parking spaces required for customers and employees. 3. The northerly access to the 1485 Shelburne Road property shall be signed for exiting vehicles only. 4. The Planning Commission, pursuant to Section 26.103(a) of the zoning regulations, specifically approves a second driveway for the 2 Holmes Road property. 5. Prior to start of construction of the proposed access road, the applicant shall be responsible for the following: 1) submit legal documents for the proposed 25 foot r.o.w. across 2 Holmes Road property for review and approval by the City Attorney, 2) record the approved legal documents in the South Burlington land records, and 3) revise the site plan to show metes and bounds information for the proposed 25 foot r.o.w. 6. The applicant shall post a issuance of a zoning permit. The three (3) years to assure that the a good chance of surviving. Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light beyond the property line. Any change in existing or proposed lighting shall be approved by the City Planner prior to installation. 8. The applicant shall obtain a zoning permit for the addition within six (6) months or this approval is null and void. The applicant shall start the construction of the proposed driveway within six (6) months or this approval is null and void. 9. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to use of the addition. 10.
