FINDINGS OF FACT & DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, application of Goss Dodge, Inc. to amend a
previously approved site plan for a 27,749 square foot auto sales
and service facility. The amendment consists of constructing a 432
square foot office addition for the auto sales and service
facility, 1485 Shelburne Road.
On the 14th day of January, 1997, the South Burlington Planning
Commission approved the request of Goss Dodge, Inc. for site plan
review under Section 26.10 of the South Burlington Zoning
Regulations based on the following findings:
1. This project consists of amending a previously approved site
plan for a 27,749 square foot auto sales and service facility. The
amendment consists of constructing a 432 square foot office
addition for the auto sales and service facility. The last review
of this property by the Commission was on 5/9/95. The ZBA on
1/13/97 approved a request from the applicant for a conditional use
permit.
2. This property located at 1485 Shelburne Road lies within the C2
District. It is bounded on the north by an educational facility
and a storage/distribution facility, on the east by Shelburne Road,
on the west by the railway r.o.w., and on the north by a retail
building and the recently approved brewery.
3. Access/circulation: Access is provided by two (2) curb cuts on
Shelburne Road, the southerly access is for ingress and egress and
the northerly access is for egress only. Access is also provided
by a r.o.w. to Holmes Road. No changes proposed.
Circulation on the site is adequate.
4. Coverage/setbacks: Building coverages is 6% (maximum allowed is
30%). Overall coverage is 40.8% (maximum allowed is 70%). Front
yard coverage is 8.2% (maximum allowed is 30%).
Setback requirements are met.
5. Landscaping: The minimum landscaping requirement, based on
building costs, is $450 which is being met. Proposed plantings
include Lilac and Yew.
6. Parking: A total of 57 parking spaces are required for
customers and employees and 88 spaces including two (2) handicapped
spaces are available. A bike rack should be provided as required
under Section 26.253(b) of the zoning regulations.
7. Sewer: No additional sewer allocation needed.
8. Traffic: This property is located in Traffic Overlay Zone 5
which would allow this property to generate a maximum of 470
vehicle trip ends (vte's) during the P.M. peak hour. ITE estimates
that this facility currently generates 72.7 vte's and with the
proposed addition to generate 73.6 vte's for a 0.9 vte increase.
The applicant was made aware that the road impact fee is $0.
9. Lighting: Existing exterior lighting consists of the
following:
--- twenty-three (23), one thousand watt metal halide lamps with
downcasting and shielded fixtures on sixteen (16) 22 foot
poles.
--- two (2) building mounted 250 watt sodium high pressure flood
lights, one (1) mounted on the main building and one (1) is
mounted on an accessory building.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the site plan application of Goss Dodge, Inc.
to amend a previously approved site plan for a 27,749 square foot
auto sales and service facility. The amendment consists of
constructing a 432 square foot office addition for the auto sales
and service facility, 1485 Shelburne Road, as depicted on a plan
entitled, "Plan Showing Proposed Building Addition "Goss Dodge"
Douglas W. & Cheryl A. Hoar Property Shelburne Road South
Burlington, Vermont," prepared by Warren A. Robenstein, dated Oct,
1996, with the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. The site plan shall be revised to show the changes below and
shall require approval of the City Planner. Three (3) copies of
the approved revised plans shall be submitted to the City Planner
prior to permit issuance.
a) The site plan shall be revised to include a bike rack as
required under Section 26.253(b) of the zoning regulations.
3. Prior to issuance of a zoning permit, the applicant shall post
a $450 landscaping bond. The bond shall remain in effect for three
(3) years to assure that the landscaping takes root and has a good
chance of surviving.
4. For the purpose of calculating road impact fees under the South
Burlington Impact Fee Ordinance, the Planning Commission estimates
that the proposed use will generate 0.9 additional vehicle trip
ends during the P.M. peak hour.

5. Any new exterior lighting shall be downcasting shielded
fixtures so as not to cast light beyond the property line. Any
change in lighting shall be approved by the City Planner prior to
installation.
6. The applicant shall obtain a zoning permit within six (6)
months pursuant to Section 27.302 of the zoning regulations or this
approval is null and void.
7. The applicant shall obtain a Certificate of
Occupancy/Compliance from the Administrative Officer prior to use
of the new addition.
8. Any changes to the site plan shall require approval by the
South Burlington Planning Commission.
