FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, site plan and conditional use application of Goss Dodge, Inc. to
amend a previously approved site plan. The amendment consists of constructing a
35'x60' addition and a 28'x44' addition to an auto sales and repair facility, 1485
Shelburne Rd.
On the l st of August, 2000, the South Burlington Development Review Board approved
the conditional use application under Section 26.05 and site plan application under
Section 26.10 of the South Burlington Zoning Regulations of Goss Dodge Inc. based on
the following findings:
1. This project consists of amending a previously approved site plan. The amendment
consists of constructing a 35'x60' addition and a 28'x44' addition to an auto sales and
repair facility, 1485 Shelburne Rd.
2. The owners of record are Douglas and Cheryl Hoar.
3. Access/Circulation: Access is currently provided by two 20 foot curb cuts on
Shelburne Road. The southerly access is for ingress and egress and the northerly
access is for egress only. Access is also provided by a r.o.w. to Holmes Road. No
changes are proposed. Circulation on the site is adequate.
4. Coverage/Setbacks: Building coverage is currently 6.3% and is proposed to increase
to 7.1% (30% max). Total coverage is currently 32.8% and is proposed to increase
to 35.7% (70% max). Front yard coverage is 12.7% and will decrease to 10% (30%
max). Setback requirements are met.
5. Parking: A total of 66 parking spaces are required and 88 spaces are being provided.
Four handicapped parking spaces are required and only two are being provided.
Plans should be revised to provide two additional handicapped parking spaces. A
bike rack is being provided.
6. Traffic: This property is located in Traffic Overlay Zone 5 which would allow this
property to generate a maximum of 470 vehicle trip ends (vte's) during the P.M. peak
hour. The property is currently approved for 73.6 P.M. peak vehicle trip ends. The
proposed addition will add 19.33 P.M. peak hour trip ends for a total of 92.9 P.M.
peak hour trip ends. The applicant should expect to pay a road impact fee for the
additional 19.3 vte's.

7. Sewer: The applicant has not requested an additional sewer allocation.
8. Landscaping: The minimum landscaping requirement, based on building costs, is
$3,888. This requirement is not being met. The applicant has requested a
landscaping waiver as the business has existed on the site for 30 years and the
existing landscaping is already well established. Staff recommended that a
landscaping waiver not be granted as the applicant is proposing to increase coverages
on a site that already has a significant amount of paved area. The applicant should
work with staff to determine appropriate planting and plans should be revised to
incorporate $3,888 worth of landscaping.
9. Lighting: All lights must be downcasting and shielded. The applicant should submit cut
sheets for all proposed lights for approval by the Director of Planning and Zoning.
10. Dumpsters: There are currently three dumpsters located on the property.
11. Conditional Use Criteria:
The proposed use complies with the stated purpose of Commercial Two District to
encourage "general commercial activity".
The proposed use will not adversely affect:
a) the capacity of existing or planned community facilities. No affect expected.
b) the character of the area affected. No affect expected.
c) traffic on roads or highways in the vicinity. The proposed use is not expected to impact
traffic adversely.
d) bylaws in effect. The proposal is in conformance with the zoning regulations.
e) utilization of renewable energy resources. There is no utilization of renewable energy
resources to be affected.
f) general public health and welfare. No adverse affect expected.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board
approves conditional use application #CU-00-18 and site plan application #SP-00-35 of
Goss Dodge, Inc. to of amend a previously approved site plan. The amendment consists
of constructing a 35'x60' addition and a 28'x44' addition to an auto sales and repair
facility, 1485 Shelburne Rd, as depicted on a one (1) page set of plans, entitled, "Plan
Showing Proposed Building Addition Goss Dodge", prepared by Warren Robenstein, dated
6/22/00, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.
2. The site plan shall be revised to show the changes listed below and shall require
approval of the Director of Planning & Zoning (hereinafter Director). Three (3) copies
of the approved revised site plan shall be submitted to the Director prior to permit
issuance.
a) The site plan shall be revised to provide two additional handicapped
parking spaces.
b) The site plan shall be revised to incorporate $3,888 worth of landscaping.
3. All lights must be downcasting and shielded. Any change to approved lights shall require
approval of the Director of Planning and Zoning prior to installation.
4. The applicant shall post a $3,888 landscape bond prior to issuance of a zoning permit.
The bond shall remain in effect for three (3) years to assure that the landscaping takes root
and has a good chance of surviving.
5. For the purpose of calculating road impact fees under the South Burlington Impact Fee
Ordinance, the Development Review Board estimates that the additions will generate 19.3
additional vehicle trip ends (vte's) during the P.M. peak hour for a total of 92.9 P.M. peak
hour vte's.
6. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
27.302 of the zoning regulations or this approval is null and void.
7. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to occupancy of the additions.
8. Any change to the site plan shall require approval by the South Burlington Development
Review Board.
