HomeMy WebLinkAboutAD-12-01 - Decision - 0002 Holmes Road# AD-12-01 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING DOUGLAS HOAR MINOR LOT LINE ADJUSTMENT APPLICATION #AD-12-01 FINDINGS OF FACT AND DECISION Douglas Hoar, hereinafter referred to as the applicant, is seeking approval for a boundary line adjustment between 1485 Shelburne Road & 2 Holmes Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the follow: FINDINGS OF FACT 1. The applicant is seeking approval for a boundary line adjustment between 1485 Shelburne Road & 2 Holmes Road. 2. The owners of record of the subject properties are DBS, LLP & DS, LLC. 3. The subject properties are located in the Commercial 2 Zoning District. 4. The application was received on July 19, 2012. 5. The plan submitted is entitled, "Plat of Survey Showing Proposed Boundary Line Adjustment Douglas W. & Cheryl A. Hoar Prop. Shelburne Rd. & Holmes Ave. So. Burl. Vt", prepared by Warren A. Robenstien, dated Sept. 1995, last revised on 7/24/12. DIMENSIONAL REQUIREMENTS 6. All area and dimensional requirements will continue to be met for all two (2) lots involved. PURSUANT TO SECTION 15.19(8) OF THE LAND DEVELOPMENT REGULA TIONS. 7. NO NEW LOTS ARE CREATED THROUGH THIS ADJUSTMENT. The boundary line adjustment between 1485 Shelburne Road & 2 Holmes Road does not result in the creation of any new lots. The boundary line adjustment involves the exchange of 0.51 acres whereby the lot at 1485 Shelburne Road is # AD-12-01 increased in size to 9.9 acres and the lot at 2 Holmes Road is decreased in size to 8.59 acres. 8. THE SALE OR EXCHANGE OF PARCELS OF LAND IS BETWEEN ADJACENT PROPERTY OWNERS. The lot line adjustments will be between adjacent property owners. 9. THE RELOCATION OF THE LOT -LINE DOES NOT RESULT IN THE CREATION OF A NON -CONFORMING LOT, STRUCTURE OR USE. Lots are in conformance with the City of South Burlington Land Development Regulations, Article 15 Subdivision and Planned Unit Development, Section 15.19 Minor Lot Line Adjustments. 10. THE PROPOSED CHANGE DOES NOT VIOLATE ANY CONDITIONS IMPOSED FROM PRIOR MUNICIPAL APPROVAL. This lot line adjustment does not violate any conditions of prior approval. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves Minor Lot Line Adjustment Application #AD-12-01 of Douglas Hoar, for a boundary line adjustment between 1485 Shelburne Road & 2 Holmes Road. 1. All previous municipal approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plat and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The final plat plan shall be recorded in the land records within 180 days or this approval is null and void. The plan shall be signed by the Administrative Officer prior to recording. Prior to recording the final plat plan, the applicant shall submit a copy of the survey plat in digital format. The format of the digital information shall require approval of the South Burlington GIS Coordinator. # AD-12-01 5. Any change to the plat plan shall require approval by the South Burlington Development Review Board or the Administrative Officer. Signed on this day of C, X, 2012 by Raymond J. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
