IDX has renovated and reoccupied the 1500 Shelburne Road building and they wish to modify their existing site plan. We propose to modify the graveled and grass areas to the south and east of the building per a previously approved site plan for a day care. There will be no change in use. I enclose a revised site plan which accurately depicts both the existing conditions and proposed improvements for the site. With specific regard to the staff comments, I offer the following responses: 1. Parking Spaces The plan shows continues to show 80 spaces, which should be more than adequate given the following breakdown of uses within the building: ■ Office: 17,184 sf ■ Mailroom: (2 empl) 2,016 sf ■ Warehouse: 1,400 sf 2. Paved / Gravel Parking Spaces Refer to plan; it accurately depicts the number of parking spaces in paved and unpaved areas. 3. Other Business a. Mr. Weith noted a letter has been received from GM Development regarding their development near Red Rocks Park. They have agreed to put in a fence to help prevent encroachment into the Park. The setback will be left in its natural condition. Mrs. Maher wanted to know what kind of fence would be put in. Mr. Craig felt Mr. Brush should come in and indicate how many trees have to come down for the fence. b. Mr. Weith noted applications for Act 200 Special Planning Grants have to be in by 11/1. He said he thought about asking for funds for the rest of the Boyle study of the S.E. Quadrant or possibly another City Center proposal. Mr. Craig suggested some- thing with CCTA on Shelburne Rd. A discussion will be scheduled for the next agenda. 2. Minutes of 29 August 1989 Mr. Craig moved to approve _the Minutes _of 29 August_as printed. Ms. Peacock seconded. Motion passed unanimously. 3. Site Plan application of BDP Realty, Inc., for operation of a day care facility in an existing office building, 1500 Shelburne Rd. Mr. Kane said the facilities would be for employees and for the general public. There will be 2 accesses, one on Shelburne Rd., PLANNING COMMISSION 10 October 1989 page 2 and one on Holmes Rd. The Shelburne Rd, access will be entrance only. An outside playground would be constructed. Eighty parking spaces would be required and are shown. Mr. Weith said this assumes 70 students and 12-14 staff people. Mr. Burgess noted that Mr. Weith recommends relocation of the maple tree which may be disturbed when the driveway is widened. Mr. Weith also re- commended a 660 qpd sewer allocation since there will be an in- crease of about 44 people in the building. The Planning Commission agreed with this. Ms. Peacock moved the Planning Commission approve the Site Plan application of B.D.P. REalty, Inc, for operation of a 3000 sq. ft. day care facility in an existing 20,600_sg_ ft. office building as depicted on a plan entitled "BDP REalty,_ Shelburne Road, South Burlington, Vermont, Site Plan," prepared by Trudell Consulting Engineers, Inc, and -dated 9/29/89_with the following__stipulations_ 1. O'Toole's is a Canadian Company with many restaurants in Canada and now in the U.S. They are an upscale restaurant, targeted for ages 28-44. There would be no new construction on the outside of the building. On the lot, they would add parking in the rear and some additional green space in front. The Zoning Board has approved the multiple use. A traffic study has been done and they believe they are in the limits of the overlay district. This record is updated monthly and, like your agency's report, lists the 12 month average flow and approved commitments against reserve. This record was last updated on September 15, 1991 and incorporates information from your agency's recent report of uncommitted reserve capacity dated 9/9/91. As Mr. Weith stated, the above referenced project received ap- proval from the South Burlington Planning Commission in December 1987. The City currently has a 3,825 gpd allocation reserved for phase II of the IDX Headquarters project. As Mr. Weith also explained, the City updates the 12 month aver- age flow estimate for the Bartlett Bay facility on the first of each month. As of 9/1/91, the 12 month average flow (9/1/90- 8/31/91) at the Bartlett Bay Treatment facility was 731,000 gpd. This is significantly different from your agency's estimate of 751,833 gpd contained in the report dated 9/9/91. It is my understanding that the State figure is based on a 12 month period ending 6/30/91. Both lots are developed with single family dwellings. These properties are located at 76 and 80 Shunpike Road and lie within the R4 District. They are bounded on the north by residences, on the east by undeveloped industrial/commercial lots, on the south by a residence and on the west by Shunpike Road. We engineered the work subsequent to approval and started work the week of 10/11/93. Work is now nearly complete and in conformance with the enclosed drawings. In a previous parking lot expansion for 1400 Shelburne Road which I completed in 1992 I was not required to draw a building permit or a certificate of occupancy. I have submitted the drawings to Dick Ward for review and permits in an effort to comply with Planning commission approval. Under the lease obligations with Senesac, the ap- plicant could have forced Senesac to do the work or could have done it themselves. They can't do this with the bank and have been told not to do anything. Mr. Nicholson said they are pre- pared to do the work and would enter into an escrow agreement with the city ($5,000) to do the work. Mr. Burgess noted that legally nothing has changed, but added there are extenuating circumstances the Commission may want to consider. Mrs. Maher noted there are extreme obstacles to the applicant complying. Mr. Craig said he appreciated the problem but noted the Commis- sion has had difficulty in the past getting projects into line with a plan. The only way to get the parking lot fixed, he said, is to keep the pressure on. He said he didn't see a change in circumstance. Ms. Peacock said she felt sorry for the applicant but didn't think this was the kind of circumstance that would allow the Com- mission to rehear the application. Mr. Teeson felt if the city had the escrow money, he could allow the request. Mr. Nicholson felt that Mr. Senesac could throw them off the lot if they tried to do the work and he didn't want anyone getting hurt. Mr. Burgess said he couldn't vote for the request as legally nothing has changed. Mr. Crai moved that based on evidence presented there is in- sufficient chan e in circumstance to rehear the application. Ms. Peacock seconded. Motionpassed 3-2 with Mrs. Maher and Mr. Teeson voting against. 6. Site plan application of Kessel/Duff Corporation to expand an existing parking area serving a 20,600 sq. ft. office building, 1500 Shelburne Rd: Mr. Austin stepped down due to a potential conflict of interest. Mrs. Maher swore in those giving testimony. Mr. Duff said what is being proposed is very similar to what was approved several years ago. They will add 12 parking spaces at one end of the builidng and 15 at the oth3r. Parking areas will be gravel but they are considering paving them. A waiver of two spaces is being requested. The applicant said they would instead pave the parking areas. Mrs. Maher seconded. Motion passed unanimously. Mr. Austin rejoined the Commission at this time. 8. Public Hearing: REvised final plat application of Richard S. Scott for conversion of an existing 12,000 sq. ft. building to retail use. The building sits on a 6.8 acre parcel and is part of a planned commercial development consisting of two other buildings (Grossman's and Jiffy Lube), 1519 Shelburne Rd: The Clerk swore in those giving testimony. Mr Pomerleau noted that the primary concern was traffic. He said they have altered the entrance to a one-way in only. Parking spaces have been angled to force people to go out via the signal- ized intersection. There will be signage all the way around the building to direct traffic. Since the former tenant is gone, there is not way to measure their traffic. The applicant contends that the difference in traffic is insignificant and that the one-way entrance would mitigate any slight increase. Mr. Pomerleau added that the applicant probably won't use the entire premises. Mr. Dickinson said there is no ITE designation for the proposed use (sales of car stereos, etc.). He said he did counts at Great Northern Stereo, City Stereo, and other similar locations. Those rates were used for his calculations. Mr. Austin felt there would be very long delays at the intersection on Saturday afternoons based on what he has ac- tually seen. Mr. Dickinson suggested retiming the signal. Mr. Craig noted that everyone says to do that. It doesn't mesh. Mr. Austin said he feels sorry for people who own property there. Until the road is widened, any additional use, even one more car, can't be handled. He said he couldn't vote in favor or the use until the road is widened. Mr. Pomerleau said this is not a high volume use as they are selling high end components. He felt they were improving existing conditions. Mr. Austin noted that Great Northern Stereo generates a lot of traffic. Mr. Craig said he didn't want to see another car at this inter- section.
