Re: Findings of Fact, application of Kessel/Duff Corporation to
expand an existing parking area serving a 20,660 square foot office
building, 1500 Shelburne Road.
On the 28th of September, 1993 the South Burlington Planning
Commission approved the request of Kessel/Duff Corporation for site
plan review under Section 19.10 of the South Burlington Zoning
Regulations based on the following findings:
1. This project involves expanding the parking area of an existing
20,600 square foot office building. The Planning Commission last
reviewed this site on 10/10/89 when it approved a day care facility
in this building. The day care facility was never established.
2. This project located at 1500 Shelburne Road lies within the C2
District. It is bounded on the east and south by an auto
dealership, on the north by the main IDX office building, and on
the west by Shelburne Road.
3. Access/circulation: Access is via the adjoining IDX property.
No access changes proposed.
Circulation is adequate.
4. Coverage/setbacks: Building coverage is 9.9% (maximum allowed
is 30%). Overall coverage is 29.3% (maximum allowed is 70%).
Front yard coverage is 1% (maximum allowed 30%).
5. Setback requirements are met. The note on the plan indicating
a 40 foot setback from Shelburne Road should be revised to note
that the setback requirement is 50 feet.
6. Parking: The current use of the building requires a total of
82 parking spaces. The plan shows 80 spaces, including four (4)
handicapped spaces. The applicant should install concrete curb -
stops in the gravel area to define parking spaces. The Planning
Commission approved a 4800 square foot addition to this building on
1/26/82 with the applicant providing 84 spaces. The applicant is
seeking a waiver for the two (2) space shortfall.
7. Landscaping: There is no minimum landscaping requirement based
on building construction costs. No additional landscaping proposed.
The site is well landscaped and no additional landscaping is
recommended.
8. Lighting: Exterior lighting consists of the following:

200 watt metal halide flood light.
40 watt high pressure sodium light.

9. Dumpster: Two (2) dumpsters are located in the rear of the
building. They are adequately screened by the building.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the site plan application of Kessel/Duff
Corporation to expand an existing parking area serving a 20,600
square foot office building as depicted on a two (2) page set of
plans, page one entitled "BDP Realty, Shelburne Road, South
Burlington, Vermont", prepared by Trudell Consulting Engineers,
Inc. and dated 9/28/89, last revised 8/18/93, with the following
stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. All exterior lighting shall be downcasting or appropriately
shielded so as not to cast light beyond the property line. Any
change in existing lighting or new lighting shall be approved by
the City Planner prior to installation.
3. The plan shall be revised prior to issuance of a
zoning/building permit to show the changes listed below and shall
require approval by the City Planner. Three (3) copies of the
approved revised plan shall be submitted to the City Planner prior
to permit issuance.
a) the front yard setback dimension along Shelburne Road shall
indicate 50 feet instead of 40 feet.
b) based on the expressed representation of the applicant,
plan shall indicate that all parking/circulation areas are to
be paved. Parking spaces shall be painted.
4. The Commission approves 80 parking spaces for this development
which represents a 2 space waiver or 2.4% shortfall. It is
the Commission's opinion that 80 spaces will adequately serve
the use.
5. The applicant shall obtain a zoning/building permit within six
(6) months or this approval is null and void.
6. The applicant shall obtain a Certificate of Occupancy from the
Administrative Officer prior to use of the expanded parking area.

7. Any changes to the site plan shall require approval by the
South Burlington Planning Commission.
8. There is an existing drainage ditch along the easterly and
southerly lot lines. The ditch must be maintained. It must also
be shown on the plans.
9. There also exists a sewer main along the south side of the
building. This must be shown on the plans. Any manholes within
the proposed parking area shall be brought up to grade, if
necessary.
