S. 45+80 RT SPECIAL CONDITIONS This permit is granted subject to the conditions on the back of the permit, with special attention given to the Special Conditions listed below. The access shall be constructed in accordance with the profile and notes of standard drawing B-71, copy attached and the attached plan dated 1/22/88. The access must be constructed to prevent water from flowing onto the highway. When requested, the District Transportation Administrator will inspect the access prior to paving. If not inspected, and the access is not satisfactory, the District Transportation Administrator can order reconstruction of the access by the Owner at their expense. All grading within the highway right-of-way (cuts and fills) associated with the construction of the access shall be inspected and approved by the District Transportation Administrator or his staff. The Owner is responsible for access maintenance (beyond the highway shoulder point). In the event that illumination lighting proves to be a hazard to the traveling public, the Petitioner will be ordered to remove or modify the lighting at his own expense. In the event that traffic from this development increases to the point where traffic signals, additional lanes for turning, or any other modifications are necessary, the expense of such improvements or facilities shall be borne by the Owner, his successors, and assigns. The determination of need for such measures is the responsibility of the Agency of Transportation and will be based upon and justified by standard Agency proced ures. Construction of the access will be performed in such a way to minimize conflicts with normal highway traffic. If necessary, the District Transportation Administrator, may request special uniformed officers to be employed to direct traffic during the construction period, at the Owners expense. Where necessary, commercial drives shall be paved from the edge of the highway pavement to the highway right-of-way or as directed by the District Transportation Administrator. Project signing and traffic control devices (such as barriers), necessary for the protection of all Permit Holder personnel, and others, including the traveling public shall be in conformance 'with the MUTCD (Manual of Traffic Control Devices), ►� Agency of Transportation Standards and additional signing or traffic control deemed necessary by the District Transportation Administrator. Uniformed traffic officers or trained flagpersons, shall be provided when two-way traffic cannot be maintained, and/or at the request of the District Transportation Administrator whenever he deems it necessary for the protection of the traveling public. It is incumbent upon the Permit Holder to verify the appropriate safety measures needed, prior to construction, so proper devices and/or personnel are available when and as needed. Failure to utilize proper measures shall be considered sufficient grounds for the District Transportation Administrator to order cessation of the work immediately. The Permit Holder shall be responsible for all damages to persons and/or property due to or resulting from any work done under this permit. Open trenches or pits along the side of the road shall be filled at the end of each day or properly protected. Even when properly protected, no pit shall be left open for more than one week. All sub -base and shoulder material shall be new material from a source approved by the District Transportation Administrator. Roadway shoulder areas will be maintained free of obstructions, including parked vehicles, at all times. Except in cases of emergency, for which a waiver can be granted by the District Transportation Administrator, no work is to be performed on the day before, on, or the day after Legal Holidays. Seeding and mulching shall be done in accordance with Section 651 Turf Establishment of the Standard Specifications for Construction published by the Vermont Agency of Transportation and to the satisfaction of the District Transportation Administrator. Any variance from approved plans is to be recorded on "as-builts" with copies provided to both the Utilities Engineer and the District Transportation Administrator A pre -construction meeting must be held prior to the Permit Holder's employees or contractor beginning work to discuss work to be completed. Present at this meeting will be the appropriate Agency respresentatives, the contractor's superintendent, and the Permit Holder and/or representative assigned to the project. Upon completion of the work by the Permit Holder, a final inspection will be held, with the same parties present as at the pre -construction meeting. The Permit Holder's contractor will be required to restore the highway to as good condition as it S was prior to the work, and to the satisfaction of the Agency or the District Transportation Administrator. No work may be performed within the State highway right-of- way between November 15 and April 15 without specific, written permission from the District Transportation Administrator. This permit covers only construction within the State highway right-of-way, and in no way releases the permit Holder from the requirements of other local and/or state governing bodies which may have jurisdiction in this matter. This permit is for construction of the access only. Only construction vehicles are authorized to use the access untill all work, including signals, loops, and related equipment, are installed and accepted by the Agency. Design approval for the signals, loops, pavement markings, etc. are not being authorized by this permit. The permit will be ammedned by letter after final plans have been approved by the Agency. There are presently 66 employees and they want to add enough room for an additional 25. He said an additional 21 parking spaces had been provided, and that seemed adequate, since there was enough parking now. Access around the back of the building will be improved for fire protection. The building will be lengthened toward the north, but the addition will match the present building in style and materials. Mr. Harris explained the landscaping plan. They are still short $500. Mr. Poger suggested more plantings between the building and the parking lot, and perhaps some more in front of the parking lot. Sketch plan application of John Belter for expansion of Industrial subdivision with 13 new lots, located at Ethan Allen Drive Mr. Belter removed himself from the discussion due to a conflict of interest. Mr. Spitz noted that most of the lots were straightforward. Room has been left to reach the land behind the lots next to the Berard land. He said that lots 2-6 as well as 19-21 backed up to a swale that was in the floodplain. All these lots will have usable area in front, but will not be buildable in the rear. Access to lots 19-21 will be through a private drive coming off Ethan Allen Drive. Mr. Poger noted that usually roads were allowed to cross the floodplain, but not run through it as this one does. He noted that the real problem here will be the intersection of Ethan Allen Drive and Airport Parkway. Mr. Spitz said they would look into what could be done. Mr. Brennan noted that at one time there had been discussion about straightening Airport Parkway so it went straight from the top of the hill to the Limekiln Bridge. Mr. Poger said that perhaps should be discussed with the City Council. Mr. Belter was asked why his lots did not go back as far as Mr. Berard's did. He said Mr. Berard had wanted to use all his land, whereas he wanted to provide 40,000 sq. ft. lots. People usually want smaller lots. Landscaping and Screening: Detailed landscaping plans must show $3000 worth of plantings in Phase I, and $34,500 in Phase II. The 42% lot coverage is below the maximum allowable. Sewer: Phase I is estimated to need 4100 gallons per day. Phase II should require 13,200 gallons per day. The State may agree to allow the rehabilitation in Phase I based on the pre-existing flows of this building; if so, Phase I can occur as soon as capacity is available. BURLINGTON SUBJECT: SITE PLAN REVIEW DATED: FEBRUARY 4, 1985 TIME: 9:10 TO 9:45 LOCATION: CITY OF SOUTH BURLINGTON MUNICIPAL OFFICES This meeting was arranged by Bread Loaf Construction Co., Inc. to review the attached site plan (S-1 dated 1/29/85) for completeness, accuracy and suitability. The first available Planning Commission meeting date is March 12, 1985 at 7:30 pm. and Bread Loaf Construction is anxious to submit a plan that will comply with the recommendations of the City Engineer and the Zoning Administator. The attached plan is identical in almost every respect to the site plan submitted 5 years ago against which a permit was apparently issued. PARKING CAPACITY: Jane asked if all the additional parkinq shown will be required. Steve pointed out that the South Burlington Zoning Regulations call for more than the total shown and that both the existing and proposed building are "under -parked'' already. Jane indicated that the Town may be willing to demonstrate some flexibility on the listed requirements to keep from installing any unnecessary paving or providing more parking than necessary. Page 2 Conference Report dated 2/4/85 PARKING LOCATION: Jane further suggested that the new paving is abutting adjacent property and covering a sewer line. While neither condition is expressly prohibited by the Zoning regulations, Jane pointed out that she and the City Engineer would quite likely recommend against such a location. Steve suggested that since a permit was already issued against this plan that the applicant may be inclined to argue against any unwelcomed consumption of otherwise developable land. Jane responded by saying that the Board does not always agree with staff recommendations and the Owner is certainly within his rights to submit the plan as previously approved. However, if the board acts to refuse the present layout, a significant delay will ensue as the alternate plan is prepared and a new hearing is scheduled. Steve and Jane agreed that some kind of compromised solution agreeable to the Owner and the administrators would be much more preferable to submitting a scheme almost certian to meet with staff disapproval. LANDSCAPING: The City of South Burlington now requires that a budget of 30 of the total building cost be allocated for plantings and landscaping. Steve agreed to show a new landscaping scheme on the site plan that will conform in scope to the prescribed budgetary requirements. (The estimated $7,500.00 must be verified through an escrow account, an Owner supplied bond or an Owner supplied letter of credit.) RESUBMITTAL Steve then agreed to meet with the Owners and address the suggested revisions and alternations and to have a revised set of plans in Jane's office within the week. An additional meeting was set up for Thursday afternoon, February 7, 1985. Page 3 Conference Report dated 2/4/85 SEWAGE: Steve then discussed the attached water consumption figures with Jane. It is fairly obvious that with the new 25 employees occasioned by the addition that the total output will still be below the 15 gallons per employee (presently utilized by the Division of Protection) of the existing building population. Based on this information, Jane indicated she would be willing to recommend that this project will not effect the total allocation presently handled by the Mallett's Bay Sewage Treatment plant. This should allow for City of Burlington approval subject to the Division of Protection's approval after March 12. CONCLUSIONS: Steve agreed to call Jane on the afternoon of February 5, to discuss the Owner approved alterations and to verify the meeting dates and procdures. Land Use Permit Application Dear Geoff, Over the past week, I have had several conversations and' meetings with Mr. Tarrant in regards to the B.D.P. traffic plan. He has developed a revised traffic plan which I support completely. With implementation of the new B.D.P. traffic plan, I will withdraw my opposition to this B.D.P. application in regards to traffic. I have attached copies of Mr. Tarrant's letters to me which were also copied to you. His letters outline the steps which B.D.P. will take to mitigate any traffic impact which it may have on Shelburne Road. It is my understanding that Dennis Blodgett (abutting property owner of B.D.P.) will deed a road easement to B.D.P.. The proposed Holmes Road extension lies on both Mr. Blodgett's and B.D.P.'s land. By Mr. Blodgett giving the easement to B.D.P., all lard necessary, on which to construct 250 feet of Holmes Road extension, will be under the control of B.D.P.. Therefore, a potential roadblock to the construction of Holmes Road extension (land owned by two different property owners) will have been removed. Furthermore, Mr. Blodgett has represented that he will commence construction of the Holmes Road extension this summer. When the road has been completed, it will be deeded over to the City of South Burlington. Mr. Tarrant has stated that B.D.P. will open an access to the Holmes Road extension upon completion of the first 250 feet of this road. Therefore, traffic entering and exiting the B.D.P. project will be able to do so at the signalized intersection of Holmes Road and Shelburne Road. In addition, Mr. Blodgett has agreed to pay the increased costs of a 4-way traffic signal over a 3-way traffic signal at Holmes Road and Shelburne Road. Mr. Tarrant has been very reasonable in working to satisfy all of my previous concerns.
