PROJECT DESCRIPTION  Sketch plan application #SD‐21‐05 of Donald and Lois Kerwin to amend a previously approved Planned  Unit Development of two lots.  The amendment is to subdivide Lot 2 (0.83 acres) into three lots of 0.28  acres each and develop a single family home on each, 1420 Hinesburg Road.    #SD‐21‐05  Staff Comments       2  2 of 6      COMMENTS  Development Review Planner Marla Keene and Director of Planning and Zoning Paul Conner (“Staff”)   have reviewed the plans submitted on 12/7/2020 and offer the following comments. Numbered items  for the Board’s attention are in red.    PERMIT HISTORY  The Board approved Final Plat application #SD‐19‐35 in January 2020 to create the existing PUD of two  residential lots.  The City Council had previously approved application IZ‐19‐01 authorizing the  development of up to three new single family home building lots.  None of the development approved  in #SD‐19‐35 has occurred, but the applicant has recorded the required mylar, thus the two‐lot  subdivision has been fully executed.  Staff considers nothing in approval #SD‐19‐35 precludes the  applicant from seeking the current subdivision.  However, conditions of #SD‐19‐35 fully apply to this  application.  Staff reminds the Board of the principals of the Stowe Club Highlands Test, which require  an applicant to demonstrate a change in one of three areas in order to request the Board revisit a prior  finding.  “Stowe Club Highlands” Review  In Stowe Club Highlands, upon review of an Act 250 proceeding, the Vermont Supreme Court  determined “under what circumstances ... permit conditions may be modified [or amended].”  The  Stowe Club Highlands decision generally affirmed the reliance on factors that had been identified by  the former Environmental Board:   (1) whether there had been “changes in factual or regulatory circumstances beyond the control of a  permittee”;   (2) whether there had been “changes in the construction or operation of the permittee's project,  not reasonably foreseeable at the time the permit was issued”; and   (3) whether there had been “changes in technology.”   These factors are intended to “assist in assessing the competing policies of flexibility and finality in  the permitting process.”  See also 24 V.S.A. § 4472(d).  If the Board finds a proposed modification is not justified by the Stowe Club Highlands factors above,  Staff considers the Board may not approve the proposed modification.    CONTEXT  The property is located in an area subject to Interim Zoning, but as noted above the applicant has  received approval IZ‐19‐01 for the creation of up to three new single family home lots from the parent  lot.  The new homes are proposed to be served by private or shared water supply wells, as City water is  not available.  The project proposes to connect both the existing home and the proposed homes into the  City wastewater system.  #SD‐20‐35 approved a similar water and wastewater configuration for the 2‐lot  subdivision.  LDR 9.13 requires all applications for subdivision in the SEQ to be considered as a PUD.  #SD‐21‐05  Staff Comments       3  3 of 6    ZONING DISTRICT & DIMENSIONAL REQUIREMENTS  Setbacks, Coverages & Lot Dimensions  Within the SEQ‐NR zoning district, the minimum lot size for a single family home is 12,000 sq. ft. with a base  density of 1.2 units per acre, and four (4) units per acre with the purchase of transferrable development  rights. With four (4) dwelling units proposed on two (2) acres, two (2) TDRs are required prior to  development of more than one new single family home.  Staff notes that in order to be considered a viable  subdivision, the applicant must provide a draft option agreement for two TDRs as part of the final plat  application, and an executed option agreement prior to recording the plat.    Maximum building coverage is 15% and maximum lot coverage is 30%.  Under the Applicant’s proposed  subdivision and subsequent build‐out of the subdivided lots, they are proposing maximum building  coverage for each of lots 2 through 4, and to meet or exceed maximum lot coverage for each of lots 2  through 4.  Lot 1, the portion of the property which is currently developed, will remain below maximum  building and lot coverage.  As a PUD located within one zoning district, the lot and building coverage is  considered on an overall basis and not lot by lot, therefore Staff considers the proposed subdivision as  meeting maximum coverage criteria.  Staff notes that the applicant will be required to demonstrate  continued compliance with building and overall coverage for the entire PUD at the time of zoning permit  application for each new home, as well as for any subsequent additions.    SEQ General Standards  SEQ general standards pertain to Height, Open Space and Resource protection, Agriculture, Public Services  and Facilities, and Circulation.    The maximum height in this zoning district is 28‐feet to the mid point of a pitched roof, with a maximum of  two stories facing the street.  There are no existing significant open spaces on this parcel.  Open spaces on adjoining parcels are  separated from this parcel by existing residential development.  As noted in the findings on SD‐19‐35,  there are two wooded areas on the existing site – one south of the existing home and one on the  eastern property boundary.  Though these areas do not constitute a mature forest, they are existing  natural resource areas providing visual buffering, wind screening, and habitat for small wildlife.  Criteria  related to open spaces require an open space management plan and encourage enhancement of wildlife  habitat values in identified open spaces.  The applicant’s proposal will necessitate removal of the eastern wooded area, as shown by the  proposed tree line on the provided plans.  The proposed development will be served by a private water system.  See discussion of water availability  under PUD criterion below.  The applicant is proposing to connect to the public wastewater system.    SEQ Regulating Plan  The SEQ regulating plans pertain to dimensional and design concepts intended to foster attractive and  walkable neighborhood development patterns.  They pertain to street and block patterns and parks.  Staff  considers for this four‐lot PUD the regulating plan criteria to be not applicable.  SEQ‐NR Specific Standards  SEQ‐NR specific standards pertain to street, block and lot pattern; street, sidewalk and parking standards;  #SD‐21‐05  Staff Comments       4  4 of 6  and residential design.  Staff considers street and block patterns standards and sidewalk and parking  standards not applicable to this two‐lot subdivision.    Lot ratios are required to maintain a width to depth ratio of 1:2.  Staff considers the proposed lots meet this  criterion better than the previously approved subdivision.  Residential design standards pertain to building orientation, front building setbacks, and location of garages  and parking.  The regulations require the following standards, which were reiterated in the conditions of  approval for the prior subdivision:   Buildings are required to be oriented to the street    Homes must have a consistent architectural style to one another.     Building facades should appear unified but varied    Garages must be set back a minimum of eight (8) feet from the front of the building    homes be set back a maximum of 25‐feet from the back of sidewalk.  Since there is no sidewalk on  Highland Ave, the Board approved the PUD with the requirement that homes must be set back no  more than 25‐feet from the front lot line.  Then note that as a 2‐lot subdivision, the standard for variation of styles was not applicable, but with the  addition of 2 lots for a total of four, demonstration of compliance with these criteria will be needed  here.   As shown, homes are set back more than 55‐feet from the front lot line and there is no indication that the  buildings can be oriented to the street in their proposed configuration.  It further appears the applicant has  not taken into consideration the required garage placement.  Staff therefore considers this proposal  specifically not in compliance with the approved PUD.    1. Staff recommends the Board consider whether to request the applicant to modify their sketch plan to  allow the impacts of changing building placement and garage location to be evaluated.  Staff considers  given the narrow lot width, the impacts of this change may be significant.  Further, Staff recommends  the Board discuss whether they will require the applicant to provide sample architectural elevations or  building design standards at the next stage of review in order to demonstrate compliance with the  requirement to provide homes of a consistent architectural style.     PUD & SUBDIVISION STANDARDS  PUD & Subdivision standards pertain to water and wastewater capacity, natural resource protection,  traffic, visual compatibility with the surrounding area, open space, fire protection, relationship to the  Comprehensive Plan, and public infrastructure.  The applicant is proposing to connect to municipal sewer in a similar manner to what was approved in SD‐ 19‐35.  They are also continuing to propose private water supply wells to serve the homes.    2. Staff recommends the Board require the applicant to demonstrate that sufficient water supply is  available to serve the proposed homes without adversely affecting the water supply of adjacent homes  at the next stage of review.  As a PUD criterion, Staff considers this must be demonstrated prior to  approval and not as a condition.   The City Stormwater Section reviewed the project on January 11, 2021 and offers the following comments.  1. The proposed project is located in the Muddy Brook watershed.   #SD‐21‐05  Staff Comments       5  5 of 6  2. The VT ANR Natural Resource Atlas wetland advisory layer shows possible Class II wetland  located along the eastern border of the lot. Has a delineation been performed for this site? This  proposal increases impacts from the original proposed so should be evaluated. I am aware that  this request was waived with the previous application, but due to the increase this should be  required at this venture.  3. Please request that the applicant include all pertinent EPSC Details on a plansheet. Sheet C3  should include a linetype for silt fence, location of snow stockpiling in winter construction,  proposed dewatering locations, etc.   4. Work in the City Right of Way (ROW) requires a permit before construction can begin. A “Permit  to Open Streets or Right‐Of‐Way” can be obtained from the South Burlington Department of Public  Works on their web site.  Staff notes that no information has been submitted indicating the applicant intends to comply with the  City stormwater regulations.  As noted by the City Stormwater Section, since the PUD if approved would  create more than ½ acre of impervious, demonstration of how the proposed development will provide  stormwater treatment and control is required prior to approval.   Staff calls the Board’s attention to the comment of the City Stormwater Section pertaining to wetland  delineation.  As noted, the Board did not require wetland delineation as part of SD‐19‐35, because the  proposed development was located in a way such that wetland impacts were unlikely to occur.   However, with the revised configuration, it is likely that impacts would occur if in fact wetlands are  present.    3. Staff therefore recommends the Board direct the applicant to comply with this and the other  comments of the Stormwater Section as part of their next application.    provide wetland delineation report, and if wetlands are present, provide classification of  functions and values, and responses to wetland protection criterion of Article 12.02   demonstrate compliance with erosion prevention and sediment control provisions of Article 16,  including a plan as requested  If Class II wetland or buffer impacts are proposed, the applicant should also demonstrate  minimization of impacts and acceptance of the proposed impacts by the State wetland division.     PUD criterion #5 requires projects to be visually compatible with planned development patterns in the  area, as specified in the Comprehensive Plan and the purpose of the zoning district.  Staff considers that  if the applicant demonstrates compliance with the SEQ design requirements, discussed above, this PUD  criterion pertaining to compatibility will be met.  The Director of Public Works reviewed the plans on 1/12/2021 and offers the following comments.  That swale on the west side of Highland is pretty shallow. The plan shows three driveways with a  culvert under each. It doesn’t list the culvert size (we require 18” minimum) nor can I get a sense  of cover.  I know this is only sketch but at some point we’ll need to see a detail of these d/w culverts  showing size, cover, etc.  Staff recommends the Board direct the applicant to either meet the City culvert requirements or provide  an alternative swale crossing, such as was approved on an adjacent property in #SD‐20‐04.  Staff notes at the time of this review, the Fire Chief has not yet reviewed the plans.  Staff anticipates any  comments will be compatible with the general concept presented in this application.  #SD‐21‐05  Staff Comments       6  6 of 6    RECOMMENDATION  Staff recommends that the Board discuss the Project with the applicant and close the meeting.     Respectfully submitted,    Marla Keene, Development Review Planner    SSS100' DOWN SLOPE ISOLATION100' DOWN SLOPE ISOLATIONVERMONT ROUTE 116 / HINESBURG ROADHIGHLAND TERRACEn/fJ.
