Re: Findings of Fact, revised application of Mery Brown for
construction of a 29,425 square foot building for office and
retail use, 1342 Shelburne Road.
On the 20th of December 1988, the South Burlington Planning
Commission approved the request of Mery Brown for site plan
approval under Section 19.10 of the South Burlington Zoning
Regulations based on the following findings:
1. TRAFFIC ACCESS: Access shall be from a single 30 foot wide
curb cut on a newly constructed 32 foot wide road (Holmes Road
Extension) off Route 7. The two existing curb cuts on Shelburne
Road shall be closed. The fourth face of the Shelburne
Road/Holmes Road Intersection traffic signal shall be in
operation prior to the issuance of a building permit. Road plans
and profiles shall be submitted for review. The portion of the
80 foot right-of-way (Holmes Road Extension) located on this
property shall be dedicated to the City prior to permit. Legal
,documentation (Offer of Dedication and Deed) shall be submitted
to the City Attorney for approval prior to permit. This site is
located in Zone 4 of the Traffic overlay District which allows a
maximum peak hour trip generation of 95.
2. CIRCULATION AND PARKING: A 24 foot wide circulation drive is
shown around the perimeter of the building. The proposed uses
require 152 spaces and 152 spaces are shown; 37 of which are for
compact cars and must be signed as such. Parking spaces shall be
used for vehicle parking only and shall not be used for sales of
items such as christmas trees, oil paintings, etc. The sidewalk
along the Holmes Road Extension .shall. extend across the driveway
and stop where the road stops. It shall be uniform grade across
the driveway with no dips or breaks. A concrete sidewalk shall
be constructed along Shelburne Road and a bond posted prior to
permit. Both sidewalks shall include a handicapped ramp.
3. LANDSCAPING & SCREENING: A revised landscaping plan with a
value of $19,500 shall be approved by the City Planner.
Applicant shall post a 3-year landscaping bond for that amount,
prior to permit. Based upon expressed representation by the
applicant, there shall be no trailers used for storage on the
site. There shall be screening provided for the trash compactor.

4. OTHER: A sewer allocation of 1650 gpd is granted and the
$2.50 per gallon fee shall be paid prior to permit. The sewer
manhole shall have a stub extending easterly. The pipe for the
storm drainage system shall be concrete or plastic, not metal or
aluminum. An additional hydrant shall be provided on the
property in a location to be approved by the Fire Chief. The
building permit shall be obtained within 6 months or this
