HomeMy WebLinkAboutSP-16-29 - Decision - 0041 Shelburne Road#SP-16-29 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING PLAZA INVESTMENTS — 41 IDX DRIVE SITE PLAN APPLICATION #SP-16-29 FINDINGS OF FACT AND DECISION Plaza Investments, hereinafter referred to as the applicant, is seeking after -the -fact approval to amend a previously approved plan for a 25,720 sq. ft. multi -use building. The amendment consists of the installation of an HVAC unit on the east side of the building, 41 IDX Drive. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking after -the -fact approval to amend a previously approved plan for a 25,720 sq. ft. multi -use building. The amendment consists of the installation of an HVAC unit on the east side of the building, 41 IDX Drive. 2. The owner of record of the subject property is Plaza Investments. 3. The subject property is located in the Commercial 1 — R-15 Zoning District. 4. The application was received on May 6, 2016. 5. The plan submitted is entitled "Shelburne Square South Burlington Vermont", prepared by O'Leary -Burke Civil Associates, PLC, dated 9/21/05, and last revised on 5/06/16. DIMENSIONAL REQUIREMENTS 6. The overall coverage will increase slightly but will still be at 69.9% (maximum allowed is 70%). The other coverages will not change. 7. Setback requirements will continue to be met. SITE PLAN REVIEW STANDARDS Only the standards below will are affected by this application. All other standards will continue to be met. Landscaping/Screening Section 13.06 - 1 — #SP-16-29 8. The new HVAC unit is screened by an eight (8) foot high fence. Section 14.07 (C) (c) All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure, and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s), 9. The existing dumpster enclosure will revised to complete the enclosure by adding a gate in the front for access. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-16-29 of Plaza Investments, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the HVAC unit. 5. Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer. Signed on this day of , 2016 by Raymond J.
