ZONING BOARD OF ADJUSTMENT SEPTEMBER 28, 1987
The South Burlington Zoning Board of
Monday, September 28, 1987 at 7 PM in
Dorset Street.
Members Present
Adjustment held a regular meeting on
the Conference Room, City Hall, 575
Fred Blais, Chairman, John Dinklage, David Boehm, James Condos, James Thibault.
Members Absent
Dan King, Donald Graf.
Others Present
Richard Ward, Zoning Administrator, Sidney Poger, The Other Paper, Jennifer F.
Silpe, Mandy Hotchkiss, Kemp H. Hanley, Gordon Woods, Diane Muhr, G. Handy, M.
Schwartz, Roy Feldman, David Spitz, E. David Crane.
No. 2 Tabled Appeal of Salamin Handy (Burlington Bagel Bakery) 26 Hinesburg

Their request is to continue their appeal to the next meeting due to the fact
that the appealant has not reviewed Jane Lafleur's comments presented to the
board tonight.
Mr. Dinklage moved that this appeal be tabled until the next meeting which will
be on October 19, 1987. This was seconded by Mr. Condos and all voted aye.
The appeal was tabled.
No. 1 Appeal of David Hershberg & Jennifer Silpe
Appeal of David Hershberg & Jennifer Silpe seeking approval from Section 19.65
Multiple uses. Request is for permission to operate a delicatessen (area
containing approximately 215 square feet) in conjunction with a beverage and
wine shop on a lot containing approximately one acre, located at 1341 Shelburne
Road.
Mr. Ward said the area is zoned C-2 District. Under section 12.107 both uses
are permitted. Section 19.65 Multiple uses - sub section 19.651 "two uses per
building". Existing use beverage/wine shop. Proposed use delicatessen -
containing 216 square feet. Lot contains one acre 148 feet frontage.
Ms. Silpe said this is my partner (Mandy Hotchkiss) and we own J.M. Nooni Deli
located at 142 North Winooski Ave. We also own a vending cart on Church St.
and we have a Toyota truck parked on University Place. We have a very large
business and it's very difficult to deliver on Shelburne Road. We would like
to operate a delicatessen there and we would have runners to do the majority
of the deliveries. We plan on keeping our bakery at our deli where we bake our
own bread.

Ms. Hotchkiss said we will have two employees and this will be a walk-in and
delivery business. The character of the area won't be affected - it will be
enhanced. Nothing will be changed except 215 square feet within the building.
As far as traffic - we anticipate that 75% of our business will be in the
delivering part of it. The parking lot is huge. It's more than 50% vacant.
We're going to be making sandwiches there - all salads, soups, etc. will be
made at our deli on North Winooski Ave. The only thing that will be made at
Shelburne Road are sandwiches.
Mr. Thibault asked how much traffic do you anticipate you will have. Ms. Silpe
said they just installed a traffic light on that corner access to K & K. Mr.
Dinklage asked how many trips going north to the university will you have and
Ms. Silpe said none.
Ms. Hotchkiss said we have been in business since January and our sales are
increasing. Ms. Silpe said our primary business on Shelburne Road will be the
businesses in that area. Mr. Dinklage asked what their hours of operation
would be. They replied 10:30 to somewhere between 7 and 7:30 at the latest.
Mr. Dinklage asked how is the space being used there now. Mr. Hanley of K & K
Beverage said as a complete beverage store.
Mr. Dinklage asked how many vehicles will be operating and Ms. Silpe said only
one.
The appeal was granted unanimously.
Mr. Condos moved that on Page 3, third paragraph, of the minutes of September
14, 1987 "Mr. Spitz said muffins, cole slaw, etc." be changed to Mr. Schwartz.
Also on Page 4 first line "originally built for retail use" be changed to
residential use. This was seconded by Mr. Dinklage and all voted aye.
Mr. Condos moved to accept the minutes as corrected and that we accept the
decision of findings of fact for the minutes of September 14, 1987.
This was seconded by Mr. Dinklage and all voted aye.
Mr. Ward announced that the next meeting will be the 19th of October and it
will be the only meeting of the month.
Mr. Thibault moved for adjournment. This was seconded by Mr. Dinklage and the
meeting adjourned at 7:40 PM.
