CONDITIONS!
(1) The deed for a parcel purchased under the provisions of this
permit must include the following "Waiver- of Development. Rights." All
subsequent deeds, leases or contracts of sale must also contain the waiver
unless a subdivision permit is obtained. Notice of the purchaser's name
and address must be filed with the Division of Protection.
"WAIVER OF DEVELOPMENTAL RIGHTS"
"In order to comply with the State of Vermont Lnvrronmerital
Protection Rules on the subdivision of lands and disposal of
waste including sewage, the grantee shall not construct or
erect a structure or htiilding on the parcel. of land conveyed
herein, the useful ocenpancy of which will require the in-
stallation of plumbing and sewage treatment facilities or
convey this land without first, complying with said State
regulations. The grantee by acceptance of this deed ac-
knowledges that this Iot, may not: qua.li.fy for approval for
developmenL under the appropriate envir•onmeutal protection
or health regulations and that. the State may deny an appli-
cation to develop the lot.."
(2) If the parcel being acquired is to be considered for building
development at some future date, the purchaser understands that the
information required by Section 3-08 of the rt.iles must be submitted for
evaluat.ion. If such information does not meet the Environmental Protection
Rules, permission to build on the lot will be denied.
(3) The conditions of this permit shall run with the land and will
be binding upon and enforceable against. the permitted. and all assigns and
successors in interest. The permittee shall. be responsible for recording
this permit and the "Notice of Permit Recording" iii the South Burlington
Land Records within 30 days of issuance of this permit and prior to
the conveyance of any lot subject to the jurisdiction of this permit.

This project, consisting of a two lot subdivision, identified as
Lot 1, being 2.90 acres in size with a building approved in
Public Building Permit PB-4-1501 and Lot 2 being 4.40 acres in
size subject to Deferral of Permit D-4-1246 located off U.S.
Route 7 and Holmes Road Extension in the City of South
Burlington, Vermont is hereby approved under the requirements of
the regulations named above, subject to the following conditions.
GENERAL
(1) This permit does not constitute Act 250 approval (Title
V.S.A., Chapter 151). The permittee is hereby reminded to
procure all relevant State and local permits prior to
proceeding with this project.
(2) The project shall be completed as shown on the plans Project
No. 88015 Sheet 1 of 1 "Composite Survey" dated September
1988 prepared by FitzPatrick-Llewellyn, Inc. and which have
been stamped "approved" by the Division of Protection. The
project shall not deviate from the approved plans without
prior written approval from the Division of Protection.
(3) Each prospective purchaser of each lot shall be shown a copy
of the approved plot plan and this Subdivision Permit prior
to conveyance of the lot.
(4) Lot #2 shall be subject to the terms and conditions of
Deferral of Permit #D-4-1246, including the "waiver of
developmental rights" contained therein.
(5) All conditions set forth in Public Building Permit #PB-4-
1501 dated September 16, 1988 shall remain in effect except
as modified or amended herein.
(6) The conditions of this permit shall run with the land and
will be binding upon and enforceable against the permittee
and all assigns and successors in interest. The permittee
shall be responsible for recording this permit and "Notice
of Permit Recording" in the South Burlington Land Records
within 30 days of issuance of this permit and prior to the
conveyance of any lot subject to the jurisdiction of this
permit.

MOTION OF APPROVAL
I move the South Burlington Planning Commission approve the Final
Plat application of llerinis.Blodgett for subdivision of a 7.3 acre
har.c_el. into two parcels of 2.9 acres and 4.4 acres as depicted on
a plan titled "Composite Survey for Blodgett Property
Development., South Burlington, Vermont," prepared by Fitzpatrick-
1,lewellyn, Inc., and dated 10/19/88 with the following
stipulations:
1. The plat shall be revised to show the northern boundary of
the proposed Holmes (toad Extension right of way continuing in a
straight to the southeast corner of lot 2 as shown in the
approved plan titled "Blodgett Property Development, Residential
Portion, South Burlington, Vermont," prepared by Fitzpatrick -
Llewellyn, Inc., dated 8/17/88.
/. The Final Plat shall be recorded within 90 days or this
approval is null and void. It must be approved by the Planner
and signed by the Chairman or Clerk of the Planning Commission

the limits of the paved area in the northern portion of the
property is not shown, it is unclear exactly what the front yard
coverage is. Based on a worst -ease estimate, it appears the
front yard coverage is approximately 37% (maximum 30% allowed).
Traffic; This 99,150 square foot -lot, is .located in zone 5 of the
Traffic Overlay District and, as a result., is allowed 112 trip
ends., The applicant estimates that the proposed use will
generate 6 trips during the peak hour. Based on I.T.E. trip
generation rates, the proposed use would generate 39 trips. This
estimate, however, is based on service stations with pumps. The
I.T.E. manual does not contain average trip rates for service
stations without pumps. Since the proposed use would not include
pumping gas, the likely trip generation should be less than 39
during the peak hour. Regardless, the proposed use should easily
meet the 112 maximum peak hour trips allowed for the property.

4) PUBLIC HEARING; TWO LOT SUBDIVISION, 1342 SHELBURNE ROAD
Dennis Blodgett proposes to subdivide a 7.3 acre parcel into two
parcels of 2.9 and 4.4 acres. The 2.9 acre parcel fronts
Shelburne Road and is Zoned C-1. The 4.4 acre parcel is located
behind the 2.9 acre parcel and will be accessed by the proposed
Holmes Road Extension. The 4.4 acre parcel is zoned R-4. The
plat shows a strip of land running through the southern portions
of both parcels which will be dedicated to the City for the
Holmes Road Extension.
On May 10, 1988, the Planning Commission approved Dennis
Blodgett's site plan application for construction of a 29,424
square foot building for office and retail uses. This building
is located on the 2.9 acre parcel. On 8/17/88, the Planning
Commission approved final plat application for an 18 unit planned
residential development which is located on the 4.4 acre parcel.
Coverage: The approved commercial use on the proposed 2.9 acre
parcel meets building, front yard and total lot coverage
requirements. The approved planned residential development on
the proposed 4.4 acre parcel meets building and total lot
coverage requirements. Also, the allowable density is met (18
un i. is a 1. lowed, 18 units approved) .
Tr•a1•fic: The two lots are located in zone 4 of the traffic
overlay district. The 2.9 acre lot is allowed 95 trips during

the peal: hour. The approved office/retail use was found to
generate 95 trip ends during' the peak hour. Therefore, the
approved use on this lot meets the allowed trip �fenerat.ion.
The 4.4 acre lot is allowed 144 trips. The approved 18 unit
planned residential development was estimated to gener•at.e 13
trips during the peak period and therefore meets the requirements
of the traffic overlay district.

5) _DISCUSSION WITH DENNIS BLODGETT REGARDING A REVISION TO THE
APPROVED 18 UNIT P.U.D., 1342 SHELBURNE ROAD
Dennis Blodgett would like to discuss the possibility of
constructing office buildings on the 4.4 acre parcel instead of
the 18 unit planned residential development of which he has
obtained approval. He is willing to construct at a lower density
than the maximum allowed. Also, he would provide a larder
undisturbed buffer between the development and the residential
properties to the north and east than that which was approved for
the residential development.
He is also entertaining thoughts of a mixed office/residential'
development on the property.
The development of office uses on this property would require a
zone change.
The purpose of this meeting is to get feedback from the Planning
Commission. This will give Mr. Blodgett an idea of whether or
not, he should pursue the project.
6) DISCUSSION WITH ROD WHITTIER OF NOR-THSHORE DEVELOPMENT
Mr. Whittier would like to discuss with the Planning Commission
the possibility of developing an affordable housing project on a
12.3 acre parcel near the Lime Kiln bridge. The primary purpose
of the meeti.ng is to discuss the affordable housing concept and
explain how the project would work in order to provide
residential units which are "affordable." -1, do not believe that
any plans will be presented.
The parcel in qtiestion is zoned Industrial -Commercial and would
require a zone change in order to allow residential. development.

3) MUDDY- BROOK INDUSTRIAL, PALMER CIRCLE LOT #5
This lot has on site sewage disposal system. The leaching field
is on lot 3. This information should be noted on the plan for
future -reference. The new owner should also be aware of this.
4) BLODGETT PROPERTY SUBDIVISION, HOLMES ROAD EXTENSION
1. The road (Holmes Road Extension) serving lot 2 should be
substantially complete before lot 2 is developed or at the very
least occupied by residents.
2. Holmes Road Extension north line beyond Green Mountain Drive
does not end with an offset of 8.71 feet but continues on to the
south east corner of the property corner. Refer to plans titled
Blodgett Property Development commercial portion dated April
1988, prepared by Fitzpatrick -Llewellyn.
