DECISION AND FINDING OF FACT
On the 26th day of August, 1996 the South Burlington Zoning Board
of Adjustment heard testimony regarding a variance application of
Alexander Lewis d.b.a., Lewis Motors, 1301-1325 Shelburne Road,
this meeting was also attended by Attorney Carl Lisman and David
Lewis.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for this
application, the Zoning Board finds, concludes, and decides as
follows:
Findings of Fact
1) The area in question is zoned Commercial I District. The
existing use automobile sales and service is a non -conforming
use.
2) Section 26.00 of the Zoning by-laws prohibits extensions of
non -conforming uses.
3) The property in question is developed with two principal
structures housing automobile franchises (Volkswagen and
Acura).
4) In an opinion letter issued by Attorney Joseph McClean, (filed
within the "document file") the extension of an automotive
repair facility would result in a variance request.
5) The property contains 4.9 acres and is located at the
intersection of Shelburne and Holmes Roads.
6) All required setbacks are conforming, lot coverage 12.4%
buildings and 57.6% pavement.
Conclusion
1) Lewis Motors has added another franchise in order to expand
their business. In order to service their customers it is
necessary to provide additional service space.
2) The property was developed as a automotive dealership in 1959.

3) The character of the neighborhood would not change, the
majority of uses are automotive related.
4) The hardship imposed on the applicant is created by two
factors, a requirement of the franchise and a change within
the zoning by-laws.
5) The use of the property has included automobile repair since
1959 and this use will continue, request is only establishing
a new facility.
6) This proposal represents the least deviation from the by-laws.
Based upon the findings and conclusion set -forth above, the Zoning
Board of Adjustment hereby grants the applicant a variance to
construct an automotive repair facility containing 8,190 square
feet located at 1301-1325,-Nielburne Road.
