Re: Findings of Fact, application of Jeff Davis, Box 226, Williston,
Vermont 05495.
On the 12th of June, 1984, the South Burlington Planning Commission
denied the request of Jeff Davis, 1270 Shelburne Road for site plan
approval under the South Burlington Zoning Regulations based on
the following findings:
1. Failure to conform with Section 11.30 which limits the maximum
size of a use in a Commercial 1 District according to the
traffic standards of Section 17.00.
2. Failure to conform with Section 17.30 and .301 which specify
the definitions and standards in determining the permitted size
of a use in a traffic overlay zone, as follows:
a) The applicant's proposed use as a retail clothing store at
1270 Shelburne Road is in Traffic Overlay Zone 3;
b) the maximum permitted peak hour traffic volume is 25 trips;
c) the average peak hour trips is 5.21 trips per 1000 square
feet of gross floor area using Institute of Transportation
Engineers estimates;
d) the total lot size is 38,225 square feet; the minimum lot size
is 40,000 square feet;
e) the total permitted size is therefore 4587 square feet
(gross floor area);
f) therefore, the applicant's proposed 6500 square foot (gross
floor area) exceeds this permitted size.
