B15486P1 April 10, 1998 Mr. Richard Ward, Zoning Administrator City of South Burlington 575 Dorset Street South Burlington, Vermont 05403 RE: Brian Waxler - 1242 Shelburne Road Commercial / Retail Building Dear Mr. Ward: On behalf of our client, Brian Waxler, we are submitting an application to the Board of Adjustment for the above proposed commercial retail building. Concurrently, we have submitted a Site Plan Application for this project. The site property is divided by a Zoning District Boundary with the front portion of the lot within the Commercial (C I) Zoning District and the rear portion within the Residential (R4) Zoning District. This application is for a conditional use approval based upon Section 29.007 of the South Burlington Zoning Regulations for a 50 feet extension of the Commercial (C 1) regulations. The project site presently has an existing single family home and an unoccupied restaurant building located on it. These will be demolished for the construction of the new 12,000 SF building and associated parking. The proposed construction will be located toward the front of the property with continued access onto Route 7. The rear portion of the lot will remain in its existing wooded state. The extension of the Commercial (C 1) regulations by 50 feet in the easterly direction is intended to satisfy setback and landscape screening requirements as outlined in Section 25.108 - Buffer Strip of the City of South Burlington Zoning Regulations. With the extension, the proposed building setback from a Residential District will meet the 65 feet requirement. In addition, a 15+ feet landscaped buffer will be provided for a screen to the Residential District. The above extension of District regulations on a lot which is divided by a district boundary is allowed as a conditional use according to Section 29.007, of the City of South Burlington Zoning Regulations. That section states: "Where a district boundary line divides a lot which was in single ownership at the time ofpassage of these regulations, the Board ofAdjustment maypermit, as a conditional use, the extension of the regulations for eitherportion of the lot not to exceed fifty (50) feet beyond the district line into the remaining portion of the lot. This provision shall not apply to the boundary lines of the Floodplain Overlay or Conservation and Open Space Districts. This review shall specifically include consideration of the stated purpose of the district in which the proposed use is to be located. 26.052 The Board shall determine that the proposed use will not adversely affect: (a) The capacity of existing or planned municipal or educational facilities. The proposed use is a Permitted Use for the Commercial (C1) Zoning District and will meet the requirements of that Zoning District. The 50 feet extension of the Zoning District Boundary will not alter the projects impact on existing or planned municipal or educational facilities. (b) The essential character of the neighborhood or district in which the property is located, nor the ability to develop adjacent propertyfor appropriate uses. The existing site presently has a single-family house and an unoccupied restaurant building with adjacent lots being a mix of residential and commercial properties. The proposed building will be located within the Commercial (C 1) Zoning District area of the property. This building will be compatible with the commercial properties along Route 7 and adjacent to the front of the lot including the existing Sleep Quarters building. A landscape buffer will be provided between the back parking and the residential lots as outlined by Section 25.108 - Buffer Strip. This landscaping will be provided with a mix of evergreen trees and bushes along the back edge of the pavement. In addition, the rear portion of the lot (=452 feet deep) will remain in its existing wooded state. This will add to the natural separation of the commercial and residential uses. (c) Traffic on roads and highways in the vicinity. The proposed project falls within a Traffic Overlay District and will meet the requirements of that Overlay District. In addition, the site presently utilizes an access onto Route 7 for the single-family home and restaurant building. The extension of the Zoning District Boundary will not impact the projects affect for traffic on roads and highways in the vicinity. (d) Bylaws in effect. The proposed project is a permitted use in the Commercial (Cl) Zoning District. With the exception of the buffer strips to a Residential District as outlined in Section 25.108, which is the purpose of this conditional use application, this proposed project meets all other City of South Burlington Bylaws in affect. The proposed building will meet the requirements for use of renewable energy sources set by the Commercial (C1) District regulations. This will be accomplished via natural gas heating and efficient building insulation. The extension of the Zoning District Boundary will not alter the projects impact on utilization of renewable resources. (fl General public health and welfare. The proposed use will have no negative effects on the general public health and welfare. 26.053 The Board may require submission of plans, data, or other information as it deems necessary. 26.054 The Board shall act to approve or disapprove a requested conditional use within 60 days after the final public hearing held under this section, and failure to so act shall be deemed approval. 26.0551n approving a conditional use, the Board may attach additional requirements as it may deem necessary to implement the provisions of the Vermont Planning and Development Act and these regulations. 26.056 Any alteration, extension or other change to an existing conditional use shall require review under the requirements of this section.
