HomeMy WebLinkAboutCU-98-0000 - Decision - 1242 Shelburne RoadSOUTH BURLINGTON ZONING BOARD OF ADJUSTMENT STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Brian Waxler Request for conditional use 1242 Shelburne Road Findings of Fact, Conclusions of Law & Order This matter came before the South Burlington Zoning Board of Adjustment on May 11, 1998 by application of Brian Waxler, the applicant for a conditional use approval, request to extend the boundary district line easterly to a depth of fifty (50) feet, located at 1242 Shelburne Road. The Board of Adjustment finds as follows: 1) The property in question has a depth of 803 feet from Shelburne Road. Three hundred (300) feet is zoned commercial and the balance is zoned residential. 2) Section 29.007 allows for an extension of fifty (50) feet into the residential district as a conditional use review by the Board of Adjustment. 3) The applicant is proposing to demolish two residential structure and construct a new 12,000 square feet retail structure. 4) The proposed retail structure will generate a maximum of 48 vehicle trip ends. Extension of the district boundary line would increase the allowable trip ends to 63. 5) A buffer area greater than 500 feet is proposed to the nearest residential unit. 6) Impacts on municipal facilities will be less than current uses. 7) The proposed use is in keeping with the general retail character of the area. Stipulation That final approval be conditioned on a boundary survey to be prepared by a licensed surveyor, that demonstrates this layout and design can be located without requesting further variances. The conditional use to extend a boundary district line easterly by fifty (50) feet at 1242 Shelburne Road is hereby granted.
