HomeMy WebLinkAboutSP-98-0002 - Decision - 1242 Shelburne RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Brian & Alice Waxler to amend a previously approved plan to construct a 12,000 square foot building for retail use. The amendment consists of. 1) reducing the amount of retail floor area, 2) landscaping modifications, and 3) parking layout modifications, 1242 Shelburne Road. On the '4--?,1 day of September, 1998 the Director of Planning & Zoning approved the request of Brian & Alice Waxler for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of amending a previously approved plan to construct a 12,000 square foot building for retail use. The amendment consists of. 1) reducing the amount of retail floor area, 2) landscaping modifications, and 3) parking layout modifications. The only issues affected by this application are coverage, parking and landscaping. 2. Coverage: Building coverage is 21 % of the CI zoned portion of the lot (maximum allowed is 30%). Overall coverage is 66.8% of the C1 zoned portion of the lot (maximum allowed is 70%). Front yard coverage is 18.8% (maximum allowed is 30%). 3. Parkina: A total of 20 parking spaces are required and 55 spaces including two (2) handicapped spaces and a bike rack are proposed. The plan should be revised to provide one (1) additional handicapped space. 4. Landscaping: The minimum landscaping requirement, based on building costs, is $10,500 which is being met. Proposed plantings include Birch, Honeylocust, Mountain Ash, Arborvitae, Crabapple, Viburnum and Rose. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Director of Planning & Zoning approves the site plan application of Brian Waxler to amend a previously approved plan to construct a 12,000 square foot building for retail use. The amendment consists of. 1) reducing the amount of retail floor area, 2) landscaping modifications, and 3) parking modifications, 1242 Shelburne Road, as depicted on a three (3) page set of plans, page 3 of 7 entitled, "Brian Waxler 1242 Shelburne Road Proposed Site Plan," prepared by Dubois & King, Inc., dated January, 1998, last revised on 9/2/98, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in 1 effect. 2. The plan shall be revised to show the changes below and shall require approval of the Director of Planning & Zoning. Three (3) copies of the approved revised plan shall be submitted to the Director of Planning & Zoning prior to permit issuance. a) The site plan (sheets 3, 4 and 5 of 7) shall be revised to provide one (1) additional handicapped space. 3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to use of the building. 5.
