FINDINGS OF FACT AND DECISION
John Eustis, hereafter referred to as the applicant, is seeking approval to amend a
previously approved plan for a 3865 sq. ft. retail building. The amendment consists of
converting the building to commercial kennel, veterinary hospital and pet day care use,
1333 Shelburne Road. The Development Review Board held a public hearing on
Tuesday, May 1, 2007. The applicant was present at the meeting.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking approval to amend a previously approved plan for a
3865 sq. ft. retail building. The amendment consists of converting the building to
commercial kennel, veterinary hospital and pet day care use, 1333 Shelburne
Road.
2. The owner of record of the subject property is the Edward B. Crane Living Trust.
3. The subject property is located in the Commercial 2 (C2) Zoning District.
4. The plan submitted is entitled, "Proposed Site Plan 1335 & 1331 Shelburne
Road", prepared by Timothy A. Duff Architect, PLC, dated 4/16/07, last revised
on 4/19/07.

The front yard setback from Shelburne Road is fifty (50) feet. It is being shown as thirty (30)
feet on the plan. The plan shall be revised accordingly.
The coverages included on the table are incorrect as they are based on the incorrect front
yard setback. The applicant is aware of this and shall have revised plans at the hearing.
The front yard coverage percentage included in this report is correct.
There are no changes to the existing building as part of this application. The applicant is
proposing to re -stripe the parking area and replace 386 feet of paved area along Holmes
Road with green space.
Parking
The site currently provides 25 parking spaces, several of which are located at least
partially on the property at 1335 Shelburne Road. The property at 1335 Shelburne Road
has requested approval in a related application to share these parking spaces. The
proposed use of Veterinary Hospital is required to have one parking space per employee
plus 0.5 pr 1,000 SF GFA. Therefore, the site is required to have 6 parking spaces.
Traffic
The most closely related use in the ITE manual for the existing and proposed uses are
specialty retail. Therefore, there shall be no estimated increases or decreases in traffic
generation.
Other
The dumpster for the property at 1333 Shelburne Road is partially on the property at
1335 Shelburne Road and is screened.

to approve Site flan Application # P-07 -23 of John Eustis, subject to the following
conditions:
1) All previous approvals and stipulations, which are not superseded by this approval,
shall remain in full effect.
2) This project shall be completed as shown on the plans submitted by the applicant
and on file in the South Burlington Department of Planning and Zoning.
3) The plans shall be revised to show the changes below and shall require approval of
the Administrative Officer. Three (3) copies of the approved revised plans shall be
submitted to the Administrative Officer prior to permit issuance.
a) The plan shall be revised to show a fifty foot (50') front yard setback along
Shelburne Road.

b) The plan shall be revised to include the accurate front yard coverage along
Shelburne Road.
c) The plan shall be revised to correctly show the address for 1335 Shelburne Road.
4) The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
5) The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer prior to the use of the building.
6) Any change to the site plan shall require approval of the Development Review Board
or the Administrative Officer.
