HomeMy WebLinkAboutSP-97-0000 - Decision - 1330 Shelburne RoadFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Uno Restaurant Corporation to construct a 99 square foot addition to a 5530 square foot standard restaurant with 155 seats, 1330 Shelburne Road. On the llth day of February, 1997, the South Burlington Planning Commission approved the request of Uno Restaurant Corporation for site plan review under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of constructing a 99 square foot addition to a 5530 square foot standard restaurant with 155 seats approved on 3/19/96. 2. This property located at 1330 Shelburne Road lies within the Cl and R4 Districts. It is bounded on the east by a single family dwelling, on the south by a retail/office building, on the north by Imperial Drive and on the west by Shelburne Road. The only issues involved were as follows: 3. Coverage/setbacks: Building coverage is 6.3% (maximum allowed is 70%). Overall coverage is 51.8% (maximum allowed is 70%). Front yard coverages are not affected. Setback requirements will be met. 4. Landscaping: The minimum landscaping requirement, based on building costs, is $371 which is being met. No additional landscaping needed since the original landscaping plan exceeded the minimum requirement by more than this additional $371. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the request of Uno Restaurant Corporation to construct a 99 square foot addition to a 5530 square foot standard restaurant with 155 seats, 1330 Shelburne Road, as depicted on a plan entitled "Revised Site Plan - C Pizzeria Uno 1330 Shelburne Road South Burlington, Vermont," prepared by Pinkham Engineering Associates, Inc., dated 12/11/95, last revised 1/8/97, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 1 2. For purposes of calculating required road impact fees under the South Burlington Impact Fee Ordinance, the Planning Commission estimates that the addition will generate zero (0) additional vehicle trip ends during the P.M. peak hour. 3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 4. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to occupancy of the new addition. 5.
