Mr. Wcclery moved that the South Burlington Planning Commission approve the
final plat_application of Victory Real Estate, Ltd. for a three lot subdivision
on Williston Roam as depicted on a -)lan entitled "For Emery Victory", prepared
by John Marsh, last revised October 17, 1980, subject to the following stipulations:
1. Lot 1 is not approved as a separate building lot; it is additional
acreage for either the adjoining NCR property or for lot 3.
2. The final plat shall be recorded within 90 days.
3. The right of way across lot 2 shall be defined on the final plat.
4. The right of way across lot 2 shall be used for the existing home only
and not used for any other purpose.
5. The remaining lot 3 shall have no access from Williston Road.
Mr. Jacob seconded the motion and all voted aye.
ApNlication by Harry and Alan Gigure for final plat approval of a two lot subdivision
on Airport Parkway and Kirby Road
Mr. Spitz said the lot was smaller than at the last meeting, as a result of
the survey work, and could no longer contain a duplex. Because of the change in
size, the Zoning Board appeal has been rewarned but Mr. Spitz felt the Commission
could give approval, if it so wished, subject to Zoning Board aproval. The new
lot is 10,960 sq. ft. and will need a front yard variance.
It was noted that normally the Commission likes to have Zoning Board approval
first, but that this application had been before the Commission already and had
been delayed. It was also noted that if the Zoning Board made any changes, the
application would have to return to the Commission anyway.
Nothing will happen with the tiny piece of land across the street from the
Tarn lot.
Yr. Woolery moved that the South Burlington_ Planning Commission apyrove the
final plat application of Harry and Alan Gigure for a two lot subdivision on
Kirby Road and Airport Parkway, as depicted on a plan entitled "2 lot Subdivision
for Harry R. Gigure,' prepared by Palmer Company, Ltd., last revised November
9� 1980, subject to the following stipulations:
1. The location of the proposed 'house on lot 2 is not a part of the Planning
Commission approval and should not appear on the record copy of the plat.
2. This approval shall be void if the 'Zoning Board does not grant the
presently warned variances that would allow the location of. the proposed house
on lot 2.
3. The final plat shall be recorded within 90 days.
Mr. Levesque seconded the motion and it carried without dissent.
Ap;nlication by David Crane for site plan ao:roval of a new 6,500 sq. ft. office
building for Burroughs Corporation at 1335 Shelburne Road
Mr. James Lamphere said there were originally 3 buildings on the lot - Burroughs,
Brothers Two, and a carwash. Part of the land is under a 15 year lease and a 30
year commitment. The lot is zoned C2 and there are now 3 curb cuts on it. Two

will be closed and one will be reduced. The existing cut on Holmes Avenue will
be moved down to provide access to two parcels in the rear.
Mr. Poger suggested using the Brothers Two access to serve that building plus
this or using one access point on the property line between the two lots. :sir.
Lamphere noted that the Cranes, owned all the land but that Brothers Two controlled
their "lot". If they do not like the access arrangement, they may want to change
the lease. Mr. Poger noted that the Commission was concerned about turning
movements on Shelburne Road and that fewer and/or smaller cuts were better. Mr.
Crane felt they could live with widening the Brothers Two cut to serve both
buildings. There will thus be 1 cut on Shelburne Road for the entire lot.
.1r. Lamphere said parking for the new building would be added and they will
tie into existing services. Storm drainage will e.°o to Holmes Avenue. Mr. Spitz
said the fire chief would like another hydrant on this side of the road. There is
a hydrant across the road and one on Holmes Avenue. The sewer pipe under the
expansion will be cast iron when the expansion is made in the future, Mr. Lamphere
said. It was requested that the future expansion lines be removed from the plan,
since that is not being provided for now.
Because of the change in curb cuts, there will be additional grassed area on
the site, and some small plantings were suggested in front. Mr. Crane said that
everything they tore up and did not build over would be grassed.
The Commission did not feel the additional hydrant on this side of the road
should be required, noting that it would be very expensive and that if there
were a large fire in that area, traffic would have to be stopped anyway.
Mr. Mona asked if the owners understood the limits of the uses allowed in
that zone when they leased the old Burroughs building and was told they did.
Mr. ;doolery moved that the South Burlington Planning Commission approve the
site plan application of David Crane for an office building at 1335 Shelburne Road
as depicted on a plan entitled "Layout of Crane Property," prepared by Wiemann-
Lamphere, Architects, dated October 7, 1980, subject to the following stipulations:
1. A 5 foot wide concrete sidewalk shall be constructed along the entire
Shelburne Road frontage of the property.
2. The "potential future expansion" designation shall be removed from the
plan of record.
3. A landscaping bond of $7200 shall be provided. Size of new plantings
on the landscaping plan shall be enlarged to reflect that amoun .
4. This property shall be served solely by the westerly access on Holmes
Avenue and by one access on Shelburne Road between the Brothers Two building and
the new Burroughs building, subject to review by the City Planner. All other
curb cuts shall be closed. and modified circulation patterns shall be indicated
on the plat.
5. A revised site plan, containing modifications from stipulations 1, 2, 4,
and 5,__shall be submitted.
6. This ap)roval expires in 6 months.
Mr. Jacob seconded the motion and all voted aye.
Application by Richard and Susan Barnier for site plan approval of a 1,680 sq. ft.
building to be used as a terminal for rubbish removal trucks, located on lot 15
in Berard Industrial Park

FINDINGS OF FACT
AND/OR STIPULATIONS
For the Site Plan Application of David Crane for an office building
at 1335 Shelburne Road as depicted on a plan entitled "Layout of Crane
Property," prepared by Wiemann-Lamphere, Architects, dated October 7, 1980.
Stipulations:
1. A 5-foot wide concrete sidewalk shall be constructed along the entire
Shelburne Road frontage of the property.
2. )The sewer line shall be cast iron for the portion located under the
areA marked "potential future expansion."
The "potential future expansion " is not being approved at this time
and shall require future site plan review by the Planning Commission.
A landscaping bond of $7200 shall be provided. Size of new plant-
ings on the landscaping plan shall be enlarged to reflect that amount.
This property shall be served solely by the westerly access on Holmes
i' Road and by one access, either the southerly or middle existing access,
on Shelburne Road. All other curbcuts shall be closed, and modified
circulation patterns shall be indicated on the plat.
A revised site plan, containing modifications from stipulations 1,,
and fit, shall be submitted.
7. This approval expires in 6 months.

Shelburne Road combined with existing business.
5) Barnier
1. Bond for completion of access road mast be finished.
2. Sewage disposal system to be designed by a professional engineer and
submitted to City for approval.
3. Addition contours must be provided to show site grading and drainage.
6) Nowland Property, Spear Street
1. Spear Street traffic volume will continue to increase; access to this
street should be limited as much as possible. Consideration should be given
to relocating southerly road connection to Pheasant hay.
2. Horseshoe radii must be such to allow a snow place and fire engine to
turn (25' radius is not sufficient). Pavement width should be of sufficient
width to allow for a parked vehicle and a truck to pass (24').
3. Solid cul-de-sacs are not acceptable because they are difficult to plow.

Proposed new lot has been reduced from 18,000 to 10,000 square foot follow-
ing survey work. Application must still go to Zoning Board for consideration
of a zoning variance (first hearing had to be rewarned due to the changed lot
dimensions) ; but Planning CoTTmission n-.ay choose to act on the subdivision subject
to Zoning Board approval.
4) Crane (Burroughs)
Proposed office building has received approval from the Zoning &card to
allow more than one building on. a lot; and the total floor area is within
the limits for a medium traffic generator.
Both Burroughs and Brothers 2 properties are caned by the sane landa,ner,
thereby offering combined access possibilities. One curb cut or. Shelburne
Road and one on Holmes Avenue should be sufficient.
Fire chief's reeo,-r>tnendations are still being reviewed.
5) Barnier, Berard Drive
Proposed building is on recently graveled, as yet unpaved, portion of
Berard Drive. Building cannot be started until street bonding arrangenkents are

Building will provide inside storage for rubbish trucks. A fenced
area for outside storage is shown on the plan.

Re: Case Number PB-4-0560; proposed construction
of a new office building.
Dear Mr. Crane:
In reviewing our records, we find that we have not approved the
above referenced project as being in compliance with the
Environmental Protection Rules governing said project.
An application was filed with the Essex Regional office on
11-20-88. On 11-24-80 we contacted Wiemann-Lamphere and
requested City approval letters for water and sewer. As of this
date, we have not received a response(s). We ask that you notify
us of the present status of the project within two weeks of the
date of this letter.
If we do not hear from you within this time frame, we will have
no alternative but to deny the project without prejudice. At
that time, if it is learned that construction is underway or
completed, we will be required to forward the case for possible
enforcement action.
