HomeMy WebLinkAboutCU-96-0000 - Decision - 1335 Shelburne RoadSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 12th day of August, 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a conditional use application of David Crane and Norman Bates, 1335 Shelburne Road, this meeting was also attended by Edward Lee. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) Area in question is zoned Commercial II District. 2) Existing uses (retail) are permitted, the proposed use (automotive repair) is conditional. Section 13.20 of zoning by-laws. 3) The existing structure (6500 square feet) is occupied with two (2) tenants, NYNEX mobile and former Car Tunes. 4) The applicant is proposing to occupy approximately 3000 square feet for windshield repair and installation. f'nnelucinn 1) Character of the area should not be affected, other automotive uses within the neighborhood. 2) Proposed business is primarily mobile, 80% of repairs are done off -site. 3) Very little traffic, installations are done by appointment. 4) Use will not adversely affect municipal or educational facilities. 5) Very similar in nature of the prior use. Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants the applicant a conditional use to operate a automotive repair business d.b.a.
