SITE PLAN REVIEW APPLICATION #SP-17-50
FINDINGS OF FACT AND DECISION
Site plan application #SP-17-50 of Lewis Real Estate to amend a previously approved plan consisting of
six (6) commercial buildings with a total of 27,323 sq. ft. and a 1,800 sq. ft. building for retail use. The
amendment consists of relocating a pedestrian connection approved under #SD-16-32, 1233 Shelburne
Road.
Based on the plans and materials contained in the document file for this application, the Administrative
Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant, Lewis Real Estate, seeks to amend a previously approved plan consisting of six (6)
commercial buildings with a total of 27,323 sq. ft. and a 1,800 sq. ft. building for retail use. The
amendment consists of relocating a pedestrian connection approved under #SD-16-32, 1233
Shelburne Road.
2. The owner of record of the subject property is Lakewood Commons Owners Association, Inc.
3. The application was received on July 11, 2017.
4. The property lies within the Commercial 1-Automobile Zoning District and the Traffic Overlay
District.
5. The plan set submitted consist of four (4) pages, with the first page titled "Condominium Plat
Lakewood Commons 1233 Shelburne Road South Burlington, Vermont", prepared by Trudell
Consulting Engineers, dated 7/8/16, and last revised on 5/17/17.
PLANNED UNIT DEVELOPMENT STANDARDS
(A)(3) The project incorporates access, circulation, and traffic management strategies sufficient to
prevent unreasonable congestion of adjacent roads.
The addition of the retail building generates five (5) new P.M. Peak Hour trip ends on the property due to the
additional proposed building and its retail use, exceeding the traffic budget for the site. As such, the applicant
is required to install a pedestrian connection between this parcel and an adjoining parcel. The Board originally
approved a connection between 1233 Shelburne Road and Fayette Road. This application seeks to change
the pedestrian connection to connect 1233 Shelburne Road and Holmes Road. The easement would be eight
(8) feet in width and contain a four (4) foot wide gravel path. The easement would cross two (2) properties
including 1301-1325 Shelburne Road and the lot for Fire Station #2. This change allows the applicant to meet
its traffic budget.

DECISION
Based on the above Findings of Fact, the Administrative Officer hereby approves -site plan application #SP-
17-50 of Lewis Real Estate, subject to the following conditions:
1. All previous approvals and stipulations will remain in full effect except as amended herein.
2. This project must be completed as shown on the plat submitted by the applicant and on file in the
South Burlington Department of Planning and Zoning.
3. Prior to permit issuance, the legal document for the easement crossing the adjacent property and
connecting to Holmes Road must be submitted to the City Attorney for approval and recorded in the
South Burlington Land Records.
4. The applicant must obtain a zoning permit within six (6) months to construct the building pursuant
to Section 17.04 of the Land Development Regulations or this approval is null and void.
5. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use or
occupancy of the building.
6. Any change to the site plan will require approval by the South Burlington Development Review Board
or Administrative Officer.
7. The applicant must submit to the Administrative Officer a final set of project plans as approved in digital
(PDF) format prior to the issuance of the first zoning permit.

Notice of Appeal with the secretary of the Development Review Board. This Notice of Appeal must be
accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
