HomeMy WebLinkAboutCU-96-0000 - Decision - 1233 Shelburne RoadSTATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 8th day of April, 1996 the South Burlington Zoning Board of Adjustment heard testimony regarding a conditional use approval of Dennis Blodgett & Lori Sullivan, 1233 Shelburne Road, this meeting was also attended by Mark Thibeault, Linda Kogut, Raeman & Myron Sopher and Jack and Edna Tenney. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findings of Fact 1) The area in question is zoned C-1 District. 2) Section 12.20 requires approval of a day care center under conditional use review (Section 26.05). 3 ) The proposed use ( adult day care) will occupy 2400 square feet of building E located at Lakewood Commons. 4) Building E is occupied with permitted uses (general office). 5) Other uses within the complex are retail, restaurant and health care center. 6 ) Lakewood Commons is a planned commercial development on a 4.5 acre parcel. Conclusion 1) The space under consideration could be occupied by 24 plus office employees. 2) Proposed use is excellent and needed within the City. 3) Applicant proposing to van -pool which will reduce traffic generated to this site. 4) Additional water & sewer usage is not adversely affecting municipal facilities. Capacity at Bartlett Bay plant is sufficient to handle additional usage. 5) Based on existing uses, health care, restaurant and retail proposed use should have no adverse impact. 6) Condominium by-laws are civil and do not impact any decision by the Zoning Board of Adjustment. Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants the applicants request to operate an adult day care center (maximum of 30 people) in conjunction with general office use, located„ at 1233 Shelburne Road.
