Dear Ms. Merrill -Griswold:
This is in reference to your property off Shelburne Road in South
Burlington, Vermont. During a recent site visit to an adjacent property, I
noted that the wetland being reviewed continued onto your property.
Therefore, development on your property may involve a discharge of
dredged or fill material in waters under Corps of Engineers' jurisdiction
and may require prior authorization from the Corps.
This letter is to inform you of Corps of Engineers' jurisdiction over
activities and to insure that you do not perform any work in waters
under Corps' jurisdiction without first obtaining the required permits.
A Corps of Engineers' permit is required under Section 404 of the
Clean Water Act (33 U.S.C. 1344) for those activities involving the
discharge of dredged and/or fill material, excavation, or mechanized
landclearing in all waters of the United States, including not only
navigable waters of the United States, but also inland rivers, lakes,
streams and wetlands. In interior waters, our jurisdiction under the
Clean Water Act extends landward to the ordinary high water mark of a
waterbody or the landward limit of any wetlands.

The term "wetland", used above, is defined by Federal regulations
to mean "... those areas that are inundated or saturated by surface or
groundwater at a frequency and duration sufficient to support, and that
under normal circumstances do support, a prevalence of vegetation
typically adapted for life in saturated soil conditions ..." (33 C.F.R. Part
328.3 (b), as published in the November 13, 1986 Federal Register).
Wetlands generally include swamps, marshes, bogs and similar areas.
However, please note that wetlands can also include forests and
meadows that lack standing water.
Before doing any work on the property, please insure that you have
clearly delineated, both in the field and on your drawings, the precise
limits of any waters of the United States under the Corps of Engineers'
jurisdiction which are located on the property. On your drawings you
should clearly indicate, with dimensions, the precise location of where
you intend to place any fill material (whether temporary or permanent),
excavate, or perform mechanized landclearing in any such wetlands or
waterway. You should then contact me at the above address to discuss
permit requirements.

That the South Burlington City Council approve the conditional use
application of t.h- Ethan Allen Motel, David Merrill, 1220 Shelburne
Road allowing for the construction of a gift shop containing 2,848
square feet on a lot containing 1.56 acres, according to the pro-
posal of record, based on the following findings:
1 - The proposed use is consistent with the health, safety and
welfare of the City of South Burlington and standards 2,3 and 4 of
Section 5 of the Interim Zoning Regulations.
2- The proposed use is consistent with standards 1 and 5 based on
the evidence submitted by Trudell Consultant Engineers regarding
traffic.
Stipulations
Approval is subject to site plan approval by the Planning Commission,
with consideration of a joint curb opening.

Dear Sirs;
This is the letter of intent as request4d at the June 43, 1979
City Council meeting in reference to the proposed use of the
property at 1220 Shelburne Rd., So. Burlington.
Our intent is to use it as a gift shop of which there are
three recognized definable types; tourist, decorative items and
tableware. The use will be to overlap all areas as stated above
with decorative items and accessories being the largest inventory
concentration. Some of these catagories will be as follows: art,
antiques, crafts, lighting, jewelry, metalware, pottery, plants,
basketware, leather goods, country clothing, toys, paper products,
Vt. food products, woodenware, tableware and linens, glassware,
country furniture and appropriate seasonal accessories. The theme
will be that ofa country style shop to provide quality Vermont
and related products. These products will be the same as similarly
found in competing shops of this type.

At your request, I have looked into the amount of traffic which might
be generated by your proposed retail business on Shelburne Road. The
"Transportation and Traffic Engineering Handbook", published by the Institution
of Transportation Engineers gives listings of traffic generation by land use.
A Highway - Orientated Commercial Business would generate 10 vehicle trip
ends per 1000 square feet of floor area.
A Neighborhood Retail Business such as a supermarket would generate 130 trip
ends per 1000 square feet of floor area.
The Institute of Transportation Engineers has also published a report on
trip generation.studies titled "Trip Generation".
For a Shopping Center of 0 to 50,000 square feet they report an average
trip rate of 115.8 vehicle trip ends per day per 1000 square feet of floor
area
These sources indicate that a figure of 120 trip ends per 1000 square feet
floor area would be reasonable for a Retail Business. A highway and
tourist oriented business such as yours would not be expected to generate
this much traffic. Based on your proposed building of 2500 square feet, you can
expect an average daily traffic of 200 and a design hour volume of 30.
It can also be assumed that your peak volume would not correspond to the peak
hours on Shelburne Road, 7 to 9 A.M. and 4 to 6 P.M.
