■ There was an existing crabapple tree that for some reason our engineer had us removing and then
replacing. We decided to just keep the fully mature tree instead. What do we need to get this approach
approved?
■ We need the dumpsters. What do we need to do to get these approved?
■ Because we declined to request approval for the community building, and then our bids came in over budget,
we decided to delete the sidewalk to the garage. What do we need to do to get this approved?

- Survey Notes -
1. Purposes of this survey and plat are to retrace the existing boundaries of two
parcels of land conveyed to W.M. and T.E. Wilson by deed of W.P. and J.B. Wilson
dated April 11, 1984 and recorded in Volume 203 Page 08 of the South Burlington
Land Records.
2. Survey was m perfored during April 2015 and consisted of a clmed400p traverse
conducted with an electronic total station instrument. Bearings shown are from Grid
North, Vermont Coordinate System of 1983. derived from GPS observations on or
adjacent to the site.
3. Iron pipes found are labeled with inside diameters; iron rods with outside diameters.
Concrete monuments fount were typically 4" square in cross-section. Proposed
markers shall consist of either 4" square concrete monuments or s/a' diameter rods
capped with aluminum disks stamped "Civil Engineering Assocs. - VT LS 597".
4. Much planimetnc detail on subject site is from Reference Plan A. Planimetric details
north and south of subject are from Reference Plans H and I.
5. Any ufities shown hereon do not purport to constitute or represent ALL ubliies

6. Shelburne Road (a/k/a US Route 7) is a public highway described in Burlington
Highway Volume 2, Page 749 as having a right-of-way width of 6 rods (99). Width
between accepted monumentation on east and west side of highway in the
immediate vicinity were observed to be LESS than 99'. The subject parcel is subject
to the public rightof♦vay.
To the best of my knowledge and belief this plat depicts the R I - I ` ,

1.2 This permit does not relieve the landowner from obtaining all other approvals and permits PRIOR to construction
including, but not limited to, those that may be required from the Act 25o District Environmental Commission,
the Drinking Water and Groundwater Protection Division, the Watershed Management Division, the Division of
Fire Safety, the Vermont Department of Health, the Family Services Division, other State departments, and local
officials.
1.3 The conditions of this permit shall run with the land and will be binding upon and enforceable against the
landowner and all assigns and successors in interest. The landowner shall record and index this permit in the
South Burlington Land Records within thirty (3o) days of issuance of this permit and prior to the conveyance of
any lot subject to the jurisdiction of this permit.
1.4 This project is approved for conversion of the existing motel into 20 residential units and office with 2 employees
on the existing 1.1 acre lot.
1.5 Construction of additional nonexempt buildings, including commercial and residential buildings, is not allowed
without prior review and approval by the Drinking Water and Groundwater Protection Division and such approval
will not be granted unless the proposal conforms to the applicable laws and regulations. No construction is
allowed that will cause non-compliance with an existing permit.
1.6 Each purchaser of any portion of the project shall be shown a copy of the Wastewater System and Potable Water
Supply Permit and the stamped plan(s), if applicable, prior to conveyance of any portion of the project to that
purchaser.
1.7 By acceptance of this permit, the landowner agrees to allow representatives of the State of Vermont access to the
property subject to this permit, at reasonable times, for the purpose of ascertaining compliance with Vermont
environmental/health statutes, regulations, and permit conditions, including performing an inspection of the
wastewater disposal and water supply systems serving the/each structure.

1.8 Any person aggrieved by this permit may appeal to the Environmental Court within 3o days of the date of
issuance of this permit in accordance with io V.S.A. Chapter 22o and the Vermont Rules of Environmental Court
Proceedings.
2.WATER SUPPLY
2.1 This project is approved for the existing connection to the water supply system owned by the City of South
Burlington (VT0005o91) as depicted on the plan(s) stamped by the Drinking Water and Groundwater Protection
Division. The project is approved for a maximum of 2862 gallons of water per day.
2.2 The landowner shall install and maintain backflow prevention devices that conform to Vermont Department of
Public Safety standards and NFPA 13 for the connection of any sprinkler fire suppression system to a public
drinking water system.
2.3 This project is approved with an existing building's water service piping. The Drinking Water and Groundwater
Protection Division assumes no liability for the adequacy of this water service. Should the water supply fail and
not qualify for the minor repair or replacement exemption, the landowner shall engage a Licensed Designer to
evaluate the cause of the failure and to submit a permit amendment application to this office, and receive approval
thereof, prior to correcting the failure.
2.4 This permit is based, in part, on a municipal approval for connection to their water distribution system. If the
municipal approval expires, this permit shall be invalid unless the municipality renews its approval. If the
municipality approval expires, a new permit must be issued for the project. An updated application form and an
application fee will be required for the project. A new municipal approval letter shall be required. The rules in
effect at the time of the filing of the application for a new permit will be applied to the project.

Dear Ray:
We have reviewed the plans for the proposed renovation of the Ho Hum Motel on Shelburne Road.
We have also met with the developers of this project. We have the following recommendations:
1. Compliance with all requirements of Vermont Fire and Building Safety Codes and standards as
enforced by the South Burlington Fire Marshal's Office. Construction plans shall be submitted to
the office of the Fire Marshal.
2. Provide an emergency key box(s), location to be specified by SBFD.
Trees, fences and floral outcroppings should be placed so as not to interfere with the
deployment of the aerial ladder, hoselines, portable ladders and other firefighting
equipment.
4. The parking area entrances and exits have been addressed at our request and appear to be of a
design that will be accessible to fire and emergency apparatus. The developer should reaffirm
that for turning radii, all corners should meet the "" 40 straight" standard.
At this point these seem to be the major issues which present themselves. As this project moves
forward additional items may surface which can be dealt with as needed with the assistance of the developer
and South Burlington Fire Marshal's office. Should you need any further assistance on this project please

like to offer the following comments:
The project is located in the North Brook watershed, which is part of the City's Stormwater
Management Overlay District. However, because the project proposes to reduce the overall impervious
area on the property from 26,650 s.f. to 24,960 s.f. it is not subject to the requirements of section
12.03.C.
The applicant is encouraged to find additional opportunities to reduce the amount of runoff leaving
the site and draining to Shelburne Road. Consider taking advantage of opportunities to direct roof
downspouts, sidewalk, and parking lot to grassed areas for disconnection and infiltration.

Zoning Requirements Compliance:
13.14 B. Definitions. (b) Housing that is rented by its inhabitants, whose gross annual household income
does not exceed sixty-five percent (65%) of the county median income, as defined by the United States
Department of Housing and Urban Development, and the total annual cost of the housing, including
rent, utilities, and condominium association fees, is not more than thirty percent (30%) of the
household's gross annual income
The 20 apartments created at 1200 Shelburne Road will be restricted to tenants earning less than 60%
of AMI through a Housing Subsidy Covenant with the Vermont Housing and Conservation Board. In fact
the tenants will all likely be earning less than 30% of AMI as we are partnering with Safe Harbor which
works with medically vulnerable homeless individuals.
13.14 C. Density Increase. On a case by case basis and as part of the Planned Unit Development
application, the Development Review Board may grant an increase in residential density over base
zoning density, in order to create below market rate housing. The density increases shall be approved
on the following criteria and standards: ARTICLE 13 SUPPLEMENTAL REGULATIONS South Burlington
Land Development Regulations Effective September 24, 2013 13-28 (1) Affordable Housing
Development. The Development Review Board may grant a density increase of no more than fifty
percent (50%) in the total number of allowed dwelling units for an Affordable Housing Development.
The total of below market rate units shall be at least half of the total proposed dwelling units. Where
the total proposed dwelling units is an uneven number, the total of below market rate units shall be
calculated as at least the total proposed dwelling units, less one (1), divided by two. Such application
shall be subject to Article 15, Planned Unit Development and Article 14, Site Plan and Conditional Use
Review.
The density allowed by the zoning ordinance for this site is 15 units and the project proposes 20 so we
are seeking a 33% density bonus due to the 100% of the units meeting the affordability definition.
13.14 D (4) Administration. The City of South Burlington Housing Authority, if any, or a bona fide
qualified non-profit organization shall be responsible for the on -going administration of the affordable
housing units as well as for the promulgation of such rules and regulations as may be necessary to
implement this program. The Housing Authority or non-profit organization will determine and
implement eligibility priorities, continuing eligibility standards and enforcement, and rental and sales
procedures.
The Champlain Housing Trust is a bona fide qualified non-profit organization. In addition, we will be
entering a Housing Subsidy Covenant with the Vermont Housing and Conservation Board, a state -
funded affordable housing organization that will restrict affordability.

Louisos said she reached out to City Council Chair
Pat Nowak regarding when the council would like to
view the document. Nowak said initiallythe commis-
sion could send it to council in completed sections,
but Louisos said the council would lose sight of
the bigger picture. They agreed that council would
receive and review the full document, and Louisos
suggested holding a joint council/commission
meeting as a public unveiling. Conner said having
a handful of input meetings at different times and
locations prior to the official public hearing(s) is
an option as well. Nowak said the timing is ideal
since it's occurring around the same time as the
city's branding project.
Draft Land Development Regulations
SEQ-Neighborhood Residential North / JAM Golf
amendments: Conner provided a brief history of
the settlement; it would be designated as Neigh-
borhood Residential North, allow 4.67 acres/parcel
with different public works standards, and have a
landscape buffer between Wheeler. Park and the
neighborhood. Louisos observed the landscape
buffer was outside the property. In the draft, there's
a provision that would make this permissible when
the request is granted through the city council, Con-
ner said. Staff showed ,a map of the area with three
regions designated for single -story structures. A rec
path was also outlined. Commissioners agreed on
the amendments.
Review table of uses in the Form Based Codes area:
The table had a list of allnwahle and nrnhihitPd nsPc
shelters; commercial kennels; cannabis cultivation;
equipment repair; lumber/contractors' yards; taxi
companies, storage and auto or truck repair garages.
list of prohibited uses that could now be permitted if
they conform to FBC: auto/motorcycle/service and
repair; car wash; equipment service/sales/rental;
warehousing/storage; light manufacturing; manu-
facturing and assembly from previously prepared
materials and components. Conner said that a use
that is not explicitly prohibited is allowable under
Form Based Code.
Other member / staff items 1iom draft LDRs: Con-
ner noted two items being worked on: rooftop and
doorway issues. The commission may be able to
have a vote at the next meeting (the special meeting,
June 30), but the LDRs are still under legal review
and might therefore only be partially reviewed by
the time of the vote.
Other Business
The commissioners agreed on a June 30 special
meeting. Staff wouldn't have graphics available and
the legal review may be partial.
Minutes
Riehle moved to approve the minutes of June 9, 2015,
Benton seconded, and the .vote was unanimously
in favor.
