SITE PLAN APPLICATION #SP-16-73
FINDINGS OF FACT AND DECISION
Champlain Housing Trust, hereinafter referred to as the applicant, is seeking after -the -
fact approval to amend a previously approved plan for a 20 unit multi -family dwelling.
The amendment consists of: 1) adding a dumpster enclosure, 2) revising the
landscaping plan by substituting a proposed crabapple tree with an existing crabapple
tree, and 3) removing a previously approved sidewalk to the community building, 1200
Shelburne Road.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is seeking after -the -fact approval to amend a previously approved plan
for a previously approved plan for a 20 unit multi -family dwelling. The amendment
consists of: 1) adding a dumpster enclosure, 2) revising the landscaping plan by
substituting a proposed crabapple tree with an existing crabapple tree, and 3) removing
a previously approved sidewalk to the community building, 1200 Shelburne Road.
2. The owner of record of the subject property is Bill & Tory Wilson.
3. The subject property is located in the Commercial 1 — R-15 Zoning District.
4. The application was received on October 14, 2016.
5. The plan submitted is entitled "Beacon Place 1200 Shelburne Road, Route 7 South
Burlington, Vermont", prepared by Krebs & Lansing Consulting Engineers, Inc., dated
3/06/15, and last revised on 9/27/16.
DIMENSIONAL REQUIREMENTS
6. The overall coverage will decrease slightly to 49.4% (maximum allowed is 70%). The
other coverages will not change.
SITE PLAN REVIEW STANDARDS
Only the standards below will are affected by this application. All other standards will
continue to be met.

7. The applicant decided to leave an existing crabapple tree in place instead of
reproving it and planting a new. Since there is no minimum landscaping requirement for
this project, this substitution is acceptable.
(c) All dumpsters and other facilities to handle solid waste, including
compliance with any recycling or other requirements, shall be accessible,
secure, and properly screened with opaque fencing to ensure that trash and
debris do not escape the enclosure(s),
8. The applicant has placed two (2) dumpsters on the property without approval. This
application is to obtain after -the -fact approval. The new enclosure will be screened on
all sides as required.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-16-73 of Champlain Housing Trust, subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
will remain in effect.
2. This project must be completed as shown on the plan and will be on file in the
South Burlington Department of Planning and Zoning.
3. The applicant must obtain a zoning permit within six (6) months pursuant to
Section 17.04 of the Land Development Regulations or this approval is null and
void.
4. Prior to issuance of a zoning permit, the applicant must submit to the
Administrative Officer a final set of project plans as approved in digital (PDF)
format.
5. The applicant must obtain a Certificate of Occupancy from the Administrative
Officer prior to use of the site modifications.
6. Any change to the site plan will require approval by the South Burlington
Development Review Board or the Administrative Officer.

by filing a Notice of Appeal with the secretary of the Development Review Board. This
Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days
of the date of this decision.
