HomeMy WebLinkAboutSP-18-40 - Decision - 1185 Shelburne Road#SP-18-40 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING JOHN LARKIN, INC. & 1185, LLC— 1185 SHELBURNE ROAD SITE PLAN REVIEW APPLICATION #SP-18-40 FINDINGS OF FACT AND DECISION John Larkin, Inc. & 1855, LLC; hereinafter referred to as "applicant" is seeking approval to amend a previously approved plan for an 83,972 sq. ft. building which will include 60 residential units and 20,250 sq. ft. of commercial space. The amendment consists of: 1) relocating the bike racks, 2) minor sidewalk modifications, 3) architectural alterations to the building, 4) revising the landscaping plan, and 5) miscellaneous site modifications, 1185 Shelburne Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT The applicant is seeking approval to amend a previously approved plan for an 83,972 sq. ft. building which will include 60 residential units and 20,250 sq. ft. of commercial space. The amendment consists of: 1) relocating the bike racks, 2) minor sidewalk modifications, 3) architectural alterations to the building, 4) revising the landscaping plan, and 5) miscellaneous site modifications, 1185 Shelburne Road. 2. The owners of record of the subject property are John Larkin, Inc. & 1185, LLC 3. The subject property is located in the Commercial 1 — Automobile Zoning District. 4. The application was received on July 24, 2018. 5. The plans submitted consists of a seven (7) page set of plans, page one (1) is labeled "Civil Site Plan Key for S. B. Revised Final Plat Resubmit 7-2018" dated 7/18/18, and prepared by Krebs & Lansing Consulting Engineers, Inc. DIMENSIONAL REQUIREMENTS 6. Coverages for the L & M PUD are increasing as follows: Building coverage is 8.1% (maximum allowed is 40%). Overall coverage is 31.9% (maximum allowed is 70%). SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. Bicycle Parking #SP-18-40 7. The plan complies with Section 13.14 of the LDRs to include the new type and location for short term bicycle parking spaces. The previously approved bike racks will be relocated and will accommodate 10 bicycle parking spaces. Landscaping 8. Minor landscaping changes are proposed. Tree species have been relocated on the site but the number and type of trees has not changed. Building Elevations 9. Numerous minor architectural modifications are being proposed (see detailed list on letter from Krebs & Lansing to staff dated 7/18/18). DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-18-40 of John Larkin, Inc. & 1185, LLC; subject to the following conditions: 1. All previous approvals and stipulations which are not changed by this decision, will remain in full effect. 2. This project must be completed as shown on the plans submitted by the applicant, and on file in the South Burlington Department of Planning and Zoning. 3. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications must be underground. 4. The applicant must obtain a zoning permit within six (6) months to construct the site modifications pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. All exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 6. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use or occupancy of the building. 7. Any change to the site plan will require approval by the South Burlington Development Review Board or Administrative Officer. Signed this W day of JO 2018, by 2 C #SP-18-40 Raymond J. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
