MEMORANDUM
TO: SOUTH BURLINGTON PLANNING COMMISSION
FROM: RICHARD WARD, ZONING ADMINISTRATIVE OFFICER
RE: SITE PLAN REVIEW BIG BEN BURGER, CONVERSION OF
A & W DRIVE-IN, SHELBURNE ROAD.
DATE: JANUARY 23, 1975
Since the January 14, 1975 Planning Commission meeting,
the staff (Mr. Szymanski, Mr. Mitchell and myself)
has met with Mr. James Harvell, of Harvell Real Estate.
The revised site plan showing the relocation of the one
curb cut has been revised and approved.
The revised plan is still in conformance with the zoning
regulations and the stipulations applied by the Zoning
Board of Adjustment.
A recommendation from Mr. Szymanski is that the McIntosh
Avenue side of the property be completely curbed and that
a catch basin be installed in the southwest corner ol" the
parking lot.
A performance bond to cover the above work and landscaping
should be posted in the amount of $2,200.

RE: SITE PLAN REVIEW Or PROPOSED BIG BEN BURGER,
1184 SHELBURNE ROAD
DATE: JANUARY 10, 1975
Proposal is to convert the existing A & W Drive -In Restaurant
into a sit down restaurant. A portion of the existing canopy
will be removed and a 35' x 56' dining area will be constructed.
On January 6, 1975 the Zoning Board of Adjustment granted
a variance dealing with the building set -back. Presently the
canopy is within 12 to 15 feet of the street right-of-way.
'he Board waived the front yard set -back to within 40 feet
of the street right-of-way. They also considered a variance
to Section 11.702 which will allow more than 50% of the
front yard for driveway and parking area.
The y=oard stipulated that no parkin, be allowed west of the
building on the south side of the lot, and that this area
be landscaped.
All other provisions of the zoning regulations are complied
with.
The existing curb cuts will be used and the front yard will
be landscaped to prevent thru traffic.
The Foard finds this to be a reasor_able use of an existin:_
structure, also a reduction in encroachment on the right-of-
way of Shelburne Road.
With the amount of landscaping required, I would .recommend
a performance bond be posted in the amount of `,1200.00.
