Re: Appeal of a decision of the Code Officer pursuant to Section z9 of the South
Burlington Sign Ordinance denying sign permit application #SN-or-25 of S.B.
Collins, Inc. This permit was denied because the proposed free-standing sign exceeds
the size limitation of 32 square feet, mo Shelburne Road.
i. The property located at iiio Shelburne Road is owned by Jolley Associates.
z. On June 8, zoot the applicant, S.B. Collins, Inc. submitted a sign application
for two(z) wall signs and one (i) free-standing sign.
3. The application #SN-oi-25 indicated that the proposed free-standing sign
would be 30.375 square feet. This measurement did not include the square
footage of the brick structure on which the words and numbers will be placed.
4. The property at iiio Shelburne Road is 29,992 square feet in area.
5. Section 8 (d) (i) of the Sign Ordinance limits the size of a free-standing sign
on a lot of less than 40,000 square feet to 32 square feet.
6. Section 3 (m) of the Sign Ordinance defines a free-standing sign as "a sign
detached from any building".
7. The size of the proposed sign, including the square footage of the brick
structure, would exceed 32 square feet.
CONCLUSIONS OF LAW
Based on the above Findings of Fact, the Board concludes that the brick structure
holding up the words and numbers is part of the free-standing sign and must be
included in the calculation of the overall dimensions of the sign.
DECISION
The South Burlington Development Review Board based on the above Findings of
Fact and Conclusions of Law, hereby upholds the decision of the Code Officer to
deny sign permit #SN-oi-25 of the S.B. Collins, Inc. on the basis that the proposed
free-standing sign exceeds the maximum size limitation of 32 square feet, iiio
Shelburne Road.

MOTION TO UPHOLD CODE OFFICER'S DECISION
I move the South Burlington Development Review Board uphold the Code Officer's
decision to deny sign permit application #SN-01-25 of S.B. Collins, Inc. on the basis
that the proposed free-standing sign exceeded the maximum sign limitation of 32
square feet.
