This project, consisting of renovation and addition to existing
commercial building (with a maximum of 6 employees) served by
municipal water and sewer services located off Shelburne Road in
the City of South Burlington, Vermont is hereby approved under
the requirements of the regulations named above, subject to the
following conditions.
GENERAL
(1) This permit does not relieve the permittee from
obtaining all other approvals and permits as may be required
from the Act 250 District Environmental Commission, the
Department of Labor and Industry (phone 828-2106 or 658-
2199), the Vermont Department of Health (phone 863-7220),
and local officials PRIOR to proceeding with this project.
(2) The project shall be completed as shown on the plans Project
88047 Sheet 2 of 16 "L & M Park South Burlington, Vermont
Site and Utilities Plan" dated June 1990 revised 7/19/93
prepared by Fitzpatrick -Llewellyn, Inc. and which have been
stamped "approved" by the Wastewater Management Division.
The project shall not deviate from the approved plans
without prior written approval from the Division of
Protection.
(3) The original building was a single family residence that was
converted to a bank branch office with a maximum of 6
employees. This permit approves that conversion and
interior renovations and an addition of 119 square feet.
(4) No alterations to the building other than those indicated on
the approved plan or Water Supply and Wastewater Disposal
Permit, which would change or affect the exterior water
supply or wastewater disposal or the approved use of the
building shall be allowed without prior review and approval
from the Agency of Natural Resources.

(5) The Wastewater Management Division now reviews the sewage
and water systems for public buildings under 10 V.S.A.,
Chapter 61 - Water Supply and Wastewater Disposal Permit.
(6) In the event of a transfer of ownership (partial or whole)
of this project, the transferee shall become permittee and
be subject to compliance with the terms and conditions of
this permit.
WATER SUPPLY
(7) The project is approved for water supply by connection to
the municipal water system. No other means of obtaining
potable water shall be allowed without prior review and
approval by the Wastewater Management Division.
SEWAGE DISPOSAL
(8) The project is approved for connection to the South
Burlington Bartlett Bay wastewater treatment facility for a
maximum of 90 gallons of sewage per day.

(2) If the parcel being acquired is to be considered for
building development at some future date, the purchaser
understands that the information required by Section 3-08 of the
rules must be submitted for evaluation. If such information does
not meet the Environmental Protection Rules, permission to build
on the lot will be denied.
(3) The conditions of this permit shall run with the land and
will be binding upon and enforceable against the permittee and
all assigns and successors in interest. The permittee shall be
responsible for recording this permit and the "Notice of Permit
Recording" in the South Burlington Land Records within 30 days of
issuance of this permit and prior to the conveyance of any lot
subject to the jurisdiction of this permit.

This is to bring to your attention a couple of items needing your
attention at L&M Park. The first is the dumpster located behind
the theater. The dumpster enclosure was recently constructed but
the two (2) dumpsters are outside the enclosure. Please contact
the person responsible and have both dumpsters placed within the
enclosure.
The second matter involves the landscaping within the development.
I contacted you earlier this year about this and you assured me
that the landscaping would be planted this fall. With this in
mind, the Planning Commission attached a condition to the Vermont
National Bank addition requiring that this landscaping be installed
prior to November 1, 1993. To date this landscaping has not been
installed.
Please contact me and let me know when you expect to have the
landscaping installed.

Dear Mr. Weith:
As you are aware, the City Planning Commission recently granted
approval to the Vermont National Bank on Shelburne Road, for
modifications to the existing building and a proposed 119 sq.ft.
addition. Because the existing structure is considered a public
building, Chapter Four of the Environmental Protection Rules
require the applicant to obtain a Water Supply & Wastewater
Disposal Permit.
The existing building, although part of L & M Park, was not
included in any sewage disposal permits granted by the state for
the parcel. As a result, the Division of Protection is requiring a
new permit application. To meet the permit application
requirements, a letter on sewer and water allocation for the
existing structure is required.
Currently the bank has 6 full time employees, no new employees are
anticipated as a result of the proposed expansion. The flow
quantities outlined in Appendix 7-A of the Environmental Protection
Rules require an allocation letter of 90 gallons per day. Would
you please provide a letter, to be used in conjunction with our
application, allocating 90 GPD of water and sewer to the project.
We apologize for any inconvenience this may have caused. Should
you have any questions in this regard, please contact us.

Mr. McClellan reviewed the changes. Mr Weith said a stipulation

Mr. Austin asked whether traffic lights have been synchronized.

just went in a few weeks ago.

7. Public Hearing: Continued Preliminary Plat application of Han-
naford Brothers Company for a 12 building planned commercial de-
velopment consisting of a new 64,000 sq. ft. supermarket, new
107,806 sq. ft. department store, 79,740 sq. ft. of new retail
space, a new 95 room hotel, a new 6,000 sq. ft. restaurant, a new
2500 sq. ft. bank with drive -through service, an existing6014 sq.
ft. restaurant and existing 6150 sq. ft. fast food restaurant
with drive through service, on 41.9 acres of land, Southland,
Shelburne Rd:
Both Mr. Austin and Mr. Sheahan stepped down due to potential
conflicts of interest.
The oath was administered to all giving testimony in this matter.
Mr White noted the Commission had asked them to go to the Agency
of Transportation and have them sign off on the project. They
have done this. They have narrowed the scope of potential
traffic issues. One issues has not been resolved: queuing
lengths between K-Mart and Brewer Parkway and the proposed
entrance to the south. Mr. White said their studies show this
works, but the Agency of Transportation wants the access moved to
the south as close as possible to Red Lobster.
Mr. Craig noted there are some minuses to moving the entrance to
the south, namely that it would no longer line up with Laurel
Hill Sotuh. There is also a question of the Burger King access.
Mr. Weith noted it would also not meet the requirement of space
between pcd entrances and a signalized intersection. Mr. Burgess
said he wasn't sure the state's and the city's objective are the
same and there may be a "catch 22" if the state insists on this
and the city doesn't want it.
Ms. Peacock noted there are a lot of high traffic generators
being proposed. Mr. White said the state says the road can
handle this. Mr Craig said he would like an independent traffic
analysis. Ms. Peacock said she didn't think it will work. She
noted there are already people in the right lane at Holmes Rd.
because they know they will get squeezed later on. She felt the
same thing would happen here. Mr White noted there would be a
dedicated left turn lane here which doesn't exist at Holmes Rd.

with drive -through, and a bank with drive -through, as depicted on
a two (2) page set of plans, page one entitled "L&M Park, Site &
Utilities Plan", prepared by Fitzpatrick -Llewellyn, Inc. and dated
6/90, last revised 7/19/93, with the following stipulations:

The applicant has submitted a customer car count survey (see
enclosed) for five (5) locations taken at their peak hour (11:00
A.M.) on the peak day (Saturday). This survey indicates an average
of 20 customers plus 10-12 employee vehicles for a total of 32
vehicles. The applicant indicates that the customer car count will
roughly double during the spring months which would bring the count
up to 52 vehicles.
Traffic: This property is in Traffic Overlay Zone 5 which would
allow this property to generate 138.9 vehicle trip ends (vte's)
during the P.M. peak hour. ITE estimates the previous use to
generate 48.8 vte's and the proposed use to generate 98.9 vte's or
a 50.1 vte increase. The applicant will be required to contribute
$7230 to the Williston Road Traffic Impact Fund (Area #2) prior to
permit based on the 50.1 additional peak hour trip ends to be
generated.
Lighting: Exterior lighting will consist of two (2) 150 watt metal
halide lamps with cut-off luminaires on 14 foot poles and five (5)
275 watt metal halide lamps attached to the building which will be
rotated downward to create a down casting light.
Sewer: An additional sewer allocation of 30 gpd is needed for this
project. The applicant will be required to pay the per gallon fee
prior to permit.

This project consists of a 116 square foot net increase addition to
an existing drive-in bank facility, a five (5) foot extension to
the drive-in canopy to add an ATM lane and parking changes. The
bank property is part of the L&M Park PUD which was last amended on
3/23/93 when the Planning Commission approved the subdivision of

the project into two (2) lots. The Planning Commission reviewed
the sketch plan on 7/13/93 (minutes enclosed).
The bank property located at 1117 Shelburne Road lies within the Cl
District. It is bounded on the north by an auto dealership, on the
west by the site of a proposed retail building, on the south by
McDonald's restaurant and on the east by Shelburne Road.
Access/circulation: Access is via a 24 foot curb cut on Shelburne
Road for ingress only and an access drive on the west side for
ingress and egress connecting the bank property to the L&M Park
commercial development.
Circulation is one-way around the bank building and is adequate.
Coverage/setbacks: The following coverage information pertains to
the commercial portion of the L&M Park project. Building coverage
is 65,416 square feet (maximum allowed is 125,453 square feet).
Overall coverage is 253,874 square feet (maximum allowed is 292,723
square feet). Front yard coverage for lot "C" and the bank lot
combined is 13.7 % (maximum allowed is 30%).
Setback requirements will be met.
Parking: No additional parking spaces provided and no additional
parking spaces required. The number of parking spaces required
for the commercial portion of the L&M Park project is based on a
shared parking study which used a Saturday to determine peak
parking demand. Since the bank is not open on Saturdays, it does
not generate a parking demand.
Landscaping: The minimum landscaping requirement for this project,
based on building cost, is $4742. The Planning Commission at
sketch plan agreed to waive the landscaping requirement. The two
( 2 ) Honey Locust trees displaced by the revised parking layout were
relocated to the vicinity of the retail building.
At the last meeting a question was raised as to why the landscaping
in the vicinity of the bank and Fayette Road was not installed.
Staff recommends a condition that requires the landscaping around
the bank, Larkin Terrace and along Fayette Road to be installed
this fall.

Traffic: The original approval for L&M Park limited the P.M. peak
hour trip generation to 623 additional vehicle trip ends (vte's)
during the P.M. peak hour. The bank building was not included in
this calculation at the time since it was not part of the project.
The project as revised on 3/3/92 for the McDonald's restaurant will
generate 566 vte's. The proposed bank expansion is estimated to
generate an additional five (5) vte's for a total of 571 vte's or
8.3% less than originally permitted.
Sewer: No additional allocation needed.
7) SOUTHLAND PCD - SHELBURNE ROAD - CONTINUED PRELIMINARY PLAT
The public hearing on this preliminary plat was continued from the
6/29/93 meeting (minutes enclosed) to give the applicant time to
address concerns raised by AOT. Enclosed is a letter from AOT
dated 9/9/93 granting conceptual approval. The conceptual approval
is being granted with a condition that the project access be
relocated to a point approximately 180 feet to the south of Laurel
Hill Drive. The reason for this is to provide enough stacking room
for queuing vehicles between the project access and the signalized
intersection to the north (K-Mart Plaza). It is my understanding
that the applicant will be presenting a revised sketch plan at
Tuesday's meeting showing a relocated project access.
At this time, staff does not have a recommendation regarding the
proposed change. Staff would first like to review a revised plan.
In addition, the applicant should submit a revised traffic impact
analysis which addresses the proposed change. Initial staff
concerns and comments are summarized below:
1. A revised study should evaluate queues and available storage.
2. Revised study should address access and safety to Laurel Hill
Drive and businesses between Laurel Hill and K-Mart Plaza/Brewer
Parkway intersection. This segment of Shelburne Road is currently
congested and unsafe due to heavy traffic volumes and a number of
high traffic generating uses (Mobil, Burger King, Getty, Bagel
Bakery, and office building on Laurel Hill Drive) . A new signal at
Laurel Hill Drive would improve traffic safety. Adding a new
signal south of Laurel Hill Drive in combination with additional
traffic generated by this development may make things worse.

5. The plan shall be revised prior to issuance of a zoning/
building permit to show the changes identified below. The
revised shall be approved by the City Planner.
a) the plan shall indicate the correct coverage calculations.
b) the landscape plan and schedule shall be consistent as to
the number of proposed plantings, and the schedule shall in-
dicate the size of proposed junipers.
c the location of the dumpster shall be correctly shown and
shall be appropriately screened.
6. Prior to issuance of a zoning/building permit, the applicant
shall pay a $1,000 fee for improvements to Ethan Allen Drive.
This requirement is a condition of the original subdivision
approval granted on 5/13/86 which created this lot.
7. The applicant shall obtain a zoning/building permit within
six months or this approval is null and void.
8. The applicant shall obtain a Certificate of Occupancy from
the Administrative Officer prior to occupancy of the building.
r 9. Any changes to the site plan shall require approval by the
South Burlington Planning Commission.

7. Sketch plan of Vermont National Bank for construction of a
116 net sq. ft. addition to an existing drive -up bank facility,
construction of a 5 ft. extension to the drive-in canopy, ad-
dition of an ATM drive -up lane, and parking changes. The ap-
plication constitutes an amendment to a planned commercial
development which consists of 150 residential units, a 61 room
hotel, 20,000 sq. ft. movie theatre (1000 seats), 22,000 sq.
ft. of retail use, a 3100 sq. ft. fast food restaurant with
drive thru and a bank with drive thru service, L&M,Park,
Shelburne Rd:
Mr. Llewellyn showed changes in the parking layout (there will
still be 29 spaces). Mr. Horton, the architect, said the bank
will move the day room out of the basement to comply with
handicapped standards. It will be located on the second floor.
An enclosed stairwell is needed, so they will build a proper
structure for it. THe central staircase will be removed and
the inside opened up. The current ATM will be removed and-Iou
drive -up ATM will be installed.
The 116 ft. addition is 1 story and allows all tellers to be

on one side of the room.
Mr. Burgess noted these are actually 2 additions. They are
enclosing'an outdoor stairtower which adds to the square
footage. He felt this was minor. Mr. Llewellyn said there
is 116 sq. ft. addition to the footprint. There will be
one-way circulation around the structure in order to egress
at the light.
Mr. Llewellyn said the applicant feels that L & M park is
already landscaped enough. Mr. Weith said the landscaping
requirement is based on 30/. of construction costs and recom-
mended they continue the street tree concept on Shelburne Rd.
Mrs. Maher noted that dead trees need to be replaced. Mr.
Weith will check on the bond.
Mr. Llewellyn said no additional sewer is required. Only
one exterior light will be moved.
Members felt street trees should be put in now.
8. REvised final plat application of JOhn Larkin to amend con-
ditions #7 and 8 of the approval for a 250 seat ballroom ad-
dition to the hotel/restaurant planned commercial development
located at 1720 Shelburne Rd. (Howard Johnsons/Quality Suites).
The amended conditions #7 & 8 address hours of operation and
submission of a report regarding usage of the ballroom facility:
Mr. Rabideau explained that when the ballroom was approved,
use was prohibited before 2 pm on weekends and 6:30 pm on
weekdays for traffic considerations. The applicant now
proposes that instead of restricting use of the ballroom
during peak hours, the Commission restrict the number of seats
during peak hour, whether they be ballroom seats or meeting
room seats. No more than 250 seats may be booked for use
during peak hours (11 am to 2 pm weekends and 4-6:30 pm on
weekdays. This won't increase traffic on Shelburne Rd. and
will be more flexible for the hotel and more ability for the
city to monitor.
The applicant wants to serve a continental breakfast in the
ballroom which will not increase traffic as guests are al-
ready in the -hotel.
Mr. Weith asked to review parking. Members agreed this should
be done over a full cycle of seasons.
Mr Austin asked how Green Mountain Dr/Shelburne Rd. performs
at peak. Mr. BUrgess said from observation, it is awful in
the northbound lanes.

Dumpster: The dumpster should be suitably screened and so noted on
the plan.
Other: The subdivision approval to which this lot was a part of
requires that $1,000 be paid when permits are issued for the first
five ( 5 ) lots. This would be the 5th lot with a building. The
money would go towards improvements to Ethan Allen Drive.
7) L&M PARK - BANK ADDITION - SKETCH PLAN
This project consists of a 116 square foot net increase addition to
an existing drive-in bank facility, a five (5) foot extension to
the drive-in canopy to add an ATM lane and parking changes. The
bank property is part of the L&M Park PUD which was last amended on
3/23/93 when the Planning Commission approved the subdivision of
the project into two (2) lots.
The bank property located at 1117 Shelburne Road lies within the Cl
District. It is bounded on the north by an auto dealership, on the
west by the site of a proposed retail building, on the south by
McDonald's restaurant and on the east by Shelburne Road.
Access/circulation: Access is via a 24 foot curb cut on Shelburne
Road for ingress only and an access drive on the west side for
ingress and egress connecting the bank property to the L&M Park
commercial development.
Circulation is one-way around the bank building and is adequate.
Coverage/setbacks: The following coverage information pertains to
the commercial portion of the L&M Park project. Building coverage
is 65,416 square feet (maximum allowed is 125,453 square feet).
Overall coverage is 253,874 square feet (maximum allowed is 292,723
square feet). The applicant should provide front yard coverage
calculation for lot "C" and the bank lot combined.
Setback requirements will be met.
Parking: No additional parking spaces provided and no additional
parking spaces required. The number of parking spaces required
for the commercial portion of the L&M Park project is based on a
shared parking study which used a Saturday to determine peak

parking demand. Since the bank is, not open on Saturdays, it does
not generate a parking demand.
Landscaping: The minimum landscaping requirement for this project
is $4742. A landscaping plan was not submitted for this sketch
plan review. Staff recommends appropriate screening in front of
the bank parking along Shelburne Road. The final plat plans must
include a landscaping plan.
Traffic: The original approval for L&M Park limited the P.M. peak
hour trip generation to 623 vehicle trip

8) JOHN LARKIN - HARBOR VIEW INN AMENDMENT - REVISED FINAL PLAT
This application is to amend conditions #7 and #8 of the December
17, 1991 Planning Commission approval for a 250 seat ballroom (see
enclosed minutes). These conditions prohibit the use of the
ballroom prior to 6:30 P.M. Monday through Friday or prior to 2:00
P.M. on weekends and require semi-annual performance reports. The
applicant is seeking to have some flexibility in the use of the
ballroom and the meeting space approved on 5/23/89 (minutes
enclosed). The applicant is proposing that instead of restricting
the use of the ballroom during the peak traffic hours, the City
should restrict the number of seats during the peak hour, whether
they be ballroom seats or meeting room seats. The applicant is
proposing that no more than 250 seats be booked for use during the

L&M PARK- BANK ADDITION - SITE PLAN
--- provide estimated cost of proposed addition.
--- parallel parking spaces must have minimum dimensions of
9'x22'.
--- provide front yard coverage calculation for lot "C" including
the bank lot and the building and overall coverage square
footages for the entire development.
--- landscaping plan for the project including the bank site must
be submitted for final plat review. Staff recommends
appropriate screening in front of bank parking.
--- the drive -up canopy is being extended five (5) feet towards
the north boundary line but the site plan does not reflect
this extension. It does not appear that the 15 foot side
setback will be met with the canopy extension. This should be
verified.
--- staff recommends that parking be located at least 50 feet from
the front property line to maintain a consistent 50 foot green
strip along the frontage, this would require that a
handicapped space be moved.
