On behalf of McIntosh Partners, Inc., enclosed please find the following in application for a
conditional use permit for the above -referenced project at the site of the former Del -Ray Motel on
Shelburne Road:
1. A completed Application to Board of Adjustment. This application has been signed by
Ms. Barbara Mayo on behalf of the current property owner, the Henry R. Barker Trust.
2. A check for the application fee of $50.00.
3. Eight sets of plans (Sheets 1 and 2) showing the proposed project.
In the way of background, this parcel is located in the C-1 Zoning District. Its easterly
property line is also the boundary between the C-1 and R-4 District to the east. The following
paragraphs address the criteria for a conditional use, as outlined in Section 26.052 of the Zoning
Regulations:
(a) The capacity of existing or planned municipal or educational facilities: The existing
sewer allocation for the site is sufficient to allow the deli/bakery to accommodate 51
seats. South Burlington Fire Chief, Wallace Possich, has reviewed the proposed plans
and found them to be "acceptable" as stated in a memorandum dated August 30, 1996.
There is no anticipated increase in police protection required for this project. The City
of South Burlington Water System will be accessed from an existing curb stop on
McIntosh Avenue. The proposed use will have no impact on educational facilities.
(b) The essential character of the neighborhood or district in which the property is located,
nor the ability to develop adjacent property for appropriate uses: The existing land use
is a 12 unit motel and residence. The proposed project will not change the essential
character of the neighborhood. This land use is similar to other existing commercial

land uses in this Zoning District along Shelburne Road, and will not affect the ability to
develop adjacent property. The proposed site plan also maintains a significant expanse
of wooded area on the easterly side of this parcel in order to act as a buffer between
the two zoning districts.
(c) Traffic on roads and highways in the vicinity: See the enclosed analysis of traffic
conditions at the Shelburne Road / McIntosh Avenue / Fayette Drive intersection dated
August 23, 1996.
(d) Bylaws in effect: The project and its proposed site plan has been designed to comply
with the requirements set forth in the City of South Burlington Zoning Regulations.
(e) Utilization of renewable energy resources: The building will utilize current energy
conservation standards in its construction and operation.
(f) General public health and welfare: The proposed project is not anticipated to have an
adverse affect on the general public health and welfare.

As requested, we have performed an analysis of traffic conditions at the Shelburne Road /
McIntosh Avenue / Fayette Drive intersection for the above -referenced project.
Background Traffic Volumes
Background p.m. peak hour turning movement volumes were obtained at this intersection by
performing traffic counts on July 31, 1996. A copy of that count is enclosed as Attachment A. The
observed peak hour volumes were then adjusted upward to a projected 1997 design volume based
on Vermont Agency of Transportation traffic data.
Project Trip Generation
The trip generation of projects such as this are typically estimated using data published by
the ITE'. In this case, however, a bagel bakery does not fit into any of the established land -use
categories for which trip generation rates are available.
Because of that, a trip generation study was performed during both the morning (7-9 a.m.)
and afternoon (4-6 p.m.) periods at the Burlington Bagel Bakery located just to the north of this site
at 992 Shelburne Road. That site has many important similarities to this, including being on the
same (east) side of Shelburne Road, having access to a signalized intersection, plus having similar
size and menu. All traffic entering and exiting the Burlington Bagel Bakery was counted, including
vehicles traveling between the bagel bakery and the adjacent convenience store. The raw data
was then adjusted based on the floor areas of the two bagel bakeries (Burlington Bagel Bakery
occupies 2,904 sq.ft. vs. this project's proposed 2,150 sq.ft.) to calculate this project's trip

generation. Table 1 presents the raw data and resulting calculations based on three days of counts
at the Burlington Bagel Bakery.

With the project site being located within the Traffic Overlay District of the South Burlington
Zoning Regulations, its potential trip generation can be limited based on the proposed land -uses,
the number and configuration of curb -cuts, and traffic conditions at adjacent intersections.
This project proposes to create two new curb cuts onto the adjacent streets. The first, onto
Shelburne Road, will replace an existing one and will be located further from McIntosh Avenue.
The second, onto McIntosh Avenue, will be located over the 200 feet minimum separation from
Shelburne Road which is required by the Zoning Regulations. Because this project wishes to retain
a curb cut onto Shelburne Road, city planning staff has determined that this project falls into Zone
2 of the Traffic Overlay District, which limits it to a maximum p.m. peak hour trip generation of 20
vte/hour per 40,000 sq.ft. of lot area. With this parcel's lot area being 39,000 sq.ft., the proposed
project will satisfy that requirement.
Traffic Congestion Conditions
The projected 1997 design hour volumes at the Shelburne Road / McIntosh Avenue / Fayette
Drive intersection were then analyzed, both without and with this project. For the sake of the
analyses, under the "with project" scenario, all project -generated traffic was assumed to access
via the McIntosh Avenue curb -cut. Table 2 presents the results of those analyses, which indicate
that levels of service at this intersection will remain at C or better. Copies of the detailed capacity
analyses are enclosed as Attachment B and C.

Conclusions
Based on the results of the above analyses, it is our opinion that this project will comply with
all requirements of the South Burlington Zoning Regulations with respect to trip generation and
impact on p.m. peak hour traffic congestion conditions.
