HomeMy WebLinkAboutSP-16-56 - Decision - 1120 Shelburne Road#SP-16-56 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING WHITE + BURKE — 1120 SHELBURNE ROAD SITE PLAN APPLICATION #SP-16-56 FINDINGS OF FACT AND DECISION White + Burke, hereinafter referred to as the applicant, is seeking approval to amend a previously approved plan for a 2,500 sq. ft. bank with a drive -through facility. The amendment consists of revising the landscaping plan, 1120 Shelburne Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT White + Burke is seeking approval to amend a previously approved plan for a 2,500 sq. ft. bank with a drive -through facility. The amendment consists of revising the landscaping plan, 1120 Shelburne Road. 2. The owners of record of the subject property are L.T. Spillane Jr. & Shelley Spillane. 3. The subject property is located in the Commercial 1 — Residential 15 Zoning District. 4. The application was received on August 18, 2016. 5. The plan submitted consists of a three (3) page set of plans, page one (1) is entitled "Northfield Savings Bank Site Demolition Plan - South Burlington", prepared by White + Burke, dated 9/04/15, and last revised on 8/15/16. DIMENSIONAL REQUIREMENTS 6. No change in coverages proposed. 7. Setback requirements will continue to be met. SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: Only the standards below are affected by this application. All other standards will continue to be met. - 1 — #SP-16-56 Landscaping 8. The proposal is to remove and replace a cedar hedge row consisting of 82 Arborvitae trees 6'-7' high at a cost of $17,000. These will replace trees which are approximately 10 ft. in height. The difference between the costs of planting replacement trees at the 10 ft. height and 6'-7' high is $8000 according to information provided by the applicant in an email from Paul Simon to staff dated 8/24/16. The applicant recently obtained approval to add $7,500 of new plantings along the street including a stone wall and a six (6) foot high chain link fence along the northerly boundary (#SP-16-31). The Administrative Officer considers the shortfall in the value of the replacement trees to have been made up by the additional $7500 of additional landscaping previously approved. 9. The City Arborist in an email dated 08/24/16 to staff indicated that the plans were acceptable. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-16-56 of White + Burke, subject to the following conditions: All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. Prior to permit issuance, the applicant must post a $17,000 landscaping bond. This bond must remain in full effect for three (3) years to assure that the landscaping has taken root and has a good chance of survival. 4. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. The applicant must obtain a Certificate of Occupancy from the Administrative Officer upon completion of installing the new landscaping. 6. Any change to the site plan will require approval by the South Burlington Development Review Board or the Administrative Officer.
