HomeMy WebLinkAboutSP-17-60 - Decision - 1125 Shelburne Road#SP-17-60 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING MILOT LARKIN PARTNERSHIP, LLP - 1125 SHELBURNE ROAD SITE PLAN APPLICATION #SP-17-60 FINDINGS OF FACT AND DECISION Milot Larkin Partnership, LLP, hereinafter referred to as the applicant, is seeking approval to amend a previously approved plan for a multi -building planned unit development. The amendment consists of: 1) adding a 120 sq. ft. concrete vault and utility cabinet, and 2) revising the landscaping plan, 1125 Shelburne Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking approval to amend a previously approved plan for a multi - building planned unit development. The amendment consists of: 1) adding a 120 sq. ft. concrete vault and utility cabinet, and 2) revising the landscaping plan, 1125 Shelburne Road. 2. The owner of record of the subject property is Milot Larkin Partnership, LLP. 3. The subject property is located in the C1 Auto & Cl-R15 Zoning Districts. 4. The application was received on August 7, 2017. 5. The plan set submitted consists of a three (3) page set of plans, page one (1) is titled, "Seven Fayette McDonalds GMP Installation Overall Site Plan", prepared by Krebs & Lansing Consulting Engineers, Inc., and dated 8/07/17. DIMENSIONAL REQUIREMENTS 6. Coverages are not changing. 7. Setback requirements are being met. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. Vehicle and Bicycle Parking 8. The plan will have to be revised to comply with Section 13.14 of the LDRs to include the new type and location for bicycle racks, to accommodate the minimum requirement of two (2) (50% of requirement) short-term bicycle parking spaces or comply with the full requirement of four (4) bicycle spaces. - 1 - #SP-17-60 9. The plan will have to be revised to show snow storage area(s). Utility Cabinet 10. The proposed utility cabinet will meet the setback requirement will be screened to comply with Section 13.18 of the LDRs. Landscaping 11. In addition to providing screening around the utility cabinet, the applicant is revising the landscaping plan to: 1) replace plantings that were either never planted or died and not replaced or 2) show plantings that were planted but were not part of the original planting plan. The total value of the new plantings is $17,745. The City Arborist on 9/12/17 indicated that the landscaping plan was acceptable. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-17-60 of Milot Larkin Partnership, LLP, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The plans must be revised to show the changes below and will require approval of the Administrative Officer. Three (3) copies of the approved revised plans must be submitted to the Administrative Officer prior to permit issuance. a. The site plan must be revised to include snow storage area(s). b. The site plan must be revised to include the minimum requirement of two (2) (50% of requirement) short-term bicycle parking spaces or comply with the full requirement of four (4) bicycle spaces. 4. Prior to permit issuance, the applicant must post a $17,745 landscaping bond. This bond must remain in full effect for three (3) years to assure that the landscaping has taken root and has a good chance of survival. 5. The applicant must obtain a zoning permit from within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 6. All exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 7. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use of the site modifications. -2- #SP-17-60 8. Prior to issuance of a zoning permit for the project, the applicant must submit to the Administrative Officer a final set of project plans as approved in digital (PDF) format. 9. Any change to the site plan will require approval by the South Burlington Development Review Board or the Administrative Officer. Signed on this day of / A 2017 by �,ay and J. This Notice of Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of this decision.
