The City is concerned about the depiction on the survey of a 3.5 acre "withdrawal parcel" at the northwesterly corner of the property. The "withdrawal parcel" as depicted on the survey has the appearance of a separate lot. In addition, there are no notes explaining its inclusion on the map. As you know, the "withdrawal parcel" is not a separate lot approved by the City Planning Office. I am told by the Surveyor, Vaughn Button, that an updated plan may be submitted within the next 60 days with revised notes. Perhaps a note could be added to the survey, or some other designation made within the bounds of the "withdrawal parcel," that would clearly indicate that the "withdrawal parcel" is not a separate lot. This parking space shortage is noted on your recently completed ALTA/ACSM survey prepared by Vaughn Button. The boundaries of the non -buildable area are shown on the plan and the acreage indicated. Since development activity is proposed in a restricted area, the applicant must address the criteria in Section 6.606 of the zoning regulations. The applicant has addressed these criteria (see enclosed). This is an important issue which the Commission needs to discuss. If the Commission is willing to approve this number of lots in a restricted area, the justification for granting such a waiver will need to be addressed thoroughly in the findings of fact. At a minimum, staff recommends the following: o for lots 2 - 5, locate building envelopes behind tree line to better screen buildings from view from Hinesburg Road. Include condition which prohibits removal of vegetation outside of building envelope. o for lot 6, shift western boundary of building envelope to east in order to comply with development area boundary. Wetlands: Wetlands on the property have been delineated. Their boundaries, with associated buffer/C.O. District boundaries, are / shown on the plan. The proposed crossing of the C.O. District I (wetlands) by roadways liaweemnaWftimarais permitted under Section 3.20 of the zoning regulations. C.O. District: There are a number of C.O. Districts on the ` property. The plans show C.O. Districts along the wetland but not along all streams and drainageways. See enclosed sketch B for an estimation of all C.O. Districts on the property. The final plat should show all existing streams/drainageways with the corresponding C.O. Districts. The C.O. District along the existing wetlands should also be noted as such, perhaps "wetland buffer/C.O. District". The Natural Resources Committee reviewed these plans and submitted comments (see enclosed). Portions of roads "A" and "B" will encroach into the C.O. District (i.e., wetland and wetland buffer). The Commission may allow this encroachment only if the attributes provided in Section 3.503(a)- (e) will not be significantly adversely affected. These attributes should be addressed by a qualified wetland expert. The amendment consists of revising the locations of residential building #4 and associated parking.: Mr. Rabideau said building #5 has already been relocated because of soils. They want to move #4 to get a more pleasing outlook and also to get units out of the path of headlights. This will also even up the spaces between units. There are no coverage or setback issues. It will just make the site look and function better. Mr. Weith said there is no impact on the rest of the site. He then asked the applicant when Fayette Road will be finished and dedicated to the City. Mr. Larkin said before Thanksgiving, according to Mr. Milot and Mr. Colton. Mr. Crow moved the Planning Commission approve the revised final plat application of John Larkin and Gerald Milot to amend an ap- proved planned commercial development consisting of 150 residen- tial units, a 61 room hotel, a 20,000 sq. ft. movie theater (1000 seats), a 22,500 sq. ft. restaurant/retail/indoor recreation buiding, a 3500 sq. ft. restaurant with drive -through service, and a bank with drive -through service, located on Shelburne Road. Site plan application of Tygate Companies to construct a 4,000 sq. ft. indoor pool addition to a 76 room motel and 250 seat restaurant, 1076 Williston Road; The applicant said the number of rooms, parking, traffic, etc. will not change. The proposal is to take the existing landscaped circle and flatten the curve. The pool will be built in front of the current exercise building. There is also a proposal to link the building to the restaurant, but this will not be done immediately. They will do some re -landscaping. The site is very well land- scaped now with a park -like setting. Mr. Burgess did not see what the applicant should get credit for landscaping done as part of an earlier approval. The last review of this site was on 1/27/87 (minutes enclosed). This property located at 1076 Williston Road lies within the Cl and CO Districts. It is bounded on the west by Holiday Inn, on the south by a single family dwelling, service station, medical office, photo shop and Williston Road, on the east by auto sales and undeveloped land, and on the north by undeveloped land. Access/circulation: Access is provided by a signalized 30 foot curb cut on Williston Road and access to the service station property. No changes proposed. Circulation on the site is adequate. Coverage/setbacks: Building coverage is 1.9% (maximum allowed is 30%). Overall coverage is 11.5% (maximum allowed is 70%). Front yard coverage is 12% (maximum allowed is 30%). Setback requirements are met. Landscaping: The minimum landscaping requirement, based on building costs, is $5610 which is not being met. Proposed landscaping which includes Juniper and Red Maple is $4878 short of the requirement. Applicant is seeking a credit for existing trees to make up the shortfall. Staff supports granting the credit. Parking: A total of 285 spaces are required and 263 spaces in addition to 50 overflow spaces for a total of 313 spaces are available. A bike rack will also be provided as required. Sketch plan application of Hospitality Inns, Inc, dba Sheraton Burlington Hotel & Conference Center to remove a 200 seat res- taurant building and construct a 10,000 sq. ft. retail/office building in its place on a lot containing a 315 room hotel and conference center, 870 Williston Rd. Mr. Lindberg said the whole front building and bridge will come down. The footprint of the Sheraton will be reduced, and the building will be moved back from the road. They are asking for parking on the east side of the building, The stone wall will remain. There will be no parking in the courtyard which will be for pedestrians only. The new building will be single story with a sloped roof, compatible with the rest of the Sheraton archi- tecture. Mr. Lindberg showed a conceptual drawing of the new bulding. They will comply with all setbacks and parking require- ments. It is anticipated that the new use will require less water and less energy. Mr. Weith noted that the parking proposed to the east is within the Conservation Zone. Mr. Burgess said the Commission cannot waive this. Mr. Lindberg said they will come back with a solution. Mr. Farrell said they will make every effort to save and move landscaping. They have configured the building to save one very large tree. 4. Public Hearing: Revised Final Plat application of L & M Part- nership to amend a planned unit development consisting of 150 residential units, a 61 room hotel, '-"0;000 sq. ft. movie theatre (1000 seats),a 22,500 sq. ft. restaurant/retail/indoor recreation building, a 3500 sq. ft. restaurant with drive -through service, and a bank with drive -through service, located on Shel- burne Rd. The amendment consists of relocating a 30-unit multi- family bulding (#5) and associated parking: Mr. Rabideau said the move is necessary because of sub -standard soils. The total number of units and parking will stay the same. This is a 30-unit building with underground parking garage. They are trying to relocate 5 apple trees. If they can't, they will provide the value of the trees in new landscaping. Tenants of Larkin Terrace presented the Commission with a peti- tion. They have a major parking problem and safety issue. Mr. r Peyton noted they lost their parking when the road came through (� and there are not enough spaces near the residential building PLANNING COMMISSION 27 September 1994 page 5 for tenants to park. People who have parked in the Merrill theatre area have been towed despite the fact that this is supposed to be a development with shared parking. Mr. Larkin acknowledged that the problem does exist and that he has re- imbursed tenants for towing fees. He said Merrill is supposed to be complying with the shared parking arrangement. Residents said they have also been towed at McDonalds and have been warned that McDonalds will continue to tow their cars if parked there. Ms. Julien said that in addition, there is a problem with emer- gency access, and recently an ambulance could not get in to reach a tenant. The Fire Dept. requires that a fire lane be put in which will eliminate 15 more parking spaces for residents. Mr. Burgess said this issue has to be cleared up as this project was approved with the stipulation of shared parking. Mr. Weith offered to meet with Mr. Larkin, the Merrill and McDonalds people and residents and report back to the Commission. Ms. Julien said McDonalds people have said they absolutely won't allow them to park there as McDonalds leases the land. Following this discussion, members said they had no objections to the amendment under consideration. As we examine the site plan, it appears that the final layout would be more balanced if we were to adjust the location of that final building. A secondary benefit of such a move would be to locate the easterly end of building 4 out of the sight line of the perimeter road. This would reduce the effect of car headlights being directed into the building. Moving building Four 45 feet more or less to the west would accomplish those goals. The revised final location of the building would remain clear of the problem soils which triggered the relocation of building 5. Would you be willing to discuss this proposal with the Planning Commission under other business? Can this minor revision be processed in an expeditious way? If this revision requires a complicated and expensive submittal process, it is likely that the partnership will forgo the changeand build the plan as currently recorded. Sketch plan application of Hospitality Inns, Inc, dba Sheraton Burlington Hotel & Conference Center to remove a 200 seat res- taurant building and construct a 10,000 sq. ft. retail/office / building in its place on a lot containing a 315 room hotel and conference center, 870 Williston Rd.;, Mr. Lindberg said the whole front building and bridge will come down. The footprint of the Sheraton will be reduced, and the building will be moved back from the road. They are asking for parking on the east side of the building, The stone wall will remain. There will be no parking in the courtyard which will be for pedestrians only. The new building will be single story with a sloped roof, compatible with the rest of the Sheraton archi- tecture. Mr. Lindberg showed a conceptual drawing of the new bulding. They will comply with all setbacks and parking require- ments. It is anticipated that the new use will require less water and less energy. Mr. Weith noted that the parking proposed to the east is within the Conservation Zone. Mr. Burgess said the Commission cannot waive this. Mr. Lindberg said they will come back with a solution. Mr. Farrell said they will make every effort to save and move landscaping. They have configured the building to save one very large tree. 4. Public Hearing: Revised Final Plat application of L & M Part- nership to amend a planned unit development consisting of 150 residential units, a 61 room hotel, \0;0.00 sq. ft. movie theatre (1000 seats),a 22,500 sq. ft. restaurant/retail/indoor recreation building, a 3500 sq. ft. restaurant with drive -through service, and a bank with drive -through service, located on Shel- burne Rd. The amendment consists of relocating a 30-unit multi- family bulding (#5) and associated parking: Mr. Rabideau said the move is necessary because of sub -standard soils. The total number of units and parking will stay the same. This is a 30-unit building with underground parking garage. They are trying to relocate 5 apple trees. If they can't, they will provide the value of the trees in new landscaping. Tenants of Larkin Terrace presented the Commission with a peti- tion. They have a major parking problem and safety issue. Mr. Peyton noted they lost their parking when the road came through and there are not enough spaces near the residential building PLANNING COMMISSION 27 September 1994 page 5 for tenants to park. People who have parked, in the Merrill theatre area have been towed despite the fact that this is supposed to be a development with shared parking. Mr. Larkin acknowledged that the problem does exist and that he has re- imbursed tenants for towing fees. He said Merrill is supposed to be complying with the shared parking arrangement. Residents said they have also been towed at McDonalds and have been warned that McDonalds will continue to tow their cars if parked there. Ms. Julien said that in addition, there is a problem with emer- gency access, and recently an ambulance could not get in to reach a tenant. The Fire Dept. requires that a fire lane be put in which will eliminate 15 more parking spaces for residents. Mr. Burgess said this issue has to be cleared up as this project was approved with the stipulation of shared parking. Mr. Weith offered to meet with Mr. Larkin, the Merrill and McDonalds people and residents and report back to the Commission. Ms. Julien said McDonalds people have said they absolutely won't allow them to park there as McDonalds leases the land. Following this discussion, members said they had no objections to the amendment under consideration. The parking study reviewed on 7/26/94 showed that the highest count taken was 207 cars. This is 40 spaces or 16% more than is apparently needed. Mr. Kelly said the warrants for that weren't met. Mr. Craig said he would like to see a right turning land into the project. He felt they work very well. Other members agreed and Mr. Milot said he would provide this. Mr. Scott suggested a "no passing zone" there as well. Mr. Scott added that it would be nice if the light at Swift could be pedestrian activated in view of the location of the bike path. He also noted that Mr. Milot had been generous in the dedication of recreation path land. Members felt the application should be continued as there were still outstanding issues including school impact fees, sewers, and others. Mrs. Maher moved to continue the application until 30 March. Mr. Sheahan seconded. Motion passed unanimously. 3. Revised Final Plat application oLf.John Larkin and Gerry Milot to amend the L&M Park planned commercial development as follows: 1) revise the building sizes and parking lot of the residential portion of the development, and 2) subdivide the project to create separate parcels for the residential and commercial portions of the development, Shelburne Rd.: Mr. Milot said they did separate financing on the commercial in the front and the rear, and the bank attorneys had a problem with subdivision. They want a "foreclosable line." The question is where to put it. Mr. Milot said there can be a stipulation that both pieces will always remain part of the planned commercial development. He showed a possible line delineating commercial and residential lands. Mr. Llewellyn noted it pretty much follows the sewer line easement. Mr. Craig noted the 100 foot strip along with the boundary previously required to be dedi- cated to the city for the Southern Connector will be included in Parcel A and not be dedicated to the city. Mr. Weith noted the Southern Connector has been taken out of the Official City Map. He also noted the applicant will provide a 20 foot easement for the recreation path. Mr. Steele then outlined other changes to the plan. Building 2 has been changed to now have its entrance to the south instead of north. They also took out the corner of the building to ac- commodate the CO Zone. They will correct the discrepancy between sheets 11 and 15, as noted by the City Planner. They will change the names of abutters and will change lot F to lot E. 55,000 gpd sewage is required. The question of parking on Fayette Rd. was raised. Mr. Milot said they are still working on this. The 5 four-story buildings plus underground parking garages are arranged around an interior courtyard. The change was to try to reduce the number of building footprints and improve the internal circulation. This provides for less lot coverage (4.3% lot coverage for the residential portion and 14% overall). They have all of the required parking and more than half is underground. There are small parking lots for each building. The first floor elevations are close to finished grade. There will be three clear stories to the eaves and then a fourth story hidden in the attic space. Mr. Craig asked if the buildings are sprinkled. Mr. Rabideau replied yes. The underground parking is noncombustible and the four floors are served by an elevator which goes down to the parking garage. Mr. Craig asked if the apartments will be rented. Mr. Rabideau stated they will be sold and they should be very affordable sales. Mr. Rabideau stated there will be lO one -bedroom units proposed for each building. Each building will conform and when they pull individual building permit: they will verify all of the dimE-nsions. Each unit will have its own heating equipment inside the unit. The heating system will run off the hot water tank. There will be no common mechanical space and no rooftop mechanical. equipment. Each buildingA will have gas. Mr. Rabideau stated there is a combination of sedges, sensitive ferns and grasses and there are remnants of the old apple orchard. The view from the units into that area is very attractive. Mr. Craig is concerned with protecting the wetlands. He would like the applicant to F;ut something in the Declaration of Condominium to protect the wetlands. Mr. Larkin agreed to having the wetlands protected in the Declaration of Condominium. Mr. Sheahan commented on the C:hief's memo requesting more than one road in. Mr. Rabideau stated he met with the Chief and the plan reflects his concern•. They provided good fire hydrant locations and clear access in front of each building. BECAUSE OF THE NUMBER OF UNITS THERE SHOULD BE AT LEAST TWO. } 1 Y1 L • (802)658-7960 PLANNING COMMISSION 25 AUGUST 1992 The South Burlington Planning Commission held a meeting on Tuesday, 25 August 1992, at 7:30 pm, in the Conference Room, City Hall, 575 Dorset Street. Members Present: William Burgess, Chairman; Mary -Barbara Maher, Terry Sheahan, William Craig, Catherine Peacock, David Austin, Mac Teeson Also Present: Joe Weith, City Planner; Sid Poger, The Other Paper; Al & Rita Reyes, Fred Tiballi, Lance A. Llewellyn, Charles Brush, Peter Collins, Tom Heilmann, Charlie VanWinkle, Leonard Lamoureaux, Roger Dickenson, Chris Bishop, Jim Carroll 1. Other Business: Mr. Weith said that Channel 17 wants to do a live call -in show and would like 2 Commission members and himself to be there on Wednesday, 23 September, at 5:45 pm. Mr. Sheahan and Mr. Burgess will represent the Commission. 2. Minutes of 4 August 1992: Mr. Sheahan moved the Minutes of 4 August be approved as written. Mrs. Maher seconded. Motion passed 6-0 with Mr. Craig abstaining. 3. Public Hearing: Continue consideration of proposed amendment to the South Burlington Zoning Regulations to establish a new Section 19.17, Design Control District: Mr. Weith noted there had been concern at the last meeting that simple applications not be required to address irrelevant criteria. He added wording but the City Attorney felt the wording was too open-ended and would be inviting arguments from all applicants. The City Attorney recommended omitting the wording and leaving it to the judgment of the Commission as to which criteria apply. Mr. Weith said he agreed with this. A majority of the Commission agreed as well. Mr. Austin raised the question, relevant to Sect. 19.172, of denying a Site Plan if the design criteria are not met. Mr. Weith said in the findings of fact it will be made clear which criteria are not being met. Mr Burgess asked that Mr. Weith discuss this with the City Attorney. Mr Weith said he would also discuss the possibility of beefing up site plan criteria to avoid duplication. Mr. Craig moved to continue the public hearing until 22 September 1992. PLANNING COMMISSION 25 AUGUST 1992 PAGE 2 revise the layout of the residential portion of a planned commercial development consisting of 150 residential units; a 61 room hotel, 20,000 sq. ft. movie theatre (1,000 seats), 22,000 sq. ft. of retail use, and a 3100 sq. ft. fast food restaurant with drive thru, 1175 Shelburne Rd: Mr. Van Winkle said the number of units will remain the same but there will be fewer buildings. Access will be changed to circle individual buildings. The original plan called for 350 bedrooms; this latest revision calls for 270. Ms. Peacock asked about the connection to the Pomerleau property. Mr. Weith said there was a condition they not build it now. He said he would check the stipulation. Members expressed no objection to the proposal. 5. Discussion with Chittenden Bank regarding potential parking and circulation changes at the Factory Outlet Mall, Shelburne Rd: Mr. Collins, representing Heathcote, said the Chittenden has tried, with the blessing of Heathcote, to negotiate changes to O'Dell Parkway that would benefit all owners. Despite negotiations, the Chittenden has been unable to get unanimity as to location, money spent, etc. Mr. Burgess noted they are at this point because the Chittenden made.a proposal in an effort to get the Commission to repeal Stipulation 8 of the T.J.Maxx approval. Mr. Weith then reviewed the terms of that approval for the benefit of the new Commission member. Mr. Collins showed where the Commission felt there was a circulation problem because of the bank. He noted the Chittenden feels they cannot have a bank there without a drive -up facility. The Chittenden then asked Leonard Lamoureaux to look at the lot to see if there was a way to address the Commission's concerns. Mr. Craig said the only reason he voted for the TJ Maxx expansion was the belief that the bank would be gone. He said the problem is the entire development in this one little area. He said there was no way he would vote for this with the drive -up facility. Mrs. Maher said a major problem is visibility as people can't see because of the bank building and they can't get around to the back. Mr. Collins said the engineers feel a bank without a drive-thru will put more of a burden on the parking. This was recommended by the Fire Chief. 4) L&M PARK - MULTI -FAMILY REVISION - SKETCH PLAN This project consists of the reduction in the number of multi- family buildings from seven (7) to five (5). The number of dwelling units will remain at 150. The applicant will need to obtain a conditional use permit from the Zoning Board of Adjustment. This property located in the rear of the L&M Park site is within the Cl zone. It is bounded on the north by undeveloped lands owned by Pomerleau, on the east by an auto dealership and the commercial portion of L&M Park, on the south by undeveloped land owned by Farrell and on the west by railroad tracks owned by Vermont Railway. Access/circulation: Access will be via a private drive off from Fayette Drive at the same location as previously proposed. The access drive will have a 140 foot long island separating ingress and egress traffic. Circulation of traffic on the site is acceptable. Coverage/setbacks: Building coverage for the residential portion will increase from 6% to 6.6% (maximum allowed is 20%). Overall coverage will increase from 22% to 28% (maximum allowed is 40%). Setback requirements will be met. Parking: The residential portion requires a total of 338 parking spaces and the plan shows 338 parking spaces. The applicant should indicate whether these numbers have changed. Revised Final Plat: For revised final plat review, the following information should be provided: --- typical elevations for the residential buildings --- locations of screened dumpsters --- exterior lighting details --- landscaping plan with schedule --- building costs --- utilities, roads, grading, drainage, etc. --- conditional use permit from the Zoning Board of Adjustment. 5) F.E.P. ASSOCIATES/BEN FRANKLIN - REVIEW CIRCULATION The applicant is returning to the Planning Commission to have their traffic circulation reviewed as a condition of the 1/8/91 approval (minutes enclosed). Condition #4 of this approval required that temporary barriers be erected as per the approved plan and that the applicant return to the Commission to review circulation after one (1) year occupancy. At this meeting, the Commission is to determine_ whether the proposed circulation improvements (i.e., curbing) should be permanently installed, or if some other circulation improvement design should be installed. The temporary barriers that were installed were not installed as shown on the approval plan, although they have greatly improved traffic circulation . It is staff's opinion that the placement of permanent barriers as shown on the approved plan would further improve traffic circulation. It would also allow the applicant to install the approved landscaping which would greatly enhance the appearance of the site.
