Re: Findings of Fact, application of L&M Partnership to amend an approved planned
unit development consisting of 150 residential units, a 61 room hotel, a 20, 000 square
foot movie theater (1000 seats), a 22,500 square foot restaurant/retail/indoor
recreation building, a 3,500 square foot restaurant with drive -through service, and
a bank with drive -through service, Shelburne Road.
On the 27th of September, 1994, the South Burlington Planning Commission approved
the request of L&M Partnership for revised final plat approval under Section 204 of
the South Burlington Subdivision Regulations based on the following findings:
1. This project consists of amending the 150 unit residential portion of the L&M Park
PCD project by relocating a 30 unit multi -family building (#5) . The sketch plan was
reviewed on 8/23/94. The applicant must obtain a conditional use permit from the
Zoning Board of Adjustment to relocate building #5.
2. Access/circulation: Access to this portion of the development is via a curb cut
on Fayette Road. This access will not change. Access to building #5 on the
approved plan is via a shared driveway with building #4. The proposed plan shows
building #5 as having its own driveway.
Circulation is adequate.
3. Coverage/setbacks: Residential portion of PCD: Building coverage is 42,560
square feet (maximum allowed is 191,054 square feet). Overall coverage is 152,968
square feet (maximum allowed is 382,108 square feet).
Setbacks requirements are being met.
4. Parking: A total of 338 parking spaces are required for the residential portion
and the plan shows 339 spaces including 18 handicapped spaces.
5. Landscaping: Landscaping associated with building #5 will be relocated along
with the building. The new building location will result in the removal of several
large apple trees. Any trees lost should be made up by increasing the landscaping
on the site by an equal dollar value.
6. Dumpsters : The two (2) existing dumpsters are not located in the approved
locations and they are not screened as required.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission
approves the revised final plat application of L&M Partnership to amend an approved
planned unit development consisting of 150 residential units, a 61 room hotel, a
20,000 square foot movie theater (1000 seats), a 22,500 square foot
restaurant/retail/indoor recreation building, a 3,500 square foot restaurant with
drive -through service, and a bank with drive -through service, located on Shelburne
Road. The amendment consists of relocating a 30 unit multi -family building (#5) and
associated parking as depicted on a four (4) page set of plans, page 1 entitled "L&M
Park, South Burlington, Vermont, Overall Site Plan" prepared by Fitzpatrick -
Llewellyn, Inc. and dated June, 1990 with a last revision date of 9 / 20 / 94 , with the
following stipulations:
1. All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. The two (2) existing dumpsters which are not located in their approved locations
must be relocated to their approved locations and screened prior to issuance of a
zoning/building permit for any building in the development.
3. The final plat plans shall be recorded in the South Burlington land records within
90 days or this approval is null and void. The plans shall be signed by the Planning
Commission Chair or Clerk prior to recording.
4. The landscape plan shall be revised to show all existing apple trees and identify
those which will be relocated. If the relocated apple trees do not survive, or it is
determined by a landscape expert that the trees are unlikely to survive, the
applicant shall plant additional landscaping of a species, number and location
approved by the City Planner.
