Re: Findings of Fact, application of John Larkin and Gerald Milot to amend an
approved planned commercial development consisting of 150 residential units, a 61
room hotel, a 20,000 square foot movie theater (1000 seats) a 22,500 square foot
restaurant/retail/indoor recreation building, a 3500 square foot restaurant with
drive -through service, and a bank with drive -through service, located on Shelburne
Road. The amendment consists of revising the location of residential building #4 and
associated parking.
On the 8th day of October, 1996, the South Burlington Planning Commission
approved the request of John Larkin and Gerald Milot for revised final plat approval
under Section 204 of the South Burlington Subdivision Regulations based on the
following findings:
1. This project consists of amending an approved planned commercial development
consisting of 150 residential units, a 61 room hotel, a 20,000 square foot movie
theater (1000 seats), a 22,500 square foot restaurant/retail/indoor recreation
building, a 3500 square foot restaurant with drive -through service, and a bank with
drive -through service, located on Shelburne Road. The amendment consists of
revising the location of residential building #4 and associated parking. The building
is proposed to be relocated 45 feet to the west. The last review of this site by the
Planning Commission was on 9 / 27 / 94 when building #5 was relocated.
2. Access/circulation: Access to this portion of the development is via a curb cut
on Fayette Road. This access will not change. Access to building #4 will be
relocated 45 feet to the west.
Circulation on the site is adequate.
3. Coverage/setbacks: Residential portion of PCD: Building coverage is 42,560
square feet (maximum allowed is 191,054 square feet). Overall coverage is 152,968
square feet (maximum allowed is 382,108 square feet) .
Setback requirements are being met.
4. Parking: A total of 338 parking spaces are required for the residential portion
and the plan shows 339 spaces including 18 handicapped spaces.
5. Landscaping: Landscaping associated with building #4 will be relocated along
with the building. The landscaping plan should be revised to include the entire
residential site and show all existing and proposed landscaping.
6. Other:
--- the site plan should show Fayette Road as currently constructed (i. e. , no cul-
de-sac, road extended to northerly boundary, etc.) .
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission
approves the revised final plat application of John Larkin and Gerald Milot to amend
an approved planned commercial development consisting of 150 residential units, a
61 room hotel, a 20,000 square foot movie theater (1000 seats) , a 22,500 square foot
restaurant/retail/indoor recreation building, a 3500 square foot restaurant with
drive -through service, and a bank with drive -through service, located on Shelburne
Road. The amendment consists of revising the location of residential building #4 and
associated parking, as depicted on a three (3) page set of plans, page one (1)
entitled L&M Park South Burlington, Vermont Overall Site Plan" prepared by
Fitz Patrick- Llewellyn, Inc., dated June, 1990, last revised 7/11/96, with the
following stipulations:
1. All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
2. The plans shall be revised to show the changes listed below and shall require
approval of the City Planner. Three (3) copies of the approved revised plans shall
be submitted to the City Planner prior to recording.
a) The landscaping plan shall be revised to include the entire residential
portion of the site and shall show all existing and proposed landscaping.
b) The site and utilities plan and the overall site plan shall be revised to show
Fayette Road as currently constructed (i.e., no cul-de-sac, road extended
to northerly boundary, etc.) .
3. Any change to the plan shall require approval from the South Burlington
Planning Commission.
4. The final plat plans shall be recorded in the land records within 90 days or this
approval is null and void. The plans shall be signed by the Planning Commission
Chair or Clerk prior to recording.
