DECISION AND FINDING OF FACT
On the loth day of March, 1997, the South Burlington Zoning Board
of Adjustment heard testimony regarding a variance application of
J.W.J. Realty d.b.a. Saturn of South Burlington, 1095 Shelburne
Road, this meeting was attended by James Lamphere.
Based upon the testimony provided at the above mentioned public
hearing and the documents submitted to the Zoning Board of
Adjustment which are contained within the "document file" for this
application, the Zoning Board finds, concludes, and decides as
follows:
Findings of Fact
1) The area in question zoned C-1 District.
2) Existing uses, automobile sales and service are conditional
uses within C-2 District.
3) The existing structure contains 8320 square feet, the proposed
addition contains 2520 square feet.
4) Automobile sales within C-1 District is a non -conforming use.
5) The ZBA granted permission (4/13/92) to construct a second
building on a 5.3 acre parcel.
6) The applicant has since purchased an adjoining lot former
Charlie's Tennis Den.
Conclusion
1) The assemblage of the parcels in question provides 400 foot
frontage and a total land area of 5.3 acres.
2) The original dealership was constructed prior to a zoning
classification that changes the permitted uses.
3 ) The Saturn dealership is an extension of a non -conforming sue,
this non -conformity is a result of a zone change and not due
to an action by the appellant.
4) Several automobile dealerships are located along Shelburne
Road, therefore, the character of the area will not be
altered.

5) During the 1992 planning and zoning review the proposed
addition was shown on the plan as a future expansion.
6) The addition as proposed should not alter the traffic
movements or increase the total vehicle trip ends.
Based upon the findings and conclusion setforth above, the Zoning
Board of Adjustment hereby grants the applicant request to
construct a 42'x 60' addition to an existing dealership d.b.a.
Saturn of South Burlingto9,llpFate_i at 1095 Shelburne Road.
