HomeMy WebLinkAboutVR-95-0000 - Decision - 1085 Shelburne Road (2)STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON DECISION AND FINDING OF FACT On the 25th day of September 1995 the South Burlington Zoning Board of Adjustment heard testimony regarding a variance application of Susanne Wilkins, Gary Lavigne agent, 1085 Shelburne Road (formerly Charlie's Tennis Den) this meeting was also attended by Mr. William Savoie. Based upon the testimony provided at the above mentioned public hearing and the documents submitted to the Zoning Board of Adjustment which are contained within the "document file" for this application, the Zoning Board finds, concludes, and decides as follows: Findinqs of Fact 1) The area in question is zoned Commercial 1 District. 2) Automobile sales and service is prohibited within the C-1 District, therefore, the two existing auto dealerships are non -conforming uses. 3) The lot in question contains 24,750 square feet and is non- complying to the minimum lot size. 4) No lot merger is planned at this time due to ownership of the lot. 5) The proposed plan involves demolition of existing structure and construction of a vehicle display lot. Conclusion 1) Expansion of display area for existing automobile dealership will not impair character of neighborhood because other auto dealership are in close proximity. 2) Small lot setforth over 35 years ago, appellant did not create this hardship. 3) In the future, lots may be merged and resubdivided in order to create two conforming lots. 4) Curb cut located to northerly side of lot will be designated as one-way entry. 1 5) Property could be developed in conformity with another use, however, proposed use represents the highest and best use. Based upon the findings and conclusion set -forth above, the Zoning Board of Adjustment hereby grants the applicants request to develop a lot located at 1085 Shelburne Road into a automobile display area for 48 vehA /f I , _ Chairman, South Burlington Zoning Board of Adjustment OCT 2 3 IM 2
