HomeMy WebLinkAboutVR-85-0000 - Decision - 1080 Shelburne Road (3)STATE' OF VE'NMUNT COUNTY OF C11IT`1'I NDEN CITY OF SOUTH BURLINGTON DECISION & FINDING OF FACT On the 7th day of October , 198 5 , the South Burlington Zoning Board of Adjustment heard evidence regarding the appeal of Anthony Perry, 1080 Shelburne Road based on the following facts and findings: 1) The severe setback restrictions in this area from Shelburne Road, and the placement of the structure on the lot make other placement of the deck very difficult. 2) The improvement as proposed will substantially improve the visual and aesthetic aspects of the property. 3) Consistent with the intent of the control of front yard setbacks. 4) If deck were on ground level as a patio instead of 18 inches above, it would be permitted. t 5) Stipulation protects any future development of highway or other improvement within this area. a Based upon the above stated facts and findings the appellant's request for a variance/1C]Q)034AX),pMM)J NXX is hereby approved/AxnAmA. Stipulations: (1) That if utilities need be laid within the right-of-way, any impedments such as trees, berms etc. shall be removed at the expense_ of the owner. An agreement protecting this condition to be approved by the City Attorney and recorded in City records. (2) The deck is proposed be limited to seating only, no further extension or covering will be permitted without review by the Zoning Board of Adjustment. Chairman
