10) ESTIMATED TRAFFIC: Traffic is expected to decrease as a result of this change. While
Shearer hopes to increase the number of customers for the dealership by approximately
10 per day, this increase is considerably less than the number of customers previously
going to the car rental use.
11) PEAK HOURS OF OPERATION: The auto sales use in the former auto rental building is
expected to have peak hours between 1 and 3 pm.
12) PEAK DAYS OF OPERATION: The peak days for auto sales use in the former auto
rental building are expected to be Monday, Friday and Saturday.
13) ESTIMATED PROJECT COMPLETION DATE: auto sales use will commence
sometime between September 1 and December 31, 2005.

Mr. Austin stepped down due to a conflict of interest.
Mr. White said they have received a variance for the auto rental
use. They will put in street trees. There are no site changes
anticipated as they will use the existing building.

7. Sketch plan application of Pizzagalli Investment Co. to
subdivide a 7.8 acre lot into three lots of 1.2 acres (lot #1),
3.3 acres (lot #2) and 3.3 acres (lot #3), 750 Hinesburg Rd:
Mr. Bouchard explained that the property is bordered by I-89,
Hinesburg Rd. and Old Farm Rd. There is a deeded 60 ft. right of
way owned by the city. There is also a proposed Interstate ramp
requiring a 50 ft. setback.
Mr. Weith noted the planned interchange is on the Official City
Map but is not in the MPO plan or in state plans at present.
Because it is still on the Official City Map, the proposed plan
does not comply with the city plan. Mr Austin noted that if the
Commission rejects the plan, the city has a certain period of
time in which to purchase the land.
Mr. Weith said the Commission is not bound to turn it down
because the wording in the Comprehensive Plan is flexible and
does not name the actual site. If the City Council says they
don't want the land, the plan can go ahead. Mr Weith suggested
the applicant meet with the Council before final plat.
Mr. Bouchard said they need direction on what they can do with
the land as they are turning away too many customers. Mr Burgess
said if they are planning to turn the road over to the city, they
will have to have a turn -around at the end of the street until
there is a connection with the Tilley property. This would be
for plowing and emergency vehicles. He said the Planning Com-
mission would try to get an answer from the city on the Inter-
change before the Public Hearing.

MOTION OF APPROVAL
SHEARER MOTOR COMPANY, LTD.
I move the South Burlington Planning Commission approve the site
plan application of Shearer Motor Company, Ltd., to convert a 912
square foot building from retail (photo developing) to auto rental
use on a 3.06 acre parcel also containing an auto sales and service
facility, 1030 & 1048 Shelburne Road, as depicted on a site plan
entitled "Proposed Auto Rental Facility, 1048 Shelburne Road, South
Burlington, VT", prepared by Graphic/Construction Management
Services, Inc., dated 12/31/95, with the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. For the purpose of calculating required road impact fees under
the South Burlington Impact Fee Ordinance, the Planning Commission
estimates that the proposed change in use will generate zero (0)
additional vehicle trip ends during the P.M. peak hour.
3. The Planning Commission approves a sewer allocation of 120 gpd.
The applicant shall pay the per gallon fee prior to permit
issuance.
4. The applicant shall post a $1738 landscape bond prior to
issuance of a zoning permit. The bond shall remain in effect for
three (3) years to assure that the landscaping takes root and has
a good chance of surviving.
5. Any new exterior lighting shall consist of downcasting shielded
fixtures so as not to cast light beyond the property line. Any
change in lighting shall be approved by the City Planner prior to
installation.
6. The applicant shall obtain a zoning permit for the change in
use within six (6) months or this approval is null and void.
7. The applicant shall obtain a Certificate of
Occupancy/Compliance from the Administrative Officer prior to use
of the newly constructed space.
8. Any change to the site plan shall require approval by the South

6) SHEARER MOTOR COMPANY, LTD - AUTO RENTAL - SITE PLAN
This project consists of converting a 912 square foot building from
retail (photo developing) to auto rental use on a 3.06 acre lot
also containing an auto sales and service facility. The ZBA on
6/26/95 granted the applicant a use variance for the auto rental
use since this use is not permitted in the district.
This property located at 1030 and 1048 Shelburne Road lies within
the Cl District. It is bounded on the north by a motel, on the
west by Shelburne Road, on the south by a restaurant, and on the
east by Orchard School.;,<

Access/circulation: The property is served by two ( 2 ) 32 foot curb i
cuts and a 22 foot curb cut. No changes proposed.
Circulation is adequate.
Coverage/setbacks: Building coverage is 18.7% (maximum allowed is
30%). Overall coverage is 93.6% (maximum allowed is 70%). Front
yard coverage is 91.5% (maximum allowed is 30%). Overall and front
yard coverages are existing and will not be made worse by this
application.
The auto dealership and auto rental buildings do not meet the front
setback requirement and the accessory building (auto body shop)
does not meet the rear setback requirement. Additionally, there is
more than one (1) principal building on this lot and the lot has
less than four (4) acres and does not qualify as a PUD. These
buildings are therefore noncomplying structures subject to the
limitations of Section 26.002 of the zoning regulations.
Parking: A total of the (3) parking spaces are required and four
(4) spaces including one (1) handicapped space is being provided
for the auto rental use.
Landscaping: There is no minimum landscaping requirement, based on
building costs, for this project. Applicant is proposing to remove
two (2) Austrian Pine trees at the southwest corner of the
property. Five (5) Honeylocust trees will be planted along the
property's frontage in the Shelburne Road r.o.w. at staff's
recommendation. VAOT has approved the trees in the r.o.w. (see
enclosed letter). These trees have a value of $1738.

ti Traffic: This property is located in Traffic Overlay Zone 2 which
would allow this property to generate a maximum of 66.6 vehicle
Y trip ends (vte's) during the P.M. peak hour. ITE estimates the
existing uses to generate 69.3 vte's which is 2.7 vte's or 4% more
vte's than allowed. ITE estimates that the change in use from
retail to auto rental will decrease vte's by 2.5 for a total of
66.8 vte's.
Sewer: The sewer allocation requested is 120 gpd. The applicant
will be required to pay the per gallon fee prior to permit
issuance.
Lighting: Existing exterior lighting consists of the following:
--- seven (7) 400 watt high pressure sodium flood lights.
--- one (1) 400 watt mercury vapor flood light.
--- one (1) 250 watt mercury vapor light.
--- eleven (11) 400 watt mercury vapor lights.
No additional lighting proposed.
7) PIZZAGALLI INVESTMENT COMPANY - 3-LOT SUBDIVISION - SKETCH PLAN
This project consists of the subdivision of a 7.8 acre parcel into
three (3) lots of 1.2 acres (lot #1), 3.3 acres (lot #2) and 3.3
acres (lot #3). A sketch plan for this subdivision was reviewed on
1/9/90 and 3/13/90 (minutes enclosed).
This property located at 750 Hinesburg Road lies within the IC and
CO Districts. It is bounded on the north by a farm, on the west by
Hinesburg Road, on the south by I-89 and on the east by undeveloped
land.
Access: Access to the three ( 3 ) lots will be via a new public
street. This 60 foot r.o.w. was set aside in 1985 when the Tilley
farm received subdivision approval. The City has received an Offer
of Irrevocable Dedication for this new street.
Lot size/frontage: The minimum lot size of 40,000 square feet will
be met by all three (3) lots.
The minimum frontage requirement of 120 feet will be met by all
three (3) lots.

1. There exists a major drainage system across this property. It
should be shown on the plan.
2. There are easements for the water and sewer lines across this
parcel they should also be shown.
3. The sidewalk is continuous across the two northerly driveways
but not across the southerly one.
TILLEY PROPERTY - HINESBURG ROAD
1) The new street when extended easterly will intersect the
Digital Road. The Hinesburg Road intersection should be three
lanes and Hinesburg Road should include widening for right and left
turns. This road is State and permits for these will be required.
2) New street should have a sidewalk.
3) Lots should have shared curb cuts.

following stipulations:
1. A $1100 landscaping bond shall be posted prior to permit.
2. Parking shall be restricted to the designated area only.
There shall be no on -street parking.
3. The fence shall be moved approximately 30 feet north to
the parking line.
4. The front yard to the south of the newly placed fence
shall be landscaped with a salt tolerant pine, as approved by
the City Planner.
5. The required parking spaces shall be paved and striped.
6. The building permit shall be obtained within 6 months.
Mr. Burgess seconded, and the motion passed unanimously.
45, Site Plan application of Peter Val Preda for use of existing
building and construction of a 65-space parking lot for
Budget Rent-A-Car at 1048 Shelburne Road.
Mr. Lamoureux explained that Mr. Val Preda wants to use the
building for his offices. The parking area will be gravel,
and the former Hough Street will be paved with a grass strip
along the side. The front lawn is already paved. The Zoning
Board said there would have to be more screening, so a cedar
hedge has been added and the area bermed slightly to continue
the berm started by Perry's Fish House. A few more trees
have been added as well. There will be a 6" drainage swale
along the parking lot. Overflow would go inside the berm
along the former Hough Street and into the gutter. Mrs.
Lafleur said the the City Manager wants an inlet in the swale
to prevent runoff to Shelburne Rd. He also wants the
sidewalk on Shelburne Rd. at the entrance drive to be
replaced across the drive.
Regarding traffic, it was estimated that it would vary from
day to day. There will be some exchange of vehicles with the
Airport Parkway operation which mostly services the airport.
There will be no new car sales at the proposed facility but
some used cars might be sold there. Mrs. Lafleur noted the
traffic estimate is 1 vehicle per hour higher than standard,
but she could not indicate whether the road could handle the
additional cars. Mrs. Hurd said some other use in there
might produce more steady traffic. Mr. Lamoureux requested

they be allowed to wait until spring to put in the sidewalk
as it is late in the season.
Mr. McClary moved that the Planning Commission approve the
site plan application of Peter Val Preda for Budget Rent-A-
Car at 1048 Shelburne Road as depicted on a plan entitled
"Budget Rent-A-Car, Shelburne Road, South Burlington, Vermont
- Site Plan" prepared by Lamoreux, revised 10/30/85 with the
following stipulations:
1. A $270 landscaping bond shall be posted prior to permit.
2. An inlet shall be placed in the swale to prevent runoff on
to Shelburne Road sidewalk. The inlet shall be piped to the
Shelburne Road drainage system.
3. The sidewalk along Shelburne Road at the entrance drive
(former Hough Street) shall be replaced continuously across
the driveway.
4. A bond shall be posted for the sidewalk replacement in an
amount to be determined �2y the City Engineer.
5. The building permit shall be obtained within 6 months.

2004 sq. ft. building for a day-care center at 1600 Williston
Road (Mills Avenue access)
Mr. Swett said they will run a state-licenseii day care center
for 35 children, hours from 7 AM to 5:30 pm, Monday -Friday.
The building is 1-1/2 stories high, 22 ft. to the peak. They
will have an office on the 2nd floor. They have placed the
building as far from residences as possible, still retaining
the legal side yard. They feel the flow of kids in the
neighborhood is away from the street toward the park. They
have chosen sheet drainage. There is a storm drain, but
there is a telephone box behind it which keeps them from
running a pipe toward it., Landscaping exceeds the
requirement and includes a 70-unit cedar hedge. Mountain Ash
tress will be changed to maple. The parking area will be
blacktopped with spaces for 8 cars only.
Neighbors requested the City to appeal the Zoning Board
ruling allowing the building and asked for Planning
Commission support. They felt the applicant had not met
Criteria #3 "hardship," but had created the hardship them-
