Zoning compliance * Existing small lot ACCESSORY RESIDENTIAL UNITS Pursuant to Section 3.10(E) of the proposed Land Development Regulations, in any district where a single-family residence is a principal permitted use, one (1) accessory residential unit within or attached to a primary single-family residence or within an existing, permitted accessory structure may be permitted by the DRB in accordance with Article 14, Site Plan Review, and the following additional criteria: 1) Floor space of the accessory residential unit shall not exceed thirty percent (30%) of the total habitable area of the single-family dwelling unit. The total habitable area of the single family dwelling unit (including the area which is to be converted to the accessory unit) is 1,680 sq. ft.. The accessory residential unit is proposed to be 416 SF, or 24.8% of the habitable area of the principal dwelling. Thus, the applicant is in compliance with this criterion. 2) The principal dwelling shall be owner occupied. The owners currently reside in the principal dwelling. This shall remain the case. 3) The accessory dwelling shall be an efficiency or one -bedroom unit. The proposed accessory dwelling is a one -bedroom unit. 4) Adequate wastewater capacity is available to service the accessory unit, as demonstrated by the issuance of a Wastewater Allocation or on -site wastewater permit pursuant to the South Burlington Ordinance regulating the use of public and private sanitary sewage and stormwater systems. IdrbWaffcommen&20121 CU 12_02_42BerkleySt._Sohrabi CITY OF SOUTH BURLINGTON DEVELOPMENT REVIEW BOARD 3 DEPARTMENT OF PLANNING & ZONING The applicant will be required to obtain wastewater approval prior to issuance of a zoning permit. At this time staff does not foresee any restrictions on the applicant's ability to obtain wastewater allocation. 1. The applicant shall obtain wastewater approval prior to the issuance of a zoning permit. 5) Two additional off-street parking spaces shall be provided on the same lot, either in a garage or a driveway, or not in any areas required to meet coverage limitations, or any front yard other than a driveway, required by these Regulations. The applicants have provided photographs of how they believe they meet the criteria above. The DRB should discuss this item and seek additional testimony as appropriate. 2. The DRB should discuss the availability of parking on the site. 6) If occupancy of the unit is to be restricted in the deed of the single-family home to a disabled person, no additional off-street parking is required. No such deed restrictions are proposed. This criterion is not applicable. 7) A zoning permit shall be required for the accessory residential unit. A zoning permit shall be required. 3. The applicant shall obtain a zoning permit from the Administrative Officer for the accessory residential unit. CONDITIONAL USE CRITERIA Pursuant to Section 3.10(E), Conditional Use Review by the Development Review Board pursuant to Article 14, Section 14.10 shall be required if the establishment of the accessory residential unit involves the "construction of a new accessory structure, an increase in the height or floor area of the existing single-family dwelling..... " The DRB must find that the proposed uses will not adverselv affect the followina: 1) The capacity of existing or planned community facilities. Staff does not feel that the proposed addition of a one bedroom apartment will have an undue adverse effect on planned education or municipal facilities. 2) The character of the area affected, as defined by the purpose or purposes of the zoning district in which the project is located, and specifically stated policies and standards of the municipal plan. The proposed project will be a one-story residential addition to the existing one-story house. Building & Lot coverage, setback, and height standards are all proposed to be met. The LDRs permit an entry staircase to extend up to five (5) feet into the required setback. The property is an existing small lot — lot size is 8,395 and the minimum for the district is 9,500. Section 3.05(C) of the LDRs states: "Any lot in individual and separate and nonaffiliated ownership from surrounding properties in existence on the effective date of these Regulations may be developed for the purposes permitted in the district in which it is located, even though not conforming to minimum lot size requirements, if such lot is not less than one -eighth (1/8) acre in area with a minimum width or depth dimension of forty (40) feet." 4. The Board should take evidence and discuss the application's compliance with this section. 3) Traffic on roads and highways in the vicinity. Staff feels that the addition of one or two residents will have negligible affects on traffic in the vicinity. 4) Bylaws and ordinances then in effect. The proposed project is in keeping with regulations, provided the applicant obtains adequate water and sewer allocations. 5) Utilization of renewable energy resources. The proposal will not affect renewable energy resources. RECOMMENDATION Staff recommends that the Development Review Board gather testimony and, if appropriate, close the public hearing Conditional Use application #CU-12-02.
